The Pledge of Allegiance to the Flag was said.

 

Mayor Tinnell called the meeting to order at 6:30 p.m.

 

In attendance were Council members Stacey Cline, Bonnie Enlow, Tony Miller, Margaret Moore, Faith Portman and Trina Summers.

 

Stacey Cline made motion to dispense with reading of 7/23/2007 regular meeting minutes. Faith Portman 2nd. Motion carried 6-0. Faith Portman made motion to approve minutes as printed. Trina Summers 2nd. Motion carried 6-0. 

 

Mayor Tinnell announced that the next Mayor’s Night In would be Monday, August 20th at 7:00 p.m.

 

City Attorney Bill Wilson had second reading and public hearing on Ordinance 007-(number to be assigned) on request from Elizabeth Larimore, Penelope Pack, and Steve and Rochelle James to rezone 3 acres, more or less, from R-2 and R-3 Residential to B-2 Central Business for property located at 207, 237 and 247 Highway 44 West. Attorney Eric Farris was present on behalf of the applicants. He explained the reason for the zoning change is to bring the property into compliance with the comprehensive plan. He stated the ally would not be closed and that they did ask the Planning Commission to exclude the set back on

Plum Street
. Faith Portman made motion to approve rezoning request. Bonnie Enlow 2nd. Motion carried 6-0. (This Ordinance will be numbered 007-728.)

 

Charlie Hall was present to report from the Operation Bright and Beautiful Committee. Mr. Hall will be taking Depp Rasner’s place as Mr. Rasner has accepted a position with the County and Deputy Judge Executive. Mr. Hall stated there were several projects in planning: murals on the CSX underpasses; work with City and County businesses on a sidewalk plan; work done to the ditch in front of the new Republic Bank; and a signature fund raiser event to use exclusively in Shepherdsville. Mr. Hall stated more details would follow. He invited everyone to join the next meeting at 9:00 a.m. on August 23rd in the Judge’s office. All help will be appreciated.

 

There was no Sewer Committee report.

 

Bernice Bennett a resident of The Pointe subdivision (607 Beechwood) was present about a dust problem caused by the dirt road behind her property put in by the developers of the new subdivision on Highway 61. She stated that the dust was terrible. She called in and spoke with Code Enforcement Officer James “Mac” McAuliffe who spoke with the developers and the road is now being watered down to prevent so much dust from being stirred up. Ms. Bennett wanted to thank the City for the help and especially Mr. McAuliffe. She stated there had been a problem when Mr. Wetzel was on the Council with burning. They were burning large piles of trees. The fire department came out and put out the fires and someone from the Forestry Department came out and took care of this problem.

 

Planning Commission Appointee Daryl Lee had nothing new to report.

 

Board of Adjustments Appointee Duane Price called to say he had nothing new to report.

 

Assistant Chief Jon Garr with the fire department was present and reported that the fire department is working on an open burning ordinance they hope to have finished very soon. He also reported that the fire department had received two bids on the self contained breathing apparatus. Survivair’s bid was $5000 cheaper than MSA but he would like the Council to approve the bid from MSA. Bonnie Enlow made motion to approve bid from MSA. Margaret Moore 2nd. Motion carried 6-0. Assistant Chief Garr stated this was part of the loan package being put together for several items needed by the fire department.

 

Code Enforcement Officer Jim McAuliffe thanked the members of the Community and Council for their thoughts and prayers for Kevin and Janet Davis’ 22 year old daughter Leslie who had a heart attack. He stated she was home and getting better. Mr. McAuliffe also reported that he had contacted the Health Department and Louisville Water Company about Honeysuckle Trailer Park. He stated that a master plumber feels it is the Park owner’s responsibility to fix the problem. Mr. McAuliffe also stated there was going to be a County amnesty program on all tires. He stated he had looked over Salt River and has a meeting set up with County Judge Melanie Roberts and Jailer Danny Fackler at 8:00 a.m. tomorrow about cleaning the tires and other junk out of the river.

 

Councilwoman Trina Summers stated it is her opinion that the Police Chief should be offered his job back. Mayor Tinnell asked Councilwoman Summers to stop right there as this was a personnel issue and needed to be discussed in executive session. Councilwoman Summers also stated that we need to make sure the clearance is what it needs to be at the

underpass when the paving is complete so we do not have any accidents there. Ms. Summers asked City Attorney Wilson about the billboard issue. City Attorney Wilson stated he had been contacted by two billboard companies and that he had hoped he would have some specifics tonight. He stated he would contact the Council when he received more information. Councilwoman Summers stated the City needs to get rid of the old cars at the old Moore farm. Mayor Tinnell stated we hope to have an auction in October of all our surplus items. Councilwoman Summers also stated that City Attorney Wilson’s fee needs to be discussed with the pending Civil Service hearing approaching. Ms. Summers stated she feels that is part of his normal duties and the City should not be charged any extra. Mayor Tinnell stated he doesn’t think the City Attorney should put in all the extra time for nothing.

 

City Attorney Wilson announced that the upcoming Civil Service termination hearing would start on Tuesday, September 4th at 6:00 p.m.

 

Councilwoman Stacey Cline stated she would like to thank the police and fire departments and everyone who worked on the school project at Trinity Life Center. She stated it was very nice and helped a lot of people. Councilwoman Cline also wanted to thank Logan Haycraft for all his work to make the parks look good. She stated many people have told her how nice First Street Park is.

 

Councilwoman Faith Portman also thanked Trinity Life Center for hosting the Back To School Fair. She stated they gave away 900 backpacks. Councilwoman Portman also wanted to thank the many people and businesses who donated. She also thanked the police and fire departments for their participation. Councilwoman Portman stated she too has seen tons of families using the Park. She asked Mayor Tinnell if she could be appointed to the Recreation Committee. She stated she has several ideas on how to make the park even better. Ms. Portman also stated she feels we need stop signs at the park right away.  She stated there were some lights out at the Park that needed fixed and that we need to get more lighting by the walking path.

 

Councilwoman Bonnie Enlow reported that the Fire Department had looked into an Alpha Card system for the City to make ID cards. She stated we need to have ID cards for all employees. Councilwoman Enlow made motion to purchase the system at the cost of $1661.75, if we put it in ourselves. Councilwoman Enlow stated that Code Enforcement Officer Jim McAuliffe has volunteered to handle and maintain. She stated the City needs to have ID cards to be in compliance with NIMS. After some discussion on other options, Mayor Tinnell asked Councilwoman Enlow to get some other quotes. The problem lies with change in employees. At this time the City is getting ID cards made through Publishers Printing Company at no charge. Mayor Tinnell asked Councilwoman Enlow to withdraw her motion until we get more information. He stated we will discuss this more at the next meeting.

 

Bonnie Enlow made motion to approve insurance for Council members. Margaret Moore 2nd. Councilman Tony Miller asked why we need a motion if this has already been approved by the Kentucky League of Cities and others. Councilwoman Trina Summers asked why vote when this is already approved. City Attorney Bill Wilson stated he stands by what he’s already said. Councilwoman Enlow stated there is nothing wrong legally with it but it’s up to the City to make policy on it. Councilwoman Stacey Cline stated she was not voting on it. Councilwoman Faith Portman also stated she was not voting on it. Councilwoman Trina Summers stated she was not voting on it either, she stands by the City Attorney. Mayor Tinnell stated there was a motion on the floor unless Councilwoman Enlow and Moore wanted to rescind it. They did not. Mayor Tinnell called for a vote. 2 voted against and 4 did not vote. (Bonnie Enlow and Margaret Moore voted no. Stacey Cline, Trina Summers, Tony Miller and Faith Portman did not vote.)

 

City Attorney Bill Wilson stated he sent the Council a letter on tax issues that he was waiting for feedback on. He also stated the police department clerk was also waiting on feedback from the Council on police department collections procedures. City Attorney Wilson reported that the City had closed on the

Old Ford Road
property. He also reported that one of the two abandoned vehicles at the farm has a lien on it and that the bicycles are virtually untraceable. City Attorney Wilson also reported that the Fire Department litigation hearing has been rescheduled for September 27th. 

 

Mayor Tinnell asked for a motion to adjourn to executive session to discuss personnel. Stacey Cline made motion.  Faith Portman 2nd. Motion carried 6-0. Councilwoman Summers stated that two people had recording devices in the last executive session and she would like to leave all electronic devices in the meeting room. Mayor Tinnell agreed. He stated no recording devices will be brought into Executive Session.

 

Faith Portman made motion to return to regular session. Stacey Cline 2nd. Motion carried 6-0. Mayor Tinnell stated there was no decision made on personnel.

 

Faith Portman made motion to adjourn. Stacey Cline 2nd. Motion carried 6-0. Meeting adjourned at 8:11 p.m.
