MINUTES REGULAR COUNCIL MEETING CITY OF SHEPHERDSVILLE 634 CONESTOGA PARKWAY SHEPHERDSVILLE, KY 40165 MONDAY, OCTOBER 26, 2009
Police officer Mike Miller said the invocation. The Pledge of Alliance to the flag was said. Mayor Tinnell called the meeting to order at 6:35 p.m. In attendance were Council members Don Cundiff, Scott Ellis, Bonnie Enlow, Tony Miller and Alan Wetzel. Larry Hatfield was absent. Mr. Ellis made the motion to dispense of the reading of the minutes from the October 12, 2009 City Council meeting. Mr. Miller 2nd. Motion carried 5-0. Mr. Cundiff made the motion to approve the minutes as presented. Mr. Ellis 2nd. Motion carried 5-0. Mayor Tinnell announced that both sewer projects are making very good progress. He mentioned that the baseball field at the park is almost complete. Old Business: Attorney Bill Wilson read the second reading of Ordinance 009-775-Regulating nuisances. Motion to approve as presented by Mr. Cundiff. Ms. Enlow 2nd. Motion carried 5-0. New Business: Attorney Bill Wilson read Resolution 009-012-Allowing the Mayor to sign papers on the new vehicle for the Public Works Department. Motion to approve by Mr. Miller. Ms. Enlow 2nd. Motion carried 5-0. Motion to approve payment of bills for October by Ms. Enlow. Mr. Ellis 2nd. Motion carried 5-0. Sign-in Speakers: Bruce Sewell-332 S. Peak and Bruce Cissell-318 S. Peak both came to complain about a drainage problem they have in the ditch beside their house. They stated that about 6 inches of water stands there constant. They said that several years ago the city put a concrete ditch from up on the hill and it carries gravel down and it stands in their ditch. They presented the council members with pictures. Chuck Keith said he has looked at it and has also cleaned it out a couple of times, but it comes right back. Chuck is going to get the price to concrete their ditch also. Planning & zoning update- Daryl Lee-none Board of Adjustment update- Duane Price – the county is looking at a text amendment to regulate the parking of semi’s on vacant lots.
Departmental reports: John Bradley-reported that Frisch’s is due to start construction in January 2010. Chief Whitaker reported that the results from their department audit should be available later this week. Chief Puckett reported that they now have a new drug dog. Kenny Waters is going to be the new canine officer. He also stated that they will be doing their Halloween detail again this year. Mr. Ellis made a motion that trick or treating only be allowed from 5 to 9 pm on Saturday night. Mr. Wetzel 2nd the motion. Motion carried 5-0. Jr. Bright stated that the electric work on the new pump station is complete. Chuck Keith stated that he has been in contact with District 5 about the lack of signs being posted to notify people that the bridge is closed temporarily. District 5 told him they would get signs out. Billy Benningfield stated that he started today at the sewer plant in a leadership role and he will be working with Mike Schroeder and that everything is looking good at the sewer plant. Council reports: Mr. Wetzel welcomed Billy Benningfield to the City. Mr. Miller stated he has had two calls about the signs that are attached to the posts of the main sign in the Kroger shopping center. The signs block the view of on coming traffic. Mr. Ellis asked about the progress of the speed humps for Hester Street that was discussed at the October 12th meeting. Mayor Tinnell responded that the person who requested the change did not live on Hester and they are checking with the residents there to make sure they want them. Mr. Cundiff asked Bill Wilson about the fire/open burning ordinance that was discussed some months ago. Bill Wilson stated he would work on simplifying the ordinance. Mr. Cundiff also asked for everyone to look at the suggestion that Mac made about a kennel ordinance. Motion by Mr. Ellis at 7:00 pm to go to executive session to discuss litigation and personnel. Mr. Wetzel 2nd. Motion carried 5-0. Motion to reconvene at 7:40 pm to return from executive session by Ms. Enlow. Mr. Cundiff 2nd. Motion carried 5-0. Attorney Bill Wilson stated that in regards to the personnel issue the Mayor was given guidance and in regards to the litigation the council advised him the direction they want him to pursue. Motion to adjourn at by Mr. Ellis, Ms. Enlow 2nd. Motion carried 5-0.
