MINUTES REGULAR COUNCIL MEETING

MONDAY, July 14, 2008

 

 Rev. Carl Thomas from Immanuel Baptist Church said the invocation.

 

The Pledge of Alliance to the flag was said

 

Mayor Tinnell called the meeting to order at 6:33 p.m.

 

In attendance were Council members Stacey Cline, Bonnie Enlow, Tony Miller, Faith Portman and Trina Summers.  Margaret Moore was absent.

 

Ms. Cline made the motion to dispense of the reading of the minutes from the June 23, 2008 City Council meeting.  Ms. Portman 2nd.  Motion carried 5-0.  Ms. Enlow made the motion to approve the minutes as presented.  Ms. Summers 2nd.  Motion carried 5-0

 

Ms. Cline made the motion to dispense of the reading of the minutes from the June 30, 2008 Special City Council meeting.  Ms. Enlow 2nd.  Motion carried 5-0.  Ms. Enlow made the motion to approve the minutes as presented.  Mr. Miller  2nd.  Motion carried 5-0

 

Mayor Tinnell  thanked Ray & Lynn Walls for all their hard work at the cemetery.

 

Old Business:

None

 

New Business:

Motion by Ms. Summer to approve the bills presented for June.  2nd by Ms. Enlow.  Motion carried 5-0.

 

Motion by Ms. Portman to allow the garbage franchise out for bid.  2nd by Ms. Cline.  Motion carried 5-0. Mr. Tim McNalley with Waste management answered questions that the council had in regards to a recycling program.

 

Motion by Ms. Portman to approve the list of surplus equipment to be auctioned that was presented .  2nd by Ms. Enlow.  Motion carried 5-0.

 

Faith Portmen presented two ordinances for first reading. Attorney Bill Wilson read  first reading of Ordinance 008-747 approving the sale of distilled spirits, beer and wine at retail, by the drink on Sunday at restaurants and dining facilities.

Motion was made by Ms. Cline to set a special meeting  on June 21st at 6:30 p.m. to have second  reading and public hearing on Ordinance 008-747  and Ordinance 008-748.  Ms. Portman 2nd.  Motion carried 4-1.  Ms. Enlow opposed.

 

Sign in speakers:

Karen Deakins-141 S. Plum Street-KC Auto Detail stated she has applied for auto dealer license with the State, however there was an article in the paper by Alan Wetzel and Scott Ellis that stated they are a “junk yard” and that she resents the statement because they are not a junk yard.  She said she has been a told a council member is also involved, but she did not want to give a name.  She requests that the Mayor and other city council members have her removed.

 

State Representative Larry Belcher presented the city with a check from the General Assembly for $ 1,000,000 for sewer improvements.

 

Daryl Lee presented the council with two zoning issues that have just been approved by the county and he suggests they ride by and look at them prior to voting on them.  (Browning Investments & Haley Avenue)

 

Reports:

Attorney Wilson stated the Council will need to call for executive session later for litigation and personnel matters.

 

Departmental Reports:

Assist. Chief Travis Bell  stated the department has started doing inspections on commercial properties (apartments and businesses) and will cite on fire code violations. They will re inspect in 30 days.

 

Trina Summers asked Chief Puckett to report on the car break ins at the YMCA.  He said they have not gotten any calls about them and suggests who ever told her about them spread the word to make sure anything like that is reported to the police department.  Ms. Summers will inform them that the city does not have anything available.

 

Jim McAulliffe reported that he is scheduling another clean up in the park.  He also asked Bill Wilson to check to see what can be done about condemning the property on

Hester Street
.

 

John Bradley reported he has just returned from a class on MS4 inspections.

 

Council reports:

Ms. Summers asked the council to consider allowing either the Chamber of Commerce or CASA to rent the rooms we have upstairs that we are currently using for storage and fire department training room.  Ms. Cline stated she has a problem “renting” city hall out.  Ms. Portman said she is worried about privacy issues with city business.

 

Ms. Cline asked John Bradley about street signs on

Red Oak Circle
.  He said the city has not taken over the streets yet, therefore we do not put up signs or do repairs.

 

Ms. Portman thanked everyone with the police and fire department that helped with Bullitt Blast.  She felt it was a wonderful success.

 

Ms. Enlow presented with Bill Wilson with an Ordinance that would repeal Ordinance 007-736 which changed the zoning on

141 S. Plum Street
to B-2.  She said the use is not in compliance with the comprehensive plan.

 

Bill Wilson read Ordinance 008-749 to repeal Ordinance 007-736 which re-zoned

Motion by Ms. Summers to go to executive session to discuss litigation and personnel at 7:55 p.m.  Ms. Enlow 2nd.  Motion carried 5-0.

 

Motion to reconvene by Ms. Portman at 9:10 p.m. Ms. Cline 2nd.  Motion carried 5-0.

 

Attorney Bill Wilson stated he has been given instructions by the council in regards to the ligation and personnel.

 

Motion to adjourn at by Ms. Cline, Seconded by Ms. Enlow .  Motion carried. Meeting adjourned at 9:11 p.m.
