May 14, 2007 Pastor Crenshaw, Vine Hill Baptist Church gave the invocation. The Pledge of Allegiance to the Flag was said.
Mayor Tinnell called the meeting to order at 6:34 p.m. In attendance were Council members Stacey Cline, Bonnie Enlow, Tony Miller, Faith Portman and Trina Summers. Stacey Cline made motion to dispense with reading of 4/23/2007 regular meeting minutes and 5/8/2007 special meeting minutes. Bonnie Enlow 2nd. Motion carried 5-0. Stacey Cline made motion to approve 4/23/2007 and 5/8/2007 minutes as printed. Bonnie Enlow 2nd. Motion carried 5-0. Mayor Tinnell announced City Hall would be closed Monday, May 28th in observance of Memorial Day and canceled the Council meeting scheduled for May 28th. Jim Smith, Patti Kaelin and Diana Cohen with the Louisville Water Company were present to address the Council regarding initiating a monthly billing pilot program beginning July 2007.They reported the increased cost to the City for sewer billing would be approximately $6300 and asked that any Ordinance which refers to bi-monthly billing be changed. Mayor Tinnell stated he thinks this is a positive thing and that it would take burden off people. He also stated it would be easier to catch leaks and get them fixed within one month versus two months. There was no Beautification Committee or Sewer Committee report. City Attorney Bill Wilson had first reading of Ordinance 007-(number to be assigned) on rezoning request by Bluegrass Safe Storage, LLC and Doris and Elwood Dawson to rezone 40.88 acres, more or less, to IL Light Industrial and .60 acres, more or less, to R-2 Residential for property located at 412 Cedar Grove Road, property to the rear of 412 Cedar Grove Road and property abutting the west property line of 360 Cedar Grove Road from B-1 and Agricultural. Mayor Tinnell stated there would be no speakers on this rezoning request tonight, public comment would be heard on June 11th. Councilwoman Stacey Cline stated she had looked at this property and it’s a mess. Councilwoman Faith Portman stated she feels there is a major drainage issue where the shale is. People did not have water problems until now. City Engineer Toby Spalding stated all drainage issues will be addressed through plan review. City Attorney Wilson had first reading of Ordinance 007-(number to be assigned) amending Ordinance 006-696 an Ordinance amending Ordinance 006-689 an Ordinance providing personnel policies and procedures for all employees of City Government pertaining to hospitalization fringe benefits. City Attorney Wilson read Resolution authorizing the filing of a U.S. Environmental Protection Agency Grant Application. Faith Portman made motion to approve. Bonnie Enlow 2nd. Motion carried 5-0. Discussion was held on request from Frank Reading, 258 7th Avenue about putting streetlights up on 7th Avenue. Mayor Tinnell asked Public Works Foreman Jesse Walls to contact L G & E and have them come out and do a site assessment. Public Works Foreman Walls stated 5th Avenue also needs streetlights. Stacey Cline made motion to approve May bills. Bonnie Enlow 2nd. Motion carried 5-0. Christy Gartner with Bullitt County Uthfest was present to address the Council about having the event at First Street Park this year. She stated it was an annual free Christian concert that brings in top Christian artists to perform. September 15th is the concert date and a tentative date of July 28th is a car cruise, an outreach for Rescue Atlanta. Mayor Tinnell stated we would make a decision at the June 11th meeting. Planning Commission Appointee Ben Robards reported there was one rezoning case for Shepherdsville. The Shepherdsville Congregation of Jehovah’s Witnesses has requested 5.5 acres, more or less, located at the intersection of Charles Hamilton Highway and a road formally known as Maraman Road in the City just south of Highway 480 be rezoned from R-1 Residential to B-1 Highway Business. Mr. Robards stated the Planning Commission approved the request. Board of Adjustments Appointee Duane Price reported there were two cases concerning Shepherdsville. Prologis has requested a variance to reduce the number of parking spaces from 1614 to 328 for property at 350 Omega Parkway in the Cedar Grove Business Park; and Sai Hath, LLC has requested a variance to reduce the size of parking spaces from 200 sq. ft. to 171sq. ft. and a variance to allow construction of a four story hotel to an overall height of 74’, which exceeds the current allowed height by 35’ for property at 130 Spring Point Drive which is a street that will be constructed off of Paroquet Springs Drive. Mayor Tinnell stated we need to author a Text Amendment that addresses parking spaces. Mr. Price stated that Evelyn Fackler is currently working on making this change. City Engineer Toby Spalding reported he had two bids that needed to be approved by the Council. The first bid was for boring and jacking. He received two bids: Price Backhoe Service Inc. at $725.00 per foot and Midwest Mole, Inc. at $826.00 per foot. He recommended accepting the Price Backhoe Service Bid for $725.00 per foot. Faith Portman made motion to accept the Price Backhoe bid. Stacey Cline 2nd. Motion carried 5-0. Mr. Spalding stated the second bid was for pump station electrical comparison. The first bid was from Brite Electric for $54,643.89. The second bid was from Marine Electric for $88,221.00. Mr. Spalding recommended accepting the bid from Brite Electric for $54,643.89. Faith Portman made motion to accept bid from Brite Electric. Trina Summers 2nd. Motion carried 5-0. Code Enforcement Officer Jim “Mac” McAuliffe reported that he had been working on several code enforcement issues. He also asked that the Council give some thought to the adoption of a Code Enforcement Board so the City can handle cases in house instead of letting the money go to the County. Councilwoman Stacey Cline asked Mr. McAuliffe to look into Lakeview Apartments grass cutting. She stated they cut grass but never cut up to her property line which leaves a mess. Fire Chief Brad Whittaker reported applications are coming in for the paid positions. He also reported June 1-3 is Crusade for Children. Councilwoman Bonnie Enlow stated she feels each department should have a suggestion box. She is donating the first one and would like the City to purchase one for each department. Councilwoman Enlow also asked about people soliciting in the City. Police Chief Ron Morris advised Mrs. Enlow to call the police department and report soliciting. Councilwoman Enlow also asked about Shepherds Glen subdivision. She reported there were cracked sidewalks and a hole in the road (Clover Cove). She asked WWTP Superintendent Mike Schroeder if the sewers had been cameraed in the subdivision. He stated that they were. She asked if they were again cameraed after the subdivision was complete. He stated they were. Councilwoman Faith Portman thanked the FOP for the picnic they sponsored. She said everyone had a great time and suggested everyone try to attend next year. Councilwoman Portman also asked where Pat Welsh’s drainage problem was on the list. City Engineer Spalding stated he was 2nd on the list. Mayor Tinnell reported that he was putting together a crew of his own to work on problems like drainage. He asked to get a copy of Toby’s list and his crew would work on it. Councilwoman Stacey Cline asked about Robert Stottman’s property on Lee Street. PWF Walls stated they need to haul some dirt in. City Engineer Spalding asked about the mosquito disks the City had last year. PWF Walls stated they were going to purchase more this year and have on hand. Councilman Miller asked Councilwoman Enlow to read a letter to the audience involving the fire departments. It was a letter concerning no longer providing Shepherdsville Fire with mutual aid. Mr. Miller stated this is what the City is dealing with in this fire department litigation. Councilwoman Trina Summers stated she has been asked if the City could water the plants on Buckman Street. PWF Walls stated he would see this was done. Mayor Tinnell asked everyone to remember Councilman Miller as he is going in the hospital on Wednesday. Mayor Tinnell also reminded everyone about his “Mayor’s Night In” on May 21st at 7:00 p.m. He stated this will be very informal and if anyone has anything they would like to discuss with him or a department head please plan to attend. Mayor Tinnell asked for a motion to go into executive session to discuss property acquisition. Trina Summers made motion to adjourn to executive session to discuss property acquisition. Tony Miller 2nd. Motion carried 5-0. Faith Portman made motion to return to regular session. Bonnie Enlow 2nd. Motion carried 5-0. Councilwoman Bonnie Enlow stated the Council instructed the Mayor to inquire about property acquisition with City Attorney Bill Wilson. Faith Portman made motion to adjourn. Bonnie Enlow 2nd.
