MINUTES REGULAR COUNCIL MEETING
CITY OF SHEPHERDSVILLE,
MONDAY, JUNE 28, 2010
Officer Mike Miller said the invocation.
The Pledge of Alliance to the flag was said.
Mayor Tinnell called the meeting to order at 6:30 p.m.
In attendance were Council members Don Cundiff, Scott Ellis, Bonnie Enlow, Larry Hatfield, Tony Miller and Alan Wetzel.
Ms. Enlow made the motion to dispense of the reading of the minutes from the June 14, 2010 City Council meeting. Mr. Wetzel 2nd. Motion carried 6-0. Mr. Ellis made the motion to approve the minutes as presented. Ms. Enlow 2nd. Motion carried 6-0.
Old Business:
City Attorney Bill Wilson read the second reading of Ordinance 010-779 to rezone the corner of Blue lick and Bryant Lane.
Discussion: Property owner Mr. Fleener said originally he had planned to build a single family 3 bedroom, one bath home but now wants to build a duplex. He presented the plans he had on a duplex to council members. He would need to file for a variance for a 30 foot setback. Several Council members stated their concerns about drainage. They feel development of this lot will cause water problems for the neighbors. Mr. Fleener said he has plans to take care of the water issue and that he feels the drainage in the area will take care of any run off. Mr. Kevin Smith spoke against the rezoning. He stated the drainage is not the only issue. He feels that any new construction there would be a detriment to the neighborhood. Mr. Wayne Downs also spoke in opposition. He stated all the other houses on Bryant have a 50 foot setback and does not want a duplex when all other properties are single family dwellings. Mr. Ellis made a motion to deny the rezoning. Ms. Enlow 2nd the motion. Motion carried 6-0.
City Attorney Bill Wilson read the second reading of Ordinance 010-780 regulating Wrecker Services. Ms. Enlow made the motion to approve as presented. Mr. Ellis 2nd the motion.
Discussion: Attorney Amanda Spalding, (representing Troy’s Wrecker Service) advised the council that Troy’s Wrecker service is currently on our list but if this ordinance passes he would be off the list because he does not have an office or location within the City limits of Shepherdsville. She also cited several problems she had with the wording of the ordinance. She also advised that she feels Ms. Enlow has a personal interest in A&M towing who is also on the list. Ms. Enlow denied the accusation. Ms. Enlow said that A&M borrowed money and purchased the business and that she no longer has personal interest in the business. Several council members asked questions about the meaning of primary business location. Mr. Wilson stated they had to have a physical business located in the corporate limits of Shepherdsville. Ms. Enlow also stated that the 4 businesses that are currently on the list are averaging 4 runs per month. Chief Puckett stated that if someone is in an accident and does not want the wrecker service next in rotation they do not have to use them and they do not have to use someone on the list.
Motion to approve the ordinance as presented by Mr. Ellis. Ms. Enlow 2nd. Motion carried 4-2. Mr. Hatfield and Mr. Cundiff voted no.
Attorney Bill Wilson read the second reading of Ordinance 010-782 approving 2010-2011 Budget for the City of Shepherdsville. After discussion Mr. Hatfield made a motion to approve as read. Mr. Wetzel 2nd. Motion carried 6-0.
Mr. Cundiff commented that he would like to form a committee to research health insurance costs and see how other Cities pay. Mr. Ellis and Mr. Wetzel will also serve on the committee.
Attorney Bill Wilson read the second reading of Ordinance 010-783 approving 2010-2011 Budget for the Shepherdsville Sewer Department. Mr. Hatfield made a motion to approve as read. Mr. Ellis 2nd. Motion carried 6-0.
New Business:
Mr. Hatfield made the motion to approve the payment of bills for the month of June. Ms. Enlow 2nd. Motion carried 6-0
Sign-in Speakers:
Depp Rasner with the Beautification committee announced they had secured the funding to paint the murals on the railroad underpasses in Shepherdsville. He asked for help from various departments in the City to make sure everything goes as planned.

Departmental reports:
Jim McAuliffe stated he would like everyone to look at 188 Shannon Lane. It is a foreclosure and it need to be demolished.
Council reports: none
Motion by Mr. Hatfield at 8:00 p.m. to go to executive session to discuss a possible litigation. Mr. Wetzel 2nd. Motion carried 6-0.
Motion by Mr. Ellis to reconvene at 9:00. Mr. Cundiff 2nd. Motion carried 6-0
Attorney Bill Wilson said that he updated the Mayor and Council on pending litigation and was given a direction to proceed in those matters.
Mr. Wilson also stated that all the necessary easements on the Old Ford Road Project have been obtained and that he and the Mayor will be meeting with the state on what they need to do to proceed.
Motion to adjourn by Mr. Hatfield. Mr. Ellis 2nd. Motion carried 6-0. Meeting adjourned at 9:05 p.m.
