The Pledge of Allegiance to the Flag was said.

 

Mayor Tinnell called the meeting to order at 6:33 p.m.

 

In attendance were Council members Stacey Cline, Bonnie Enlow, Tony Miller, Margaret Moore, Faith Portman and Trina Summers.

 

Stacey Cline made motion to dispense with reading of 8/27/2007 regular meeting minutes. Faith Portman 2nd. Motion carried 6-0. Faith Portman made motion to approve minutes as written. Tony Miller 2nd. Motion carried 6-0. 

 

Don Lawson Jr. with the CPA firm of Stephens & Lawson presented the Audit ending 6/30/2006. He apologized for the delay in completing the audit. He stated financial statements changed drastically three years ago making the audit process a much longer one. He reported that the internal control problem had been corrected as of July 1, 2006 when the new software was installed. He also reported that financial institutions were still not pledging sufficient amounts of money on City accounts at certain times. He did state that this is a common problem many cities have. He stated the upgrade of the computer system should alleviate reporting problems from the past years. He stated all in all everything looked fine and invited the Council to call him at any time with questions, comments, or concerns.

 

Fire Chief Brad Whittaker played a video Remembering 9-1-1 victims. Chief Whittaker also introduced the five new paid fire personnel who will start September 23rd; Captain Al Tronzo, Captain Jon Garr, Sergeant William Zeller, Sergeant Mayes, Sergeant Michael Stephens.  He welcomed each and stated we have a great staff that, along with our current paid Captain, Matt Smothers, will keep moving the fire department forward. Chief Whittaker stated several pieces of equipment had been purchased recently, a new engine company, a Seagrave for $400,000; self contained breathing apparatus for $105,000; and several pieces of swift water rescue equipment. He thanked the Council for their support of the fire department. (At this time everyone was invited out to look at the new truck.) Chief Whittaker then did a visual presentation on a proposed open burning ordinance for the City. He covered several points and asked the Council to look it over and let him know of any questions or concerns. One suggestion was made if the Ordinance passes, to put the announcement on the Rumpke bills so everyone is aware of the change in open burning regulations within the City.

 

Shirley Lack was present to address the Council on Single Payer Healthcare. In her presentation she stated approximately 47 million people in America have no health insurance at all. She asked the Council to support and endorse HR 676 that will provide for comprehensive health insurance coverage for all United Stated residents and for other purposes by passing a Resolution.

 

Mayor Tinnell announced the next “Mayor’s Night In” would be September 17th at 7:00.

 

Mayor Tinnell also announced that Uthfest will be held at First Street Park on Saturday, September 15th. City Attorney Bill Wilson was concerned because we had not received the items that were to be given to the City prior to the event (insurance certificate, traffic plan, parking plan, BMX presentation). He also stated he still had concerns on security issues. Police Chief Doug Puckett said he would call the representatives of the Uthfest Ministries and speak with them about these concerns.

 

There were no reports from the Beautification or Sewer Committees.

 

City Attorney Wilson had first reading of Ordinance 007-(number to be assigned) an ordinance closing/abandoning a portion of an unnamed alley between Second Street and Frank E. Simon Alley as a public way maintained by the City of Shepherdsville. Attorney Mark Edison was present and explained to the Council where the property was located.

 

City Attorney Wilson had first reading of Ordinance 007-(number to be assigned) an ordinance proposing consensual annexation of real property of BDHM Inc. into the City of Shepherdsville. Attorney Keith Brown was present for the applicant and stated this was approximately 76 acres located between two other pieces of property that had previously been annexed into the City.

 

City Attorney Bill Wilson had first summary reading of Ordinance 007-(number to be assigned) an ordinance establishing all fees for the City of Shepherdsville’s Wastewater Treatment facilities. He stated this takes all sewer ordinances and combines them into one. The Ordinance raises sewer rates by the Consumer Price Index of 3.4% which was agreed by the Council in a previous Ordinance in 2005. Mayor Tinnell stated that this increase was agreed to in the previous administration and the he in no way suggested a sewer rate increase.

 

City Attorney Wilson had first reading of Ordinance 007-(number to be assigned) approving a lease for the financing of a public project in a maximum principal amount not to exceed $260,000 (fire department equipment).

 

City Attorney Wilson had first reading of Ordinance 007-(number to be assigned) an Ordinance levying Personal Property, and Property of Public Service Companies Ad Valorem taxes and providing assessment, equalization and collection pursuant to the provisions of KRS 92.280, Et. Seq.

Faith Portman made motion to approve parade permit for Bullitt Central High School Homecoming Parade for Thursday, September 27th. Tony Miller 2nd. Motion carried 6-0.

 

Steve Brown, President of the Homeowners Association in Oak Grove subdivision was present to request signs (Stop signs, No Parking on Street signs, Children At Play signs) be put up in the neighborhood. Public Works Foreman Jesse Walls stated we have not taken the streets over in Oak Grove yet because construction is not complete. Mayor Tinnell stated that upon completion of the subdivision the Association could submit a request to the City to take over the streets. At that time signs will be put in throughout the subdivision.

 

Planning Commission Appointee Daryl Lee reported there were two rezoning cases to be heard for Shepherdsville. Shepherdsville Congregation of Jehovah’s Witnesses to rezone 1.37 acres, more or less, from R-1 Residential to B-1 Highway Business for property located at 1746 Highway 44 East; Clarence Deakins and Karen Deakins to rezone .61 acres, more or less, from R-3 Residential to B-2 Central Business for property located at

141 S Plum Street
.

 

Board of Adjustments Appointee Duane Price called to say he had no report at this time.

 

Councilwoman Stacey Cline congratulated the Sewer Department for recently receiving the Golden Peak Performance Award.

 

Councilwoman Faith Portman stated she had received calls about high grass on two pieces of property. 274 Circle Drive and 360 Circle Drive. She also stated the grass was high on Highway 44 West across from Bullitt Central High School. Councilwoman Portman also stated the gates at the park look great but she thinks they need reflectors on them so they can be seen. Public Works Foreman Jesse Walls states he was working on this. Mrs. Portman also stated we need a Stop Sign in the park. Councilwoman Portman also stated she is sorry to see City Engineer Toby Spalding leave; he has done a lot for the City.

 

Councilwoman Bonnie Enlow asked if any more lights were going in on

First Street
. PWF Walls stated he and the Mayor had looked at that and there were plans for more lights on
First Street
but not the walking trail at this time.

 

Councilwoman Margaret Moore stated the park hours need to be posted and people made to leave when the park closes.

 

Mayor Tinnell asked for a motion to adjourn to executive session to discuss litigation and personnel. Tony Miller made motion.  Stacey Cline 2nd. Motion carried 6-0.

 

Faith Portman made motion to return to regular session. Stacey Cline 2nd. Motion carried 6-0. Mayor Tinnell stated there were no decisions at this time.
