Pastor Drew Prince, First Baptist Church of Shepherdsville gave the invocation. The Pledge of Allegiance to the Flag was said. Mayor Tinnell called the meeting to order at 6:30 p.m. In attendance were Council members Stacey Cline, Bonnie Enlow, Tony Miller, Faith Portman, and Trina Summers. Stacey Cline made motion to dispense with reading of 2/26/2007 regular and 3/6/2007 special meeting minutes. Trina Summers 2nd. Councilman Tony Miller said he would abstain from voting on the minutes since he was not in attendance at the called meeting. Stacey Cline stated she would do separate motions to allow Mr. Miller to vote. Stacey Cline withdrew her motion and Trina Summers withdrew her second. Stacey Cline made motion to approve 2/26/2007 minutes. Trina Summers 2nd. Motion carried 5-0. Stacey Cline made motion to approve 3/6/2007 meeting minutes. Trina Summers 2nd. Motion carried 4-0-1. (Tony Miller abstained.) City Attorney Wilson had second reading and public hearing on Ordinance 007-(number to be assigned) concerning request from CRT Properties, LLC to rezone 1.81 acres, more or less, from Agricultural to B-1 Highway Business for property located at the north east intersection of Old Preston Highway South and Cedar Grove Road. There was no public comment. Stacey Cline made motion to accept the Planning Commission’s recommendation. Trina Summers 2nd. Motion carried 5-0. (This Ordinance will be numbered 007-717.) Depp Rasner gave a report on the County Beautification project. He reported that March 15th was the deadline for the grant application for ramp beautification. He stated the Committee needed to raise $500,000 in cash or in kind services and they were just shy of that number. Mr. Rasner also reported on the Operation Bright & Beautiful project. He stated there was going to be a clean up of the whiskey barrels on Buckman and at the city entrances. He asked anyone interested in helping meet at the Conference Centre at 9:00 a.m. on Saturday, March 17th. There was no report from the Sewer Committee. City Attorney Wilson had first reading of Ordinance 007-(number to be assigned) amending Ordinance 003-580 an ordinance establishing the position of Fire Marshal for the City of Shepherdsville, Bullitt County, Kentucky fixing the qualifications, tenure and compensation. Councilwoman Trina Summers asked that two changes be made to the ordinance; adding qualifications and have fire level 1 experience. (Margaret Moore came in at this time.) Mayor Tinnell stated that at the last meeting the Council was presented with a list of three names for the new Civil Service Commission Board: David Billings, Darvin Hill and John E. Lee. Bonnie Enlow made motion to accept Mr. Billings, Mr. Hill and Mr. Lee to serve on Civil Service Commission Board. Margaret Moore 2nd. Motion failed 2-3-1. (Tony Miller abstained.) Mayor Tinnell stated we do not have a Civil Service Board and that he will submit more names to the Council. Clinton Saul addressed the Council about whether the gym had been designated as a shelter in case of severe weather. City Attorney Wilson stated he would call the insurance company and speak with them about this, we can then set criteria for use of the gym in severe weather conditions. Mr. Saul also stated that the City should also have something in place to cover pets for people who have to leave their homes. Mr. Saul also spoke on the Civil Service Ordinance. He stated he did support the Civil Service but felt one place in the Ordinance has bad wording. He stated he would like to see some preference added to the ordinance for honorably discharged veterans and suggested implementing a point system. Mr. Saul also spoke on the fire lawsuit. He stated Chapter 95 talks about a regular fire department. He stated in his opinion a full time paid department is a regular fire department. He stated there is a huge gap in the budget between police and fire and he would like to see the City seek a full time fire department. City Attorney Wilson stated the Council is paramount of the fire department issue and we will keep moving forward. Ted Korfhage was present to address the Council on the storm water issue. He stated the County is working on the storm water issue and we need something fair that will work for developers. He suggested setting up a committee to work on this project comprised of developers, engineers and interested parties so that no one is hurt by the guidelines set up to comply with this issue. Board of Adjustments Appointee Duane Price was present and reported that there was nothing new for Shepherdsville at the last meeting but there is going to be an emergency meeting on the 15th to discuss the Huber Station temporary trailer issue. Councilwoman Faith Portman stated she has received calls about the streetlights on Cliffside Drive. She stated the paint was peeling off the polls and asked if RECC or the City was responsible for repainting them. The City Clerk stated she would call RECC and ask who is responsible. Councilwoman Stacey Cline stated that due to the lack of any evidence of wrong doing she makes the motion to reinstall Jason Lee and Carol Richards to the Civil Service Commission Board. Trina Summers 2nd. City Attorney Wilson stated since this involves pending litigation it should not be discussed. Mayor Tinnell stated he would not call for a vote. Councilwoman Bonnie Enlow stated this would open the City up for a lawsuit and that this is a conspiracy. Councilwoman Trina Summers stated the way the terminations were handled also smocks of a conspiracy and has sullied reputations. Councilwoman Summers stated there is a motion on the floor with a 2nd and called for a vote. Councilwoman Cline stated she was told the Council was going to vote on one replacement to the Board, not three. She stated she also feels this is a conspiracy. Mayor Tinnell stated he wanted the talk of conspiracy dropped on both sides. At this time a vote was taken 3-2-1. Motion carries. Mayor Tinnell stated he would not reverse his decision at this time. Mayor Tinnell asked for a motion to go into executive session to discuss litigation and personnel. City Attorney Wilson asked that Fire Chief Brad Whittaker and City Engineer Toby Spalding be asked to join Executive Session. Bonnie Enlow made motion to adjourn to executive session to discuss personnel and litigation. Margaret Moore 2nd. Motion carried 5-1. (Trina Summers voted against.) Faith Portman made motion to return to regular session. Tony Miller 2nd. Motion carried 6-0. Mayor Tinnell stated no decisions were made. Bonnie Enlow made motion to adjourn. Stacey Cline 2nd.
