MINUTES REGULAR COUNCIL MEETING

MONDAY, May 12, 2008

 

 Councilman Tony Miller said the invocation.

 

The Pledge of Alliance to the flag was said

 

Mayor Tinnell called the meeting to order at 6:37 p.m.

 

In attendance were Council members Stacey Cline, Bonnie Enlow, Tony Miller, Margaret Moore, Faith Portman and Trina Summers.

 

Ms. Enlow made the motion to dispense of the reading of the minutes from the April 28th, 2008 City Council meeting.  Ms. Moore 2nd.  Motion carried 6-0.  Ms. Cline made the motion to approve the minutes with revisions to additional comments that she and Ms. Portman had said about discussion with Mr. Hadley in regards to police department.  Ms. Jeffries said she would go back and listen to recorded disk and she what she could find. Ms. Enlow 2nd.  Motion carried 6-0

 

Mayor Tinnell announced that Judy Richmond, Tammy Owen sister lost her battle with cancer on Friday, May 9th.  He asked everyone to remember them in prayer.  He also reminded everyone that the American Cancer Relay for Life will be Friday May 16th at 7 pm at North Bullitt High School.  He also announced there will be a yard sale to benefit the Goronflo Family on Saturday May 24th at First Street Park.  He also reminded everyone that there will not be a council meeting on May 26th due to the Memorial Day Holiday.

 

Old Business:

Ms. Portman made a motion to table the reading of Ordinance No. 008-(number to be assigned) on Zoning for Rolling Acres Farm until the meeting on June 9th, 2008.  Ms. Enlow 2nd.  Motion carried 6-0.

 

New Business:

Mr. Woolridge reported that Publishers Printing has acquired more property.  They are going to request a re-zoning from B1 to Light Industrial.  The property purchased contains a 20 foot alley and there is no current use of the alley and he would like to request it be closed.  Ms. Enlow asked if the fire department would have access if alley closed.  He responded with yes.  Motion by Ms. Summers that Mr. Woolridge contact Mr. Wilson to pursue the closure.  Ms. Portman 2nd.  Motion carried 6-0.

 

Mr. Daryl Lee asked the council if they were aware that they voted to take over

Conestoga Parkway
and the street lights in May 2006.  He also questioned the closing of
Salt River Plant Drive
.  He said he did not feel it was closed properly. He asked Ms. Jeffries will copy the  minutes from October 23, 2006 and get a copy to Bill Wilson for his review.  He also said he does not understand the Old Ford Road Project.  What is it’s status?  The Mayor responded with…We received $100,000 for design and moving the utilities.  The funding to complete the work was not secured by the city and they state now says there are no funds available.

 

Mr. Duane Price stated that the city needs to be aware that a ruling was made that in a zoning case only the homeowner, business owner or an attorney representing the homeowner or business owner could speak in regards to re-zoning hearings.  Bill Wilson responded by saying possibly someone who has power of attorney could do the same.  He will check on this.  He also stated that the Jehovah Witness church needed a waiver for their parking lot.

 

Reports:

 

Attorney Wilson stated that he has attended one meeting with the Division of Water and one meeting with the County and a company called URS.  He is seeking alternatives for some of the unfunded mandates.  He also said that he should have the Ordinance ready for first reading soon.

 

Departmental Reports:

 

Jim McAulliffe reported that he checked with the city attorney and he advised them not to go onto private property to cut grass.  He said he had the works department mow the front yard at 360 Circle Drive.  Ms. Summers stated she was by there and there were people from Quality Security there trying to re-secure the house and garage.  They stated they were also going to remove the pool.  Ms. Cline stated they need to look at 233 Tollview.  Ms. Portman stated she talked to Mt. Washington and their ordinance is written to allow them on private property after certain notices have been sent.  Ms. Jeffries to call Ken Stovall at Mt. Washington and try to obtain a copy of their ordinance.

  

Council reports:

Ms. Summers reported that she will call Bob Fouts with Economic Development and see if she can get a workshop with KDJA to explain how the occupational tax incentives work.  It will be open to the public.

 

Mr. Miller encourage everyone to attend the Relay for Life on May 16th at North Bullitt High School.  He also wished everyone good luck with the May 20th Primary Election.

 

Ms. Portman responded to Mr. Hadley’s prior comment on police protection:  she stated the police department has hired a part-time person to pursue all areas that are currently being hit.  The part-time individual has had a lot of good leads.  The police department also has an anonymous tips line.

 

Ms. Enlow reported that at a previous council meeting a property owner inquired about closing an alley on

2nd Ave
behind his house. Ms Enlow stated another property owner that lives on the alley stated that their request to close the alley was previously denied sometime in the 90’s.

 

Motion to go into Executive Session at 7:40 p.m. to discuss property acquisition and pending litigation by Ms. Summers. Ms. Cline 2nd.  Motion carried 6-0.

 

Motion to reconvene at 8:44 p.m. by Ms. Summers.  Ms. Cline 2nd.  Motion carried 6-0.  Mr. Wilson stated for the record that no action was taken.

 

Motion to adjourn by Ms. Cline, Seconded by Ms. Portman.  Motion carried. Meeting adjourned at 8:45 p.m.
