The Pledge of Allegiance to the Flag was said.

 

Mayor Tinnell called the meeting to order at 6:30 p.m.

 

In attendance were Council members Stacey Cline, Bonnie Enlow, Tony Miller, Margaret Moore, Faith Portman and Trina Summers.

 

Stacey Cline made motion to dispense with reading of 9/10/2007 regular meeting minutes and 9/13/2007 special meeting minutes. Faith Portman 2nd. Motion carried 6-0. Faith Portman made motion to approve minutes as written. Stacey Cline 2nd. Motion carried 6-0. 

 

Police Chief Doug Puckett introduced Shepherdsville’s three newest police officers: Mark Riley, who will be taking over K-9, Mike Miller and Steve Clark.

 

City Attorney Bill Wilson had second summary reading of Ordinance 007-(number to be assigned) an ordinance establishing all fees for the City of Shepherdsville’s Wastewater Treatment facilities. He stated this Ordinance combines all existing sewer ordinances into one. The only change is reflected in Section 5 Rates and Charges where the sewer rates were raised by the Consumer Price Index fee of 3.4%. Trina Summers made motion to approve. Bonnie Enlow 2nd. Motion carried 6-0. (This Ordinance will be numbered 007-729.)

 

City Attorney Wilson had second reading of Ordinance 007-(number to be assigned) an ordinance closing/abandoning a portion of an unnamed alley between Second Street and Frank E. Simon Alley as a public way maintained by the City of Shepherdsville. Tony Miller made motion to approve. Stacey Cline 2nd. Motion carried 6-0. (This Ordinance will be numbered 007-730.)

 

City Attorney Wilson had second reading of Ordinance 007-(number to be assigned) an ordinance proposing consensual annexation of real property of BDHM Inc. into the City of Shepherdsville. Tony Miller made motion to approve. Faith Portman 2nd. Motion carried 6-0. (This Ordinance will be numbered 007-731.)

 

City Attorney Wilson had second summary reading of Ordinance 007-(number to be assigned) approving a lease for the financing of a public project in a maximum principal amount not to exceed $260,000 (fire department equipment). Trina Summers made motion to approve. Margaret Moore 2nd. Motion carried 6-0. (This Ordinance will be numbered 007-732.)

 

City Attorney Wilson had second reading of Ordinance 007-(number to be assigned) an Ordinance establishing the Real Property Ad Valorem taxes and providing assessment, equalization and collection pursuant to the provisions of  KRS 92.280, Et Seq. This will set the 2007 real property tax rate at 14.5. Bonnie Enlow made motion to approve. Stacey Cline 2nd. Motion carried 6-0. (This Ordinance will be numbered 007-733.)

 

City Attorney Wilson had second reading of Ordinance 007-(number to be assigned) an Ordinance levying Personal Property, and Property of Public Service Companies Ad Valorem taxes and providing assessment, equalization and collection pursuant to the provisions of KRS 92.280, Et. Seq. This will set the 2007 personal property tax rate at 16.68. Tony Miller made motion to approve. Bonnie Enlow 2nd. Motion carried 6-0. (This Ordinance will be numbered 007-734.)

 

There were no reports from the Beautification or Sewer Committees.

 

City Attorney Wilson read Resolution approving and authorizing the Mayor to sign all agreements pertaining to the Kentucky Transportation Cabinet and/or Department of Highways to explore design options for the realignment of Beech Grove Road (KY 1494) along Old Ford Road (CR 1276). Stacey Cline made motion to approve. Bonnie Enlow 2nd. Motion carried 6-0.

 

City Attorney Wilson read Resolution affirming continuation of single county or regional area designation status to actively participate in the Bullitt County Regional solid waste management area. Bonnie Enlow made motion to approve. Faith Portman 2nd. Motion carried 6-0.

 

Discussion followed on request by Miles Homes to take over street lights in Section 1 and 2 in Hensley Estates. Mayor Tinnell stated he would have Public Works Foreman Jesse Walls look at and report back at next meeting.

 

Discussion followed on request for approval to hold the 14th Armored Re-Creations October event at First Street Park. Mayor Tinnell asked the City Clerk to call and get exact date when event will be held and asked the police and fire departments to follow up with Mr. Garrett to offer assistance at the event if needed. Stacey Cline made motion to approve. Tony Miller 2nd. Motion carried 6-0. 

 

Margaret Moore made motion to approve September bills for payment. Stacey Cline 2nd. Motion carried 6-0.

 

Mr. Virgil Kleinhelter was present to address the Council on smoking bans. He presented the Council with information and asked them to look it over.

 

Planning Commission Appointee Daryl Lee reported the October Agenda was not ready yet so he had nothing to report.

 

Board of Adjustments Appointee Duane Price reported that Lowe’s had requested a variance to reduce the size of parking spaces from 200 sq. ft. to 162 sq. ft. and a variance to increase the amount of signage on the building from 200 sq. ft. to 509 sq. ft. And that Rodney Hurst requested a conditional use permit to operate mini storage warehouse businesses on the property located at the intersection of

Maraman Drive
and
Charles Hamilton Way
. He also requested a variance to allow mini storage warehouses to encroach 25’ into the front yard setback requirement; 11’ into the side yard setback requirement and 3’ into the side yard setback requirement.

 

City Attorney Bill Wilson reported that the remaining fire department bench trial would be held Thursday at 9:00 a.m. He also discussed the leasing of the old City Hall and Police Department buildings. Probation and Parole looked at the police department building and determined it was too small. Mr. Wilson stated they did not look at the City Hall building and he would like to show them that building. He stated another alternative they suggested was to add on to the Police Department building. After some discussion, the Council decided they did not want to add on to the building.

 

Councilwoman Stacey Cline reported there was a chain hanging out of a tree on

First Street
that needs to be removed.

 

Councilman Tony Miller reported that behind Woody Dawson’s house had been cleaned out and it looks good.

 

Councilwoman Cline stated she had received a call about the guardrail on

Carpenter Street
. Mayor Tinnell stated he thought that it had been ordered.

Councilwoman Faith Portman stated the sidewalk stamping at First Street Park looked great and thanked Public Works Foreman Jesse Walls and Jim McClure for a job well done. She also reported that people are speeding through the Park and asked it speed bumps could be put in to slow them down before someone gets hurt. Councilwoman Portman also asked about lights on the walking path at the park and suggested getting some concrete benches for along the path.

 

Councilwoman Bonnie Enlow stated she would like to publicly thank David Conn for his help in settling the fire department lawsuit with Zoneton and Mt. Washington Fire Districts. She thanked everyone involved for what they did.

 

Attorney Bill Wilson stated the role of the council members involved, Trina Summers, Bonnie Enlow and Tony Miller) was very impressive and well done. He stated the Council put in much effort to get this resolved.

 

Mayor Tinnell stated the entire Council and City Attorney should be commended for the work done to settle the fire department lawsuit. They worked very hard to get it done.

 

Councilwoman Margaret Moore stated she was concerned about kids walking into the street at First Street Park. She suggested putting up a fence. Councilwoman Stacey Cline stated the fence is going up now.

 

Tony Miller made motion to adjourn. Stacey Cline 2nd. Motion carried 6-0. Meeting adjourned at 7:27 p.m.
