October 8, 2007 Brother Tim Wade, Lighthouse Baptist Church gave the invocation.
The Pledge of Allegiance to the Flag was said. Mayor Tinnell called the meeting to order at 6:30 p.m. In attendance were Council members Stacey Cline, Bonnie Enlow, Tony Miller, Margaret Moore, Faith Portman and Trina Summers. Stacey Cline made motion to dispense with reading of 9/24/2007 regular meeting minutes. Faith Portman 2nd. Motion carried 6-0. Trina Summers made motion to approve minutes as written. Stacey Cline 2nd. Motion carried 6-0. Mayor Tinnell announced the next Mayor’s Night In would be Monday, October 15th at 7:00 p.m. Tim Garrett was present to answer any questions on the 14th Armored Re-Creation military vehicle show to be held on October 26th, 27th, and 28th. Public Works Foreman Jesse Walls reported he had looked at Section 1 and 2 in Hensley Estates. He stated he had spoken with Mr. Miles and the request was to take over the streetlights only. However, PWF Walls reported there were some problems that needed taken care of and suggested holding off taking over anything until these issues are resolved. Councilwoman Trina Summers reported that the grant submitted by the Beautification Committee had been turned down. She stated the committee is not going to give up their efforts but will re-submit grant applications as smaller projects. There was no report from the Sewer Committee. City Attorney Bill Wilson had first reading of Ordinance 007-(number to be assigned) on request by Shepherdsville Congregation of Jehovah’s Witnesses to rezone their property from R-1 Residential to B-1 Highway Business. The property in question is 1.37 acres, more or less, located at 1746 Highway 44. Joe Hurst was present on behalf of the Congregation of Jehovah’s Witnesses. City Attorney Wilson stated the second reading would be October 22nd.
City Attorney Wilson had first reading of Ordinance 007-(number to be assigned) on request by Clarence Deakins and Karen Deakins to rezone their property from R-3 Residential to B-2 Central Business. The property in question is .61 acres, more or less, located at 141 S Plum Street. Second reading will be October 22nd.
Discussion followed on request by Darrell Miller to tear down a barn on property the City recently purchased from him. City Attorney Wilson stated he has concerns on liability issues. Councilwoman Trina Summers asked if the City could use the barn for storage. Mayor Tinnell stated that pipe and fittings being used on the current interceptor project could be stored there. After further discussion everyone agreed to leave the barn set until the project is finished. Mayor Tinnell asked City Attorney Wilson to send Mr. Miller a letter explaining the decision.
Discussion followed on request from Congregation of Jehovah’s Witnesses to use the Community Center on Wednesdays from 7:00-10:00 p.m. and Sundays from 9:00 a.m. to 12:30 p.m. to hold services through October 2008. Mr. Hurst explained to the Council that they are looking for a place to hold services until their new building is complete. It was determined that through the months of November and December the Community Center is closed as well as several other activities the building is being used for throughout the year. Mr. Hurst stated he understood and asked that if any one knew of a place to please let him know.
Shirley Lack was present to again discuss the Single Payer Health Care issue. She asked what she could do to get the City on board. Mayor Tinnell stated he does not think any one has a desire for a resolution right now. He stated we would like to do further research on the matter. Ms. Lack stated they can’t get Congressional attention unless small cities sign on; however, Shepherdsville was the first City she talked to.
Planning Commission Appointee Daryl Lee had nothing to report. Board of Adjustments Appointee Duane Price called to report there was nothing new for Shepherdsville at this time. City Attorney Bill Wilson reported Probation and Parole could use the police building and would need 11 parking spaces. He also reported he had spoken with Chuck McCleary with the AOC about the City Hall building. He reported that Lamar Billboard Company is working on a proposal for the City to review. He reported that regarding fire litigation, finding of fact had to be in to the Judge by Friday and he anticipated we wouldn’t hear anything before the end of November. City Attorney Wilson stated the City had received a letter regarding a fire emergency declared by Governor Fletcher. There will be no open burning until the order is rescinded. Fire Chief Brad Whittaker stated he would send a copy of the Order to Central Dispatch. Councilwoman Margaret Moore stated she would like to see some attention devoted to the weeds and high grass on 44 West and asked that the Code Enforcement Officer look into. Councilwoman Bonnie Enlow asked how close we were to shutting the gates at the park at night. She stated we need to get the gates up as soon as possible and shut them. She also stated that reflectors need to be put on the black gates so they can be seen at night. After further discussion it was determined that Public Works Foreman would post signs that park hours are dusk to dawn. Discussion was also held on putting additional goals on First Street Park and the gate at Frank Simon Park. Councilwoman Bonnie Enlow, Faith Portman, Stacey Cline, Trina Summers and Councilman Tony Miller thanked everyone involved with the City picnic; with a special thanks to Tom Rosselli and his wife and Mac McAuliffe and his wife. It was a great day and a fun time. Halloween Trick or Treat hours will be Wednesday, October 31st from 5:00-9:00 p.m. Faith Portman made motion to adjourn to executive session to discuss personnel and litigation. Margaret Moore 2nd. Motion carried 6-0. Faith Portman made motion to return to regular session. Stacey Cline 2nd. Motion carried 6-0. There were no decisions on litigation or personnel.
