MINUTES REGULAR COUNCIL MEETING

MONDAY, June 8, 2009

 

Pastor John Lehenbauer from Divine Savior Lutheran Church said the invocation.

 

The Pledge of Alliance to the flag was said.

 

Mayor Tinnell called the meeting to order at 6:32 p.m.

 

In attendance were Council members Don Cundiff, Scott Ellis, Bonnie Enlow, Larry Hatfield, Tony Miller, and Alan Wetzel.

 

Mr. Miller made the motion to dispense of the reading of the minutes from the May 11, 2009 City Council meeting.  Mr. Hatfield 2nd.  Motion carried 5-0. (Mr. Wetzel had not yet arrived) Mr. Ellis made the motion to approve the minutes as presented.  Ms. Enlow 2nd.  Motion carried 5-0. 

 

Mr. Cundiff made the motion to dispense of the reading of the minutes from the May 13, 2009 Special City Council meeting.  Mr. Ellis 2nd.  Motion carried 6-0. Mr. Ellis made the motion to approve the minutes as presented.  Ms. Enlow 2nd.  Motion carried 6-0. 

 

Ms. Enlow made the motion to dispense of the reading of the minutes from the May 18, 2009 Special City Council meeting.  Mr. Ellis 2nd.  Motion carried 6-0. Mr. Cundiff made the motion to approve the minutes as presented.  Mr. Hatfield 2nd.  Motion carried 6-0. 

 

Mayor Tinnell stated that the previous weekend was the Pow Wow in the park and they had a very good turnout.  He also asked everyone to go and look at the recent changes made in the park.

 

Old Business:

Motion by Mr. Wetzel to table Ordinance 009-765 until we have the budget approved. Mr. Hatfield 2nd.  Motion carried 6-0.

 

Attorney Bill Wilson said there needs to be more research done on Ordinance 009-767 and Ordinance 009-768 before we have the final reading.  Motion by Mr. Hatfield to delay second reading of both ordinances until further research is done.  Ms. Enlow 2nd.  Motion carried 6-0.

 

 

New Business:

Attorney Bill Wilson read Resolution 009-006 Approving the agreement with Homeland Security.  Motion to accept by Mr. Cundiff.  Mr. Ellis 2nd.  Motion carried 6-0.

 

Attorney Bill Wilson read the first reading of Ordinance 009-769 Adopting the General Fund Budget for 2009-2010

 

Attorney Bill Wilson read the first reading of Ordinance 009-770 Adopting the Sewer Fund Budget for 2009-2010

 

After discussion a motion to pay bills for May by Mr. Cundiff, Mr. Miller 2nd.  Motion carried 6-0.

 

 

Sign-in Speakers:  

Robert Weikert  from Beechwood Estates wanted to know when the gravel area at Red Oak and Tecumseh would be paved.  The Mayor responded and said that it should be taken care of as soon as they replace a valve there.  Mr. Weikert also asked about the road conditions in the neighborhood.  The Mayor responded that the City has not yet taken over those roads because the development is not complete.  Any repairs at this point should be done by the developer.  Mr. Weikert also asked about speed bumps because speeding is bad in that area.  Mayor responded that we can not put speed bumps on public streets.  The Police Chief responded that they have worked radar in that area more than once and do get a lot of speeders, however they can not sit someone there everyday.  Mr. Weikert also stated that the development sign at Oakgrove and

Beechgrove Road
needs to be moved.  It blocks your view when you attempt a left hand turn.  A friend of his had an accident there because of the sign.  Mr. Wiekert also asked what happened with the plans for the
Beechgrove Road
by-pass.  The Mayor explained that it is still in the works but still waiting on finalizing some easements.

 

Planning & zoning update-  

Daryl Lee presented the Council with a site map on an upcoming zoning case 2009Z-17 Eshman Living Trust for

984 Old Preston Highway South
from AG to I-L Light Industrial.

 

Board of Adjustment update- None

 

Departmental reports:

Chief Whittaker said that he had been getting calls and emails about a recently injured firefighter,  Mike Abell received second degree burns to his face and ears, but he is ok and has returned to full duty.  He also stated that they have received a free treadmill thru the Wellness Program.

 

Sewer Superintendent Mike Schroeder asked that he go into executive session to discuss a personnel issue.

 

Chief Puckett stated they had their final inspection for the accreditation on May 20th.  He presented the Mayor and Council with a letter from the Kentucky Association of Chiefs of Police Law Enforcement Accreditation Program advising the City that we have Fulfilled all the Accreditation standards for our first five year certification. The accreditation is based on 149 standards and Shepherdsville will be the first police department in Bullitt County to receive this.  The accreditation will enable us a 10% discount on our police liability insurance. He thanked Dan Patchin for his dedication for the last 18 months to make this happen.  He also thanks Ken Bernardi, Dan Patchin and Maxine Jeffries for accomplishing the Drug Free Workplace program that will enable us to receive a 5% discount on our workmans compensation insurance premium.

 

Public Works Director Chuck Keith said they have started spraying for mosquitoes.

 

Judge Melanie Roberts thanked the Police Department for their help due to her calls about

Beechgrove Road
congestion.

 

Jim McAulliffe reported that the is working on another demolition on Highway 44.  He also reported that vacant home are causing a lot of calls about tall grass but that the City can not cut them because of the expense.  He also reported that the council need to look at some type of renter protection ordinance.

 

Council reports:  

Mr. Hatfield  asked Mac about the house on

4th Avenue
and what is being done.  Mac said the house is for sale and not complete.  He also asked about the reopening
Salt River Plant Road
, even if it is just south-bound.  Ms. Enlow said she agrees this needs to be done.  Mr. Wetzel stated that he was involved in the closing of the road and he feels that it should stay closed because the road is so narrow and it is dangerous for the families with children who play near the road. After discussion a motion was made by Mr. Hatfield to reopen Salt River Plant Road (southbound only).  Ms. Enlow 2nd.  Motion carried 4-2.  Wetzel and Ellis voted against.

 

Mr. Hatfield then read the following statement:

“At the beginning of the year I was appointed by this council and Mayor Tinnell to a special committee to investigate and oversee the South Bullitt Regional Interceptor Project.  I have spent the last 6 months trying my best to keep this project alive and at the same time protect Shepherdsville and its rate payers.  This project has the possibility of being a great addition to Shepherdsville’s infrastructure and a catalyst for large economic development.  However, from the beginning my primary goal has been to keep this project from weighing too heavily on the shoulders of rate payers of Shepherdsville.

 

At this time I want to be on the record stating that this project has not been routed in the most cost effective manner.  I feel there are hundreds of thousands of dollars if not millions that could be trimmed off this project and still efficiently provide the Highway 245 Corridor with sewers and the City of Shepherdsville with a beneficial addition to it’s infrastructure.  I have been trying unsuccessfully for several months to have these changes made and so far have been met with much resistance.

 

I know I was not elected to this council to sit still while the City spends money unwisely so I won’t.  However, I also know I am only one vote.  As one of the council members appointed to this sewer line committee it is my opinion that with a few changes to this line we can enjoy massive cost savings.  I as a councilman will continue to try and obtain the support I need to make these changes.  If the rest of the council feels I am in error then through their votes they can disagree and it is their right to do so.”

 

Mr. Cundiff stated that he has had someone request that the City change to a non-partisan election which would eliminate the primary.

 

Attorney Bill Wilson read second reading of  Ordinance 009-766-rezoning 5.8 acres at the corner of

Hensley Road
and Hwy 44 West for Miles Homes, LLC from B-1 Highway Business to R-3 Residential. Mr. John Woolridge spoke on behalf of the applicant.  He stated they were going to build a mix of homes, patio homes and town houses. No one spoke in opposition.  Motion to approve the rezoning by Ms. Enlow, Mr. Hatfield 2nd.  Motion carried 6-0.

 

Motion at 7:45 p.m. to go to executive session to discuss litigation, personnel and property acquisition by Mr. Wetzel. Ms. Enlow 2nd.  Motion carried 6-0.

 

Motion to reconvene by  Mr. Cundiff at 9:09 p.m.  Mr. Hatfield 2nd.  Motion carried 6-0.

 

Attorney Bill Wilson  said they did not discuss personnel, but they did discuss litigation and property acquisition while in executive session, however no decisions were made.

 

Motion to adjourn at by Mr. Wetzel,  Mr. Ellis 2nd.   Motion carried 6-0. Meeting adjourned at 9:11 p.m.
