MINUTES REGULAR COUNCIL MEETING

CITY OF SHEPHERDSVILLE,

MONDAY, September 13, 2010

Captain Ken Bernardi said the invocation.

The Pledge of Alliance to the flag was said.

Mayor Tinnell called the meeting to order at 6:30 p.m.

In attendance were Council members Don Cundiff, Scott Ellis, Bonnie Enlow, Tony Miller and Alan Wetzel. Larry Hatfield was absent.

Mr. Cundiff made the motion to dispense with the reading of the minutes from the August 23, 2010 City Council meeting and September 1, 2010 Special Meeting.  Mr. Wetzel 2nd.  Motion carried 5-0. Mr. Ellis made the motion to approve the minutes as presented.    Mr. Wetzel 2nd the motion.  Motion carried 5-0.

Old Business:

Second reading of Ordinance 010-790 to set Real Property Tax rate.  Mr. Cundiff made a motion to approve.  Mr. Wetzel 2nd .     Motion carried 5-0.

Second reading of Ordinance 010-791 to set Personal Property Tax rate.  Ms. Enlow made a motion to approve.  Mr. Ellis 2nd.     Motion carried 5-0.

New Business:

Attorney Jennifer Barbagallo read a Proclamation from the Mayor and City Council against domestic violence.

A parade permit from Bullitt Central for the homecoming parade was presented.  Motion by Ms. Enlow to approve.  Mr. Ellis 2nd.  Motion carried 5-0.

Sign-in Speakers

Brenda Fawbush came to speak about her (and her neighbors) concern about the apartments that are being proposed behind Bratcher Estates.  She said they would create several problems including drainage issues, traffic, crime, noise and other problems.  She feels the developer has not done his part in the past to do things right and that it would just get worse if he is allowed to put the apartments in.

Crystal Lyons came to speak about an incident that occurred in Hickory Acres on September 6. A man stopped and performed a sexual act in front of several children.  She reported it to the police and they made a report; however she was unable to reach the reporting officer for several days following the incident and did not feel it was handled appropriately or in a timely manner.  She said she did her own research and found the subject on the sex offenders’ website and that as of today Officer Boone still had not contacted her.  Mayor Tinnell said this was a terrible incident and that she should talk to Chief Puckett.  Chief Puckett stated that Officer Boone has been off sick and that he would talk to her to see what was going on.

Denise Peacock of 151 Carpenter Street came to speak about the change that was made to the speed bump in front of her house.  Mayor Tinnell stated that the speed bump was ground down to one inch to make it a speed hump and it was painted and a sign was put up.  This is the same process that was done to the other speed bumps in the city. Mrs. Peacock was not pleased with what she referred to as the removal of the speed bump and feels that her grandchildren could be in danger because of this.

Council reports: 

Don Cundiff asked Jim McAullife if he had found out anything about the sign from the Kitchen.  Mac said he talked to the owner and he plans on re-opening.

Motion to adjourn to executive session at 7:05 p.m. for litigation and property issues by Mr. Cundiff.  Ms. Enlow 2nd.  Motion carried 5-0.

Motion to reconvene at 8:05 pm by Mr. Ellis.  Ms. Enlow 2nd.  Motion carried 5-0. 

Jennifer Barbagallo reported the council discussed possible litigation and property acquisition and that no decisions were made. 

Motion to adjourn by Ms. Enlow, Mr. Ellis 2nd.   Motion carried 5-0 Meeting adjourned at 8:07 p.m.
