MINUTES REGULAR COUNCIL MEETING CITY OF SHEPHERDSVILLE 634 CONESTOGA PARKWAY SHEPHERDSVILLE, KY 40165 MONDAY, August 10, 2009
Police Officer Tim Wade said the invocation. The Pledge of Alliance to the flag was said. Mayor Tinnell called the meeting to order at 6:35 p.m. In attendance were Council members Don Cundiff, Scott Ellis, Larry Hatfield, Tony Miller and Alan Wetzel. Bonnie Enlow was absent. Mr. Cundiff made the motion to dispense of the reading of the minutes from the July 27, 2009 City Council meeting. Mr. Ellis 2nd. Motion carried 5-0. Mr. Ellis made the motion to approve the minutes as presented. Mr. Wetzel 2nd. Motion carried 5-0. Mr. Tracy Schiller and Mr. Ed Brodt with the COPS program made a presentation on their recent evaluation of the Shepherdsville Police Department. They explained the process and presented a written copy of the results. Mayor Tinnell announced that Congressman Brett Guthrie will be at City Hall on Tuesday August 11, 2009 to meet with the public. Mayor Tinnell also thanked everyone for their kindness during the recent loss of his sister, Sandra Ryan. Old Business: None New Business: Attorney Bill Wilson read Resolution No. 009-008-Accepting a $ 75,000 grant thru KIA for the Salt River Interceptor Project. Motion to approve by Mr. Hatfield. 2nd by Mr. Ellis. Motion carried 5-0. Attorney Bill Wilson read Resolution No. 009-009-Accepting a $ 216,800 grant thru EPA for the Salt River Interceptor Project. Motion to approve by Mr. Hatfield. 2nd by Mr. Miller. Motion carried 5-0. A parade permit was presented by Depp Rasner for 2nd Sunday event. Motion to approve by Mr. Cundiff, 2nd by Mr. Ellis. Motion carried 5-0. Sign-in Speakers: David Eadens-Candidate for State Senate asked for everyone’s support in the next election. He said he feels there needs to be average people in Frankfort. He has a strong back ground in education and municipal government. Steve Woods said he was told by planning and zoning that the City would need to issue him a permit to operate a haunted house at 121 and 125 E. 2nd Street. Bill Wilson advised him he felt that he needs to start with the County because they are the ones who would issue a conditional use permit and then the City could act on his request. He also asked the Council about the drainage problem he brought to them 5 months ago. Mayor Tinnell responded that they have looked at the problem and there is a lot that will need to be done by the property owners before the City can do anything, but they are still looking at the problem and he could not say when they would be able to act on it. Rusty Watson-Meadowlark Subdivision-complained that he is confused about street parking in his neighborhood. He said they keep getting warning citations for parking on the street and when he called the Police Department they said that it is OK to park on the street. Chief Puckett responded that it is a safety issue to park on the street. He knows that sometimes it is necessary, but the traffic officer is just doing what he is asked to do. Terry Wallace who lives in the Point Subdivision complained about a neighbor who has changed the drainage beside his house. It is not on the City easement but wants the City to get involved. Mr. Wilson advised him that possibly the deed restrictions in the area would be a solution to the problem. Mr. Wallace and Mr. Wilson to call each other and see what can be done. Planning & zoning update- none Board of Adjustment update- Duane Price - none Departmental reports: Chief Whitaker gave a report that during the heavy rain last week in Louisville our swift water team went to Louisville to assist with mutual aid. Chief Puckett reported that with the stimulus money the police department was awarded funding for one additional police officer. The funding is for 3 years. This will bring the total number of officers to 26. Jr. Bright reported that his project is about 400 feet from Buffalo Run, however the recent rains have slowed the project somewhat.
Council reports: Mr. Miller reported that in his area several speed limit and no parking signs have been removed and would like to see them replaced. The Mayor suggested he call the Public Works Department and advise them and they will replace them. Mr. Cundiff asked if the City has taken over Haley Avenue. The answer is no. The Mayor said Chuck has an estimate to repave it, but not sure how much it is. He also asked Bill Wilson to start to work on ordinances for yard sales, open burning and dogs barking. Motion at 8:15 p.m. to go to executive session to discuss litigation and property acquisition by Mr. Cundiff. 2nd by Mr. Ellis. Motion carried 5-0. Motion at 8:55 p.m. to reconvene by Mr. Cundiff. 2nd by Mr. Ellis. Motion carried 5-0. Attorney Bill Wilson said property acquisition and litigation were discussed and he was given instructions on how to proceed with both issues. Motion to adjourn at by Mr. Ellis, Mr. Wetzel 2nd.
