October 24, 2005

Mayor Sohm welcomed and thanked everyone for attending the meeting.

Reverend David Naylor, St. Aloysius Catholic Church gave the invocation.

The Pledge of Allegiance to the Flag was said.

Mayor Sohm called the meeting to order at 6:34 p.m.

In attendance were Council members Tony Miller, Margaret Moore, Faith Portman and Trina Summers.

Trina Summers made motion to dispense with reading of 10/10/2005 regular meeting minutes. Tony Miller 2nd. Motion carried 4-0.

Tony Miller made motion to approve minutes as printed.  Trina Summers 2nd. Motion carried 4-0.

Mayor Sohm introduced Police Chief Ron Morris who introduced the new Part Time Police Clerk, Deanna Duncan, who will work from 4:00-8:00 p.m. Monday through Friday.

Mayor Sohm announced that Councilwoman Faith Portman was a new grandma with the birth of her second grandson, Jacob Steven.

Mayor Sohm also announced that he had become a new grandfather with the birth of his first grandchild, Skylar Nicole.

City Attorney Joe Wantland had second reading of Ordinance 005-(number to be assigned) an ordinance establishing and implementing a program to asses and collect user fees for the development of public safety services rendered by the City of Shepherdsville, Bullitt County, Kentucky, for motor vehicle collisions, environmental endangerment, hazard material containment and other related emergency services. Tony Miller made motion to accept. Faith Portman 2nd. Motion carried 4-0. (This Ordinance will be numbered 005-677.)

City Attorney Wantland had second reading of Ordinance 005-(number to be assigned) an ordinance establishing reimbursement to the City of Shepherdsville for costs, expenses and fees associated with the City of Shepherdsville Police Department within and by the City of Shepherdsville, Bullitt County, Kentucky. Trina Summers made motion to accept. Tony Miller 2nd. Motion carried 3-0-1 (Margaret Moore abstained.) This Ordinance will become effective date of publication. (This Ordinance will be numbered 005-678.)

Wastewater Treatment Plant Superintendent Mike Schroeder announced that on October 27th and 28th Bullitt Lick Middle School students will tour the plant. He stated there would be approximately 70 kids each day. He invited the Council to attend. Mr. Schroeder also reported that the Sewer Plant had purchased an Odolog which measures odors at pump stations. He reported that the pump station at the Rest Area had recently been checked and the readings were very close to being lethal. The City took it upon ourselves to add an odor control substance and now the readings are in the normal range. Mike reported this would also help several other pump stations with odor problems. Mike also reported that he has attended several demos on Vactor Trucks. He stated the purchase of a Vactor Truck is in this year’s budget and he was putting specs together to go out for bid. Mike also stated that Brian Moore with the Courier Journal wrote a good article on the sewer plant.

There was no report from the Historical Committee.

Mayor Sohm reported that paving within the City should begin the first or second week of November. Mayor Sohm also stated that there had been a request to pave Hester Court because it was in such disrepair. He stated we cannot identify this street as ever being taken into the City’s maintenance program. He stated if we want to make repairs, the Council will need to vote to have it paved. He stated he City wouldn’t be able to pave the entire road without easements. City Attorney Wantland stated the road is dedicated to public use but the City needs deed of easement to pave entire Court. Councilwoman Margaret Moore stated these people pay taxes, have a road sign and pay utilities, she believes the road should be blacktopped. Margaret Moore made motion to bring the Court into the City’s maintenance program. Trina Summers 2nd. Mayor Sohm stated this could cause some question because the road is not built to the City’s Design Criteria Specifications. City Attorney Wantland stated there is almost no chance of development in this area and suggested adding to the motion “if in the future the road is to be used for commercial use the road must be brought up to the current Design Criteria Specifications. Mayor Sohm stated that we may want to limit truck traffic on this street by adding a 6000 pound weight limit restriction. He suggested asking Rumpke not to use the street and asking the property owners to agree to take their garbage can to the end of the street to be picked up. Margaret Moore and Trina Summers both agreed to amend their motion by adding what the City Attorney suggested. Motion carried 4-0.

Mayor Sohm reported that the initial road connecting the two parks has been cut in and filled with gravel. He stated that the fence at Frank Simon Park had not been moved yet. He stated he would like to meet with the Recreation Committee and a representative from the YMCA to discuss plans for the park. He asked the Council to ride by and look at the new road. Mayor Sohm also stated we have started cleaning up around the river. He stated we need to hire some part time help to mow so we can continue this clean up. Mayor Sohm also stated that he would like to put playground equipment in both parks.

City Attorney Wantland read Resolution 05-03 establishing adoption of the KIPDA Regional Hazard Mitigation Plan by the City of Shepherdsville, Bullitt County, Kentucky. Trina Summers made motion to approve. Tony Miller 2nd. Motion carried 4-0.

City Attorney Wantland opened bid on gas and diesel for the City. He stated that only one bid had been received from Jim White (Jamie’s White Lightning). City Attorney Wantland stated that this station did not offer 24 hour service. Tony Miller made motion to reject bid based on fact that our bid specifications called for 24 hour service and our police and fire departments depend on 24 hour service. Faith Portman 2nd. Motion carried 4-0. We will reopen bid to revisit the 24 hour service. Police Chief Ron Morris suggested looking into a fleet card program which offers a $0.15 gallon discount. Mayor Sohm asked Chief Morris to research this and report back.

City Attorney Wantland had first reading of Ordinance 005-(number to be assigned) proposing annexation of unincorporated territory adjoining the City of Shepherdsville, Bullitt County, Kentucky. City Attorney Wantland stated this is 235 acres belonging to the Hamilton family that borders the Lauth development and will be used for light industrial

Trina Summers made motion to pay October bills. Faith Portman 2nd. Motion carried 4-0.

Planning Commission Appointee Ben Robards reported the City had two rezoning cases. He stated Ray and Lynn Walls have filed to rezone their property from Agricultural and B-1 Highway Business to IL Light Industrial. The property is 13.25 acres, more or less, located at 1880 and 1954 S Preston Highway. He stated this request had received a favorable recommendation with one restriction.  Terry and Karen Higdon have filed to rezone their property from R-1 Residential to B-2 Central Business. The property is .57 acres, more or less, located at 2933 Highway 44 East. He stated this request had also received a favorable recommendation with two restrictions.

 Board of Adjustments Appointee Scott Isert was not present at the meeting.

Police Chief Morris thanked the Council for their support of the two Ordinances passed tonight

Councilman Tony Miller thanked Reporter Brian Moore for the article in the paper about the railroad crossing. Mr. Miller also stated he had received a call about a house on Melwood that the fire department responded to for a gas leak. Assistant Fire Chief Terry Whittaker reported that the fire department did respond to a call on Melwood for a gas leak but when they got there they could not find service to the home. He stated the only measurable gas found was in the ditch and that was not enough to cause concern. Councilman Miller asked Assistant Chief Whittaker if he could attend the next meeting for the opening of the gas and diesel bids.

Councilwoman Margaret Moore reported that Mr. Samuels is having a problem with drainage. He lives at the end of First Avenue. Mayor Sohm stated he and Public Works Foreman Jesse Walls would look at the problem to see if the City could do anything about it. He stated if there was something we can do we will.

Mayor Sohm stated that the Louisville Advisory Board had recently met and provided him with a layout of the entire area that new water lines are being installed throughout the City. He invited the Council to review at their convenience.

Tony Miller made motion to adjourn. Margaret Moore 2nd. Motion carried 4-0. Meeting adjourned at 8:09 p.m.
