MINUTES REGULAR COUNCIL MEETING CITY OF SHEPHERDSVILLE 634 CONESTOGA PARKWAY SHEPHERDSVILLE, KY 40165 MONDAY, March 23, 2009
Officer Tim Wade said the invocation. The Pledge of Alliance to the flag was said Mayor Tinnell called the meeting to order at 6:30 p.m. In attendance were Council members Don Cundiff, Scott Ellis, Bonnie Enlow, Larry Hatfield, Tony Miller, and Alan Wetzel. Mr. Hatfield made the motion to dispense of the reading of the minutes from the March 9, 2009 City Council meeting. Mr. Miller 2nd. Motion carried 5-0. (Mr. Wetzel had not yet arrived) Ms. Enlow made the motion to approve the minutes as presented. Mr. Ellis 2nd. Motion carried 5-0. Mr. Wetzel arrived just as voting was completed. Mayor Tinnell said that they have started working on the new ball fields in the park and they hoped to get started with the amphitheater in July or August. He also stated that Darvin Hill has agreed to serve on the Civil Service Board for another 3 year term. Old Business: Attorney Bill Wilson read second reading of a summary of Ordinance 009-763-relating nuisances in the City of Shepherdsville. Motion by Mr. Cundiff to approve as presented. Mr. Miller 2nd. Motion carried 6-0.
New Business: Attorney Bill Wilson read first reading of Ordinance 009-764-relating to rezoning of property located at 377 Nancy Drive in the City of Shepherdsville. Motion to approve payment of bills for the month of March by Mr. Hatfield. Mr. Wetzel 2nd. Motion carried 6-0. Sign-in Speakers: Pete Moreno of 300 Tecumseh advised the council that he has a problem with standing water on his property and that it is causing an erosion problem. Public Works director, Chuck Keith said he has looked at the problem and said that the developer did not install the drainage properly. Mayor Tinnell said he will go out and look at the problem tomorrow. Laura Holt, President of the Miles Place homeowners association said they have a problem with on street parking in their area and that she has a concern that at times a emergency vehicle would not be able to get thru. Chief Puckett advised her he will have members of his department keep watch in that area. Heather Hibbs of 581 Shady Glenn presented the council with pictures (from 2006) of a water flooding problem that is present in her area. She has had to sand bag her property several times to keep the water from getting into her home. Public Works director, Chuck Keith said he has looked at the problem and feels the water needs to be diverted towards Chillicoope. Mayor and council to look at and see if it something we can do or possibly force the developer to correct the problem. Alex Rameriz from Cabo’s Cantina asked the council members to reconsider the ordinance on alcohol sales on Sunday. He said for restaurants like his it would really help on Sunday sales especially during the different sporting events. Mr. Ellis asked Bill Wilson about perhaps we need to do the simulated ballot at city hall and see how people feel about the Sunday sales and then decide how to proceed. Planning & zoning update- NONE Board of Adjustment update-NONE Departmental Reports: Assistant Fire Chief Travis Bell said they have secured a grant for $45,000 for training. No match on the City’s part. They will use it for training materials. Michael Schroeder wanted to make a presentation to the Council, but Attorney Bill Wilson advised him that the subject was possibly litigation and should not be brought up in open session. Council reports: Mr. Hatfield asked about the street lights in Heritage Hills. City Clerk Maxine Jeffries advised him we are waiting for a contract from Salt River Rural Electric and once the city has signed and returned the contract to Salt River they will be turn the lights on. Mr. Hatfield also stated he would like a update from Jr. Bright on the Capitol Projects. Motion by Mr. Ellis at 7:18 p.m. to go to executive session to discuss property acquisition. Mr. Wetzel 2nd. Motion carried 6-0. Motion to reconvene by Mr. Wetzel at 8:25 p.m.. Mr. Hatfield 2nd. Motion carried 6-0. Attorney Bill Wilson stated that a property acquisition issue was discussed and they gave the him a direction to on how to proceed with the issue. There was one more issue to come before the City Council. The public works department is seeking financing for a trailer and lawn tractor. Republic Bank bid 6% for 3 years. PBI Bank bid 5% for 3 years. Motion to approve the financing with PBI Bank at a rate of 5% by Mr. Wetzel. Mr. Ellis 2nd. Motion carried 5-0. Mr. Cundiff did not vote due to conflict of interest. Motion to adjourn at by Mr. Hatfield, Mr. Cundiff 2nd. Motion carried 6-0.
