July 23, 2007 Pastor Robert Stoess, Shepherdsville Church of Nazarene gave the invocation.
The Pledge of Allegiance to the Flag was said. Mayor Tinnell called the meeting to order at 6:32 p.m. In attendance were Council members Stacey Cline, Bonnie Enlow, Tony Miller, Margaret Moore, Faith Portman and Trina Summers. Stacey Cline made motion to dispense with reading of 7/9/2007 regular meeting minutes. Trina Summers 2nd. Motion carried 6-0. Trina Summers made motion to approve minutes as written. Margaret Moore 2nd. Motion carried 6-0. City Attorney Bill Wilson had second reading and public hearing on Ordinance 007-(number to be assigned) on request from Salt River Development Co., LLC to rezone 9.619 acres, more or less, to B-2 Central Business from R-3 Residential Restricted and 149.71 acres, more or less, to IL Light Industrial from R-3 Residential Restricted for property located at 2761 Cedar Grove Road. Ray Bannon, attorney for the applicant was present to answer any questions. Margaret Moore made motion to approve. Faith Portman 2nd. Motion carried 6-0. (This Ordinance will be numbered 007-727.) There was no report from the Beautification Committee. There was no Sewer Committee report. City Attorney Wilson had first reading on Ordinance 007-(number to be assigned) on request from Elizabeth Larimore, Penelope Pack, and Steve and Rochelle James to rezone 3 acres, more or less, from R-2 and R-3 Residential to B-2 Central Business for property located at 207, 237 and 247 Highway 44 West. Planning Commission Appointee Daryl Lee suggested the Council look at the set back on Plum Street. Mayor Tinnell stated he would like to appoint Ralph Lawson to fill the vacant position on the Ethics Committee. He stated there are two Democrats on the Committee at this time and the vacant position must be filled by a Republican. He stated Mr. Lawson is a Republican. Trina Summers made motion to approve. Stacey Cline 2nd. Motion carried 6-0. Stacey Cline made motion to approve payment of July bills. Faith Portman 2nd. Motion carried 6-0. Tammy Hogan, 170 Edgewood Avenue in The Pointe was present about a water problem on her property. She stated by digging the ditch it makes more water come on her property. Mayor Tinnell stated this is a blue line stream controlled by the Corps of Engineers and the City can’t do anything to this ditch. City Engineer Toby Spalding stated the trees need to be removed from the ditch and the Drainage Committee has discussed this problem being put on the list to improve the ditch with the direction of the Corps of Engineers. There were several residents from Old Ford Place in attendance to speak to the Council about a ditch in their subdivision. Tiffany Smith acted as spokesperson. She reported South Shore Drive ditches are filling up and there are algae, fungus and snapping turtles in them. Mayor Tinnell stated the problem has already been surveyed and estimates gotten to fix the problem. He stated it would be given to the Drainage Committee for review and put on the list by priority. Mayor Tinnell stated one homeowner has a pond on his property that the developer put in. He stated the list is prioritized by structural damage, safety issues, work being done in the area, size of job and cost of job. Planning Commission Appointee Daryl Lee had nothing new to report. Board of Adjustments Appointee Duane Price reported Tony Manley, 772 Cedar Grove Road requested a conditional use permit to allow mini storage warehouses on the property zoned B-1 Highway Business; a variance to construct mini storage warehouses that will encroach 25’ into the front yard setback requirement; and a variance to construct mini storage warehouses that will encroach 5’ into the rear yard setback requirement on property zoned B-1 Highway Business. Mr. Price also reported that Publishers Printing Company, 100 Frank E. Simon Avenue requested a variance to allow a building to be constructed to an overall height of 75’ which exceeds the 40’ current regulation on property zoned IL Light Industrial. Code Enforcement Officer Jim McAuliffe stated that Kevin and Janet Davis’ 22 year old daughter Leslie had a heart attack and was in critical condition. He asked everyone to say a prayer, call their churches and friends and also have them say a prayer. Mr. McAuliffe also reported that there has been great progress made at cleaning up Honeysuckle Trailer Park. He stated Angela is working very hard to get it cleaned up and should be commended. He stated they are going to set rules to either clean up or get out. City Engineer Toby Spalding reported the stop light on Highway 480 is working. Councilwoman Trina Summers commented about Police Chief Morris’ letter about official license plates. She stated she didn’t want to endanger anyone by not making undercover vehicles. She stated what she would like done is all City vehicles be marked with the City’s logo on them. Mayor Tinnell stated that any City owned vehicle should have official tags on them. He stated he is a firm believer in this and wants it done. Mayor Tinnell also stated there seems to always be complaints on decisions he’s made and frankly he’s tired of it. Councilwoman Stacey Cline reported that she received a call about a tree hanging over a fence from one neighbor’s yard to the other. They asked her if they could cut the tree hanging on their side of the fence. City Attorney Wilson stated you have to be careful when cutting a tree. You can’t have the tree be a nuisance to somebody else but he does not advise to cut it at this point. He suggested contacting an attorney for advice. Councilwoman Faith Portman stated she had attended the last Fiscal Court meeting and the fire department had been recognized for their assistance with the train derailment 6 months ago. She also stated she had received a call from someone who had called to reserve Frank Simon Park and when they got there someone was already there and said they were told first come first serve. She suggested putting up signs when the park is reserved so this problem won’t occur again. Ms. Portman also stated we need to contact Larry Belcher and Gary Tapp about widening Highway 44. Ms. Portman also reported that she had ridden with Police Officer Chad Ledington and enjoyed it very much. She stated the officer was kind and courteous to people. She stated we have a good police department but need a few more officers. She complimented and thanked the police department for allowing her to do this. Councilwoman Margaret Moore stated there are not enough picnic tables in the park. She stated if we are going to let people use the park we should provide tables for them to use. Councilwoman Moore also asked how far the walk is at the park. City Engineer Spalding stated he would find out. City Attorney Wilson stated in some parks there is a green dot every tenth of a mile. Mayor Tinnell asked for a motion to adjourn to executive session to discuss personnel. Margaret Moore made motion. Bonnie Enlow 2nd. Motion carried 6-0. Faith Portman made motion to return to regular session. Bonnie Enlow 2nd. Motion carried 6-0. Mayor Tinnell stated there was one decision on personnel. Faith Portman made motion to adjourn.
