January 22, 2007 Mayor Tinnell introduced Pastor Jack Roberts from Maryville Baptist Church to give the invocation.
The Pledge of Allegiance to the Flag was said. Mayor Tinnell called the meeting to order at 6:31 p.m. In attendance were Council members Stacey Cline, Bonnie Enlow, Tony Miller, Margaret Moore, Faith Portman, and Trina Summers. Stacey Cline made motion to dispense with reading of 1/8/2007 meeting minutes. Faith Portman 2nd. Motion carried 6-0. (The minutes were not approved but will be done so at the February 12th meeting.) Mayor Tinnell announced that the gym would be closed for several weeks while the floor is being finished. Trina Summers made motion to bring the discussion on request from Associated Title Company to subrogate mortgage of Jackie Carrier off the table for further discussion. Margaret Moore 2nd. Motion carried 6-0. Mark Gotschall with Associated Title Company was present to answer any of the Council’s questions. He stated that Ms. Carrier was refinancing her home for $89,500. Tony Miller made motion to approve subrogation due to the fact that we’ve done this in the past. Stacey Cline 2nd. Motion carried 6-0. Further discussion followed on request from Shepherds Glen subdivision to take over streets, street lights and pump station. Stacey Cline made motion to accept. Faith Portman 2nd. After further discussion Ms. Cline withdrew her motion and Ms. Portman withdrew her 2nd. Stacey Cline then made motion to take over streets, street lights and pump station paying only current bills and bills due henceforth. Faith Portman 2nd. Motion carried 6-0. City Attorney Joe Wantland had first reading of Ordinance 007-(number to be assigned) on request from First Federal Savings Bank to rezone 2.0 acres, more or less, from R-3 Residential to B-2 Central Business located at the southeast intersection of Highway 44 East and Huston Drive. The second reading will be February 12th. Depp Rasner was again present from the County Beautification Committee to update the Council on the beautification project the County is involved in. Mr. Rasner reported that the TE 21 effort for the ramp beautification is underway. He stated the committee is getting involved in city projects they would like to see done such as an Adopt A Highway program. He also stated letters of intent are being sent for the ramp project along with support letters for the various other projects. There was no report from the Recreation Committee. There was no report from the Sewer Committee. Tony Miller made motion to approve payment of January bills. Faith Portman 2nd. Motion carried 6-0. Bob Meek with Boy Scout Troup 868 updated the Council on the finishing touches to the Community Center. He stated that new kitchen appliances need to be purchased (electric stove and refrigerator) and the floor needs to be sealed. After some discussion Trina Summers made motion to authorize the Mayor to negotiate on the kitchen appliances and floor sealing not to exceed $2000 on this project. Tony Miller 2nd. Motion carried 6-0. At this time Judge Rodney Burress swore in new City Attorney Bill Wilson. Mr. Wilson presented outgoing City Attorney Joe Wantland a plaque in appreciation of all his hard work over the last several years he’s done for the City. Terry Edwards addressed the Council regarding the Civil Service Ordinance stating he was speaking for the citizens of Shepherdsville. He stated that the people spoke that they wanted change. He stated this Ordinance was voted as a conspiracy and that it was a mistake. He stated the Council “stepped on our constitutional rights” and he would like the Ordinance to be rescinded and a new Ordinance be written. He stated that he had spoken with a state and federal agency about the legality of the Ordinance. Clinton Saul addressed the Council regarding the Civil Service Ordinance calling on the Council members. He stated he feels the Civil Service Ordinance is not fair because the Mayor’s hands are tied. He stated the Mayor was elected to run the City and asked the Council to untie his hands to be able to lead the City. He asked that the proper action to taken to fix this. Jeff Schank addressed the Council stating that he was not present as an officer of the Shepherdsville Police Department. He stated that the Civil Service Ordinance benefits all the City’s employees. He stated he is here as Treasurer of the Shepherdsville FOP and if the Ordinance is changed it will be a big step backwards. Planning Commission Appointee Ben Robards reported there was one case for Shepherdsville. First Federal Savings Bank has requested a zoning change for 2.0 acres, more or less from R-3 Residential to B-2 Central Business. The property is located at the southeast intersection of Highway 44 East and Huston Drive. He stated the request had received a favorable recommendation from the Planning Commission. Board of Adjustments Appointee Duane Price reported there was nothing new for Shepherdsville. Police Chief Ron Morris stated he would like to commend the police department for their work on the train derailment. Councilwoman Stacey Cline thanked the fire fighters, police officers and all who helped feed the fire fighters during this time. Councilwoman Faith Portman also thanked the fire fighters and police officers and everyone who contributed during this time. Councilwoman Bonnie Enlow stated she had received a call from Bullitt County Septic about Rumpke crushing the garbage in the truck on their parking lot. The City Clerk stated she would contact Rumpke again about this problem. Councilwoman Enlow also stated that she had done research on the Civil Service Ordinance and citizens are concerned. She stated she thinks we need the Civil Service but some employees want it changed. Bonnie Enlow made motion to rescind the Civil Service Ordinance. Margaret Moore 2nd. Mayor Tinnell stated he feels with all the information Mr. Edwards has brought forth it should be turned over to Counsel for review. He also stated that for the record no one was fired while he was Mayor for five years. Mayor Tinnell stated since he left the employment ranks are upside down. He feels people have been mistreated here. He stated he would never mistreat anyone who needs to protect their family. Mayor Tinnell stated that before we call for a vote he would ask that the motion be tabled. Bonnie Enlow and Margaret Moore withdrew their motion and 2nd and agreed to table. Bonnie Enlow made motion to table discussion on rescinding the Civil Service Ordinance. Stacey Cline 2nd. Motion carried 6-0. Faith Portman made motion to adjourn to executive session to discuss personnel and litigation. Stacey Cline 2nd. Motion carried 6-0. Faith Portman made motion to return to regular session. Bonnie Enlow 2nd. Motion carried 6-0. Mayor Tinnell stated there were no decisions on litigation or personnel. Trina Summers made motion to adjourn. Faith Portman 2nd. Motion carried 6-0.
