MINUTES REGULAR COUNCIL MEETING

MONDAY, June 22, 2009

 

Office Tim Wade said the invocation.

 

The Pledge of Alliance to the flag was said.

 

Mayor Tinnell called the meeting to order at 6:32 p.m.

 

In attendance were Council members Don Cundiff, Scott Ellis, Bonnie Enlow, Larry Hatfield, and Alan Wetzel. Tony Miller was absent.

 

Mr. Cundiff made the motion to dispense of the reading of the minutes from the June 8, 2009 City Council meeting.  Mr. Hatfield 2nd.  Motion carried 5-0.  Mr. Ellis made the motion to approve the minutes as presented.  Mr. Wetzel 2nd.  Motion carried 5-0. 

 

Old Business:

Attorney Bill Wilson read the second reading of Ordinance 009-767-closing a portion of an unimproved alley.  Motion to approve by Mr. Cundiff.  Mr. Wetzel 2nd. Motion carried 5-0.

 

Attorney Bill Wilson read the second reading of Ordinance 009-768-closing a portion of an unimproved alley formerly known as

North Street
.  Motion to approve by Mr. Hatfield.  Mr. Ellis 2nd.  Motion carried 5-0.

 

Attorney Bill Wilson read the second reading of Ordinance 009-769 Adopting the General Fund Budget for 2009-2010.  After discussion a motion to approve by Hatfield.  Ms. Enlow 2nd.  Motion carried 5-0.

 

Attorney Bill Wilson read the second reading of Ordinance 009-770 Adopting the Sewer Fund Budget for 2009-2010. After discussion a motion to approve by Mr. Hatfield.  Mr. Ellis 2nd.  Motion carried 5-0.

 

New Business:

Attorney Bill Wilson read Resolution 009-007 Allowing the Mayor to sign an Memorandum of Agreement with the Department of Highways for the Beechgrove Road Bypass. Motion to accept by Ms. Enlow.  Mr. Ellis 2nd.  Motion carried 5-0.

 

Attorney Bill Wilson read the first reading of Ordinance 009-771 Rezoning 984 Old Preston Highway.

 

Sign-in Speakers:

Depp Rasner- he is working on a “Right of Entry” agreement with CSX Railroad to paint the underpasses in Shepherdsville as part of the Operation Bright and Beautiful.  Mr. Givan has donated $ 3,000 to the project.  He will provide the Council members with copies of the scope of the project.

 

Depp Rasner also stated that he is working with the County on funding for clean-up thru the litter abatement program.  The County is going to pay them $100 per mile to clean up along the sides of the roads.  He asked the City to consider doing a similar program.

 

Depp Rasner also stated that he has scheduled Hot River Nights for Saturday August 8th in the First Street Park from 2 pm until 7 pm.

 

Residents from

Beechgrove Road
came to let the City Council know that they appreciated the Council opening up
Salt River Plant Road
.

 

Ed Faircloth asked if

Salt River Plant Road
was going to be open in both directions and if they were only going to be able to turn South.  He is opposed to the reopening.  He said people drive through their yards and does not feel that opening the road is a benefit.  Mayor Tinnell responded that this may be just a temporary thing until the Beechgrove bypass is completed.

 

Mike Richards stated that he fells there is too much speeding down

Salt River Plant Road
and they if they put in a turning lane and traffic light at the end of
Beechgrove Road
and Hwy 61 that would take care of the problem. 
Salt River Plant Road
has been closed for three years and should remain closed.

 

Jerry Parker- read a prepared statement as to how and why the road was closed and why he feels it should remain closed.  Mainly due to safety reasons.

 

Ron Akridge came to thank the Mayor and City Council for the improvements they are making in the park and to thank the police department for their extra patrol.  He also thanked them for opening

Salt River Plant Road
.  He did asked if there is something that can be done about the many yard sale signs that are on telephone and street poles in Shepherdsville.

 

Planning & zoning update- none

 

Board of Adjustment update- Duane Price

Said they have an upcoming case on an encroachment of a sign on

Dawson Drive
.

 

Departmental reports:

Jim McAulliffe reported that the is working on another demolition at

240 6th Avenue
.  He said the property is owned by Peoples Bank of Mt. Washington and they have agreed to pay for the expenses.

 

John Bradley reported he just went thru his first MS4 audit and everything went very well.

 

Council reports:  

Mr. Wetzel advised the rest of the council that he feels that if the City is only going to open

Salt River Plant Road
on a temporary basis that it is not cost effective to do so.  He would like to see it remain closed.

 

Ms. Enlow said she has been speaking with Judge Roberts and they would like our assistance to open the swimming pool.  Ms. Roberts state she has someone who will do the repairs for free but need the City’s help in funding the operation of the pool.

 

Mr. Ellis state he is not in agreement on opening Salt River Plant Road either and that if there is just one fatality that is one fatality too many.

 

Motion at 7:55 p.m. to go to executive session to discuss personnel and property acquisition by Mr. Ellis. Mr. Hatfield 2nd.  Motion carried 5-0.

 

Motion to reconvene by  Mr. Ellis at 8:30 p.m.  Mr. Wetzel 2nd.  Motion carried 5-0.

 

Attorney Bill Wilson  said they did discuss personnel, but no decision was made and that they did discuss property acquisition and he was given a direction to go, however no decisions were made.

 

Motion to adjourn at by Mr. Cundiff,  Mr. Ellis 2nd.   Motion carried 5-0. Meeting adjourned at 8:32 p.m.
