MINUTES REGULAR COUNCIL MEETING

MONDAY, September 28, 2009

 

Pastor Randy Pace said the invocation.

 

The Pledge of Alliance to the flag was said.

 

Mayor Tinnell called the meeting to order at 6:35 p.m.

 

In attendance were Council members Don Cundiff, Scott Ellis, Bonnie Enlow, Larry Hatfield, Tony Miller and Alan Wetzel.

 

Mr. Ellis made the motion to dispense of the reading of the minutes from the September 14, 2009 City Council meeting.  Mr. Miller 2nd.  Motion carried 5 and one abstention.  Mr. Miller abstained from voting. Mr. Cundiff made the motion to approve the minutes as presented.  Mr. Ellis 2nd.  Motion carried 5 and one abstention. 

 

Mayor Tinnell announced that there will be a benefit for Bobby Donaldson at the First Street Park Saturday October 3rd from 9-5.  

 

City Clerk Maxine Jeffries stated Melinda Lewis from Public Entity could not be in attendance and that she brought the check from KLC for $ 2,927 as a refund on Police Liability Coverage due to the accreditation certificate.

 

Old Business:

Attorney Bill Wilson read the first reading of Ordinance 009-767 and 009-768. Both ordinances are corrections on the alley closings previous passed.

 

New Business:

Kelly Carter with the Bullitt County Health Department talked to the council about the new program the department has called Mobilizing for Action through Planning and Partnerships.

 

Attorney Bill Wilson read Resolution 009-011-Authorizing an Assistance Agreement with KIA.  Motion to approve by Mr. Cundiff.  Mr. Ellis 2nd. Motion carried 6-0

 

Motion by Ms. Enlow to approve payment of bills for September.  Mr. Ellis 2nd.  Motion carried 6-0.

 

Sign-in Speakers:

Tiffany Rameriz, owner of Cabo’s Cantina spoke to council asking them to take another look at the Sunday liquor sales.  They feel that without it they may not be able to stay open.  She presented the city with a petition with signatures of some of their customers who want Sunday sales.

 

Bonnie Matlow, Partners & Prevention gave the council members statistics on Alcohol sales in Bullitt County.  She spoke against Sunday sales.

 

Planning & zoning update- none

 

Board of Adjustment update- Duane Price - none

 

 

 

Departmental reports:

Captain Patchin reported that the Police Department launched their new website today and encouraged everyone to look at it.

 

Jim McAulliffe reported that he has been working with the works department on possibly cutting grass at vacant properties and placing liens for the expenses.

 

Council reports:  

Mr. Wetzel said that he thought it is time for the council to consider some type of simulated ballot that will enable the citizens to vote on Sunday sales.  He sad he would like to finalize everything by the next meeting.

 

Mr. Hatfield agreed.  He said that he thinks we need to know how the public feels before putting this to a vote again.

 

Ms. Enlow stated that this would not be a legally bound vote and that she will still vote no.

 

Mr. Miller stated that he previously talked to County Clerk Kevin Mooney and that Mr. Mooney stated that according to the statutes it could not be put on the ballot during a general election.

 

Mayor Tinnell stated that he felt they need to inquire about the cost of a simulated ballot.

 

Mr. Wetzel made a motion to move ahead with the plan for a mock ballot and explore the cost and report it back at the next council meeting on October 12.  Mr. Hatfield 2nd.  Motion carried 4-2.  Mr. Miller and Ms. Enlow voted no.

 

Ms. Enlow advised that the Old Tyme Festival committee will meet at City Hall on October 20 at 6 p.m.

 

Mr. Cundiff asked other council members to look over the yard sale ordinance and try to have it ready to present at the next meeting.

 

Mr. Wetzel made the motion at 7:30 pm to go to executive session to discuss property acquisition, litigation and personnel.  Mr. Ellis 2nd.  Motion carried 6-0.

 

Mr. Ellis made the motion to reconvene at 9:00 pm.  Mr. Cundiff 2nd.  Motion carried 6-0.

 

Attorney Bill Wilson stated property acquisition and litigation was discussed and he was given a direction to pursue and that personnel was discussed and the Mayor was given direction on how to proceed with the issue.

 

Motion to adjourn at by Mr. Hatfield,  Mr. Miller 2nd.   Motion carried 6-0. Meeting adjourned at 9:00 p.m.
