August 27, 2007 Brother Chip Thorton, Bullitt Lick Baptist Church gave the invocation.
The Pledge of Allegiance to the Flag was said. Mayor Tinnell called the meeting to order at 6:31 p.m. In attendance were Council members Stacey Cline, Bonnie Enlow, Tony Miller, Faith Portman and Trina Summers. Trina Summers made motion to dispense with reading of 8/13/2007 regular meeting minutes. Faith Portman 2nd. Motion carried 5-0. Stacey Cline made motion to approve minutes as printed. Trina Summers 2nd. Motion carried 5-0. There were no reports from the Beautification or Sewer Committees. (Margaret Moore came in at this time.) Discussion followed on cost recovery procedure for the police department. Police Clerk Michaela Frank addressed the Council stated she has collected $22,000+. She stated there is approximately $29,000 out to be collected; and from what’s been sent to the collection agency only $119 has been collected. Mrs. Frank stated she is looking for suggestions on how to collect past due money; the collection agency is not working. City Attorney Bill Wilson stated he had talked with Michaela about the collection process; she’s collected approximately 50% of bills sent. Assistant Fire Chief Travis Bell stated that insurance companies are sent bills from the fire department. Michaela stated the police department bills persons found guilty of a misdemeanor or felony. Councilwoman Bonnie Enlow stated we need to eliminate sending bills for collection; it’s a waste of time. City Attorney Wilson stated one option is to send a letter on City stationary signed by the City Attorney stating further action will be taken if the bill is not paid. Stacey Cline made motion to pay August bills. Faith Portman 2nd. Motion carried 6-0. City Attorney Wilson stated he has been approached by the Drug Task Force about leasing the old City Hall Building and Probation and Parole about leasing the old Police Department building. He stated the Drug Task Force is looking at a 6-12 month lease for City Hall only; they do not want the fire department space for $1500-$2000 a month. Attorney Wilson stated that at present 402 square feet is leased out to Miller Consulting. He stated this would bring in approximately $55,000 per year if both buildings are leased. City Attorney Wilson stated he had spoken with two companies interested in placing billboards back on the City’s property. He stated since this is probably potential litigation it will be discussed in Executive Session. City Attorney Wilson also stated he has done some research on cemeteries in the City. He stated the City has the duty to protect cemeteries in the City limits. He also stated there is not a lot of risk letting someone going in and cleaning up the cemetery with the City’s input and monitoring. Code Enforcement Officer Jim McAuliffe stated he had checkout of the cemetery in question and it is very, very overgrown. He suggested letting the inmates go in and do the hard work; then allow the Sunday School go in and clean and finish. Mayor Tinnell stated the City will go in and kill the weeds and prepare for the clean up. All in favor of moving forward with this project. Shirley Lack was present to address the Council on Uninsured (Single Payer) Healthcare. She stated she would like the City to endorse single payer health insurance. Ms. Lack stated HR 676 provides healthcare for everyone. Councilwoman Faith Portman stated she would like Ms. Lack to come to the next meeting and do a presentation on single payer health insurance. Ms. Lack stated Louisville Metro has endorsed and she is asking the City of Shepherdsville to also endorse. Denise Peacock was present to address the Council about Hester Street. She would like a No Through Traffic sign put up. Mayor Tinnell stated a no through traffic sign could not be placed on an open street. Police Chief Doug Puckett stated there had been extra traffic control there. The speed limit is 15 mph. Councilwoman Margaret Moore stated there used to be a guardrail there. Mrs. Peacock said that was years and years ago. Councilwoman Trina Summers stated we need to do a direct patrol when high school lets out; check into putting up a guardrail and possibly put up a barrier. Mayor Tinnell stated he and Public Works Foreman Jesse Walls would ride over and take a look at this problem. Planning Commission Appointee Daryl Lee called to say he had nothing new to report. Board of Adjustments Appointee Duane Price stated he had talked with Evelyn Fackler about height restrictions and if the City wanted to do this it would have to be in the form of a zoning restriction. He suggested the Council think about this before deciding. Code Enforcement Office Jim McAuliffe reported progress on Honeysuckle Trailer Park. He stated the Health Department had not gotten back with him yet and that Louisville Water is working with the park owner’s attorney. Mr. McAuliffe also stated he would like to thank City and County leaders, Danny Fackler, and Fiscal Court for their help in the river clean up project. He asked the Council to write letters to the volunteers and also thanking the inmate for their help. City Engineer Toby Spalding stated we had bid a new dump truck. Peterson came back with the price of $71,986 for a single axle truck. He stated this is the State contract price. Mayor Tinnell stated we are looking at funding for 4 or 5 years instead of paying for it through the bond issue. Faith Portman made motion to accept. Trina Summers 2nd. Motion carried 6-0. City Engineer Spalding also bid a back hoe and trailer. The cost from Hunt Tractor was $58,485. This is also the State contract price. Bids were also let on a mini excavator. Caterpillar’s bid was $80,304; Case’s bid was $79,895. Engineer Spalding recommending purchasing the Caterpillar because it matches the rest of the equipment. The first payment on this equipment will not be until November 2008. Trina Summers made motion to purchase the Caterpillar mini excavator for $80,304. Faith Portman 2nd. Motion carried 6-0. Engineer Spalding also received a bid on a lifting beam hoist trolley system for the pump station. The bid from Crane America was $71,529. He stated this would be paid for out of the bond money. Faith Portman made motion to purchase. Stacey Cline 2nd. Motion carried 6-0. City Engineer Spalding also handed out an Ordinance combining all sewer ordinances the City now has in effect. He asked the Council to look it over and call him with any questions. He would like to have the first reading at the September 10th meeting. He stated the CPI increase of 3.4% for this year has been added in and that he added the date of July 1st each year when the CPI increase would go in effect. City Attorney Wilson stated that Section 12 needs to list the ordinances that this is repealing. Assistant Fire Chief Travis Bell was present and reported that the new truck and rescue boat is in. He invited anyone who would like to see them to come to the fire house. Assistant Chief Bell also reported that all interviews are complete and the list is going to the Civil Service Commission for certification this week. He stated there would be two 24/48 and two part time personnel on each shift for 24/7 coverage. Tom Rosselli handed out and read a letter about the success of the river cleanup. Councilwoman Margaret Moore stated she wanted to thank the people who were here at the last meeting who applauded for her. She stated she appreciates it more than you know. Councilwoman Faith Portman asked about the open burning ordinance that the fire department is working on. City Attorney Wilson stated the fire department is still working on it. Faith also reported that she had spoken with Nick Simon’s assistant and that the City can still get ID badges free at Publishers. The contact is Chris Graves in the Personnel Department. Councilwoman Bonnie Enlow stated she feels we should look at other options. She feels we take a lot from Nick Simon, everyone does, and he gets very little in return. Councilwoman Stacey Cline stated she had received calls about dogs being dropped off on First Street. She stated she is meeting the Dog Warden the next day and going to try and catch them. She thinks she may have a home for them. Councilman Tony Miller asked about the storm sewer on Beechwood and Edgewood in The Pointe. He stated it was caved in. He also asked about the manhole in the yard. WWTP Superintendent Mike Schroeder stated he would take care of that. Mayor Tinnell asked for a motion to adjourn to executive session to discuss possible property acquisition and litigation. Bonnie Enlow made motion. Trina Summers 2nd. Motion carried 6-0. Faith Portman made motion to return to regular session. Margaret Moore 2nd. Motion carried 6-0. Mayor Tinnell stated that Attorney Bill Wilson had been given direction on litigation questions and City Engineer Toby Spalding had been given direction on property acquisition.
