MINUTES REGULAR COUNCIL MEETING
CITY OF SHEPHERDSVILLE,
MONDAY, JUNE 14, 2010
Officer Tim Wade said the invocation.
The Pledge of Alliance to the flag was said.
Mayor Tinnell called the meeting to order at 6:30 p.m.
In attendance were Council members Don Cundiff, Scott Ellis, Bonnie Enlow, Larry Hatfield, and Alan Wetzel. Tony Miller arrived at 6:55 p.m.
Mr. Cundiff made the motion to dispense of the reading of the minutes from the May 24, 2010 City Council meeting. Mr. Ellis 2nd. Motion carried 5-0. Mr. Ellis made the motion to approve the minutes as presented. Ms. Enlow 2nd. Motion carried 5-0.
Mayor Tinnell announced that retired officer Don Whittaker passed away and asked everyone to remember the family in prayer.
Old Business:
Mr. Hatfield made a motion to table the decision on Ordinance 010-779 until the June 28th Council meeting and give the clerk time to contact Mr. Fleener and ask him to attend the next meeting so he can answer any questions the council has on the rezoning. Mr. Cundiff 2nd the motion. Motion carried 5-0.
Mr. Hatfield also made the motion to table Ordinance 010-780 regulating Wrecker Services. Ms. Enlow 2nd the motion. Motion carried 5-0.
Attorney Bill Wilson read the second reading of Ordinance 010-781 making amendments to the nuisance ordinance. Ms. Enlow made a motion to approve as read. Mr. Cundiff 2nd. Motion carried 5-0.
New Business:
Attorney Bill Wilson read the first reading of Ordinance 010-782 2010-2011 General Fund Budget.
Attorney Bill Wilson read the first reading of Ordinance 010-783 2010-2011 Sewer Fund Budget.
Sign-in Speakers:
Boy Scout Chris Brown presented the Mayor and Council members with pictures of his completed eagle scout project he did in the park. He thanked the City for their assistance and for allowing him to do the project.
John Colburn-candidate for City Council asked permission to hold a public meeting on July 1 at 4:30 p.m. on Frank E. Simon Avenue in front of the court house. Several council members had a problem with closing the street during that time of day due to the Court house is still open and conducting business. Judge Ward was in the audience and commented that with the Sheriffs department being there and the court house still being open it would not be a good idea. Motion by Mr. Hatfield NOT to close Frank E. Simon Avenue. Ms. Enlow 2nd. Motion carried with 5-0 and Mr. Ellis abstained from voting. Mr. Cundiff said we need to come up with an alternate plan prior to the next council meeting.
Bob Elkins-Old Ford Road resident asked when the work (due to the Beechgrove Road Bypass Project) on his property was going to be completed. He especially wanted to know when the City was going to install the fence that he was promised. Mayor Tinnell advised Mr. Elkins that the project is contingent on State Highway money and that the City has just again gotten the approval from the state. The Mayor did assure Mr. Elkins that the work would be completed soon.
Judge Ward announced that there had been some miscommunication and that the American Legion Post that was suppose to present the City with a POW/MIA flag during the council meeting, was instead at the City Park installing a new POW/MIA flag.

Council reports:
Mr. Hatfield said that Angie Johnston with QK4 would be making a presentation at the next meeting on the 28th.
Mr. Cundiff asked when the garbage contract was due for renewal.
Motion by Mr. Hatfield at 7:15 p.m. to go to executive session to discuss a possible litigation. Mr. Wetzel 2nd. Motion carried 6-0.
Motion by Ms. Enlow to reconvene at 7:30. Mr. Hatfield 2nd. Motion carried 6-0
Attorney Bill Wilson said that they had discussed an agreement they had with a company known as Corn Island to do an archeological study on the Salt River Interceptor Project and the council advised him to negotiate with the company to possibly resolve the issue.
Motion to adjourn by Mr. Wetzel. Mr. Ellis 2nd. Meeting adjourned at 7:35 p.m.
