MINUTES REGULAR COUNCIL MEETING CITY OF SHEPHERDSVILLE 634 CONESTOGA PARKWAY SHEPHERDSVILLE, KY 40165 MONDAY, January 12, 2009
Councilmember Tony Miller said the invocation. The Pledge of Alliance to the flag was said Mayor Tinnell called the meeting to order at 6:34 p.m. In attendance were Council members Don Cundiff, Scott Ellis, Bonnie Enlow, Larry Hatfield, Tony Miller, and Alan Wetzel Ms. Enlow made the motion to dispense of the reading of the minutes from the December 8, 2008 City Council meeting. Mr. Cundiff 2nd. Motion carried 6-0. Ms. Enlow made the motion to approve the minutes as presented. Mr. Wetzel 2nd. Motion carried 6-0. City Attorney Bill Wilson read a Proclamation for Bullitt County School Board Recognition for the month of January. Fire Chief Brad Whitaker introduced five (5) of the new firefighters that were recently hired as a result of the grant we received. Attorney Bill Wilson administered the Oath of Office to the new firefighters. Chief Whitaker also announced that the department has been approved for another grant in the amount of $22,360 which will be used to purchase a training library for the department.
Old Business: None New Business: Heritage Hills submitted a written request for the City to take over the remainder of the lights in their subdivision. Motion was made by Mr. Cundiff that we take over the street lights contingent upon the roads passing inspection by the Public Works Director. Second by Mr. Hatfield. Motion carried 6-0. City Attorney Bill Wilson read Resolution 009-001-Designation of applicant’s Agent. Motion to approve as presented by Ms. Enlow. Mr. Ellis 2nd. Motion carried 6-0. City Attorney Bill Wilson read Resolution 009-002-Establishing a Drug Free Workplace. Motion to approve with the following changes: Section 6. 1c: strike “that results in an injury requiring off-site medical attention” and Section 6. 2e strike “that results in an injury requiring off-site medical attention” by Ms. Enlow. Mr. Wetzel 2nd. Motion carried 6-0. Sign-in Speakers:
Steve Brown-apologized to the police department, mayor and city council for his actions the last time that he attended a council meeting.
Planning & zoning update- Daryl Lee provided maps of the location of two upcoming re-zoning cases.
Board of Adjustment update-Duane Price reported that the state law has changed in regards to daycares. Pleasant Grove Church has re-applied. They have 20 children there. He also reported that Mindel-Scott has reduced the plans for the parking lot at the dialysis center that is going to be located on Adam Shepherd. City Attorney update: Bill Wilson said he had given the council a copy of an agreement from GFS to correct an error and to change the name to their new/reorganized name. Motion by Mr. Hatfield to allow mayor to execute the agreement. Ms. Enlow 2nd. Motion carried 6-0. Bill Wilson also said he had received a restricted stock agreement for a local company requesting agreement on taxes to be paid on stock employees receive in lieu of pay and whether it is taxable or not. Motion by Mr. Hatfield to allow Mayor to sign the agreement. Ms. Enlow 2nd. Motion carried 6-0.
Departmental Reports: None Council reports: Mr. Miller thanked everyone who supported him and for coming out tonight. Mr. Hatfield thanked everyone for their support and he is looking forward to addressing the issues he feels the city needs to change. Ms. Enlow asked about a drainage issue on Shannon Lane. Mr. Keith said he will check into it. She also asked the police department to see what kinds of rules or laws there are in regards to basketball goals in the street. She also asked for a consistency in the way speed limits are assigned. She said they are inconsistent thru out the city. Mr. Cundiff said it was good to be back. Mayor Tinnell asked Boy Scout Troop 685 that was in the audience to stand and be recognized. Motion by Mr. Cundiff at 7:15 p.m. to go to executive session to discuss property acquisition and litigation. Mr. Wetzel 2nd. Motion carried 6-0. Motion to reconvene by Mr. Hatfield at 9:55 p.m.. Mr. Wetzel 2nd. Motion carried 6-0. Attorney Bill Wilson reported that no action was taken on either subject. Motion to adjourn at by Mr. Cundiff, Mr. Ellis 2nd. Motion carried 6-0.
