JANUARY 10, 2005

Mayor Sohm welcomed and thanked everyone for attending the meeting.

Ed Jensen, Divine Savior Lutheran Church gave the invocation.

The Pledge of Allegiance to the Flag was said.

Mayor Sohm called the meeting to order at 6:32 p.m.

In attendance were Council members Stacey Cline, Tony Miller, Margaret Moore, Faith Portman, Trina Summers and Alan Wetzel.

Stacey Cline made motion to dispense with reading of 12/13/2004 regular meeting minutes. Trina Summers 2nd. Motion carried 6-0.

Tony Miller made motion to approve minutes as printed. Stacey Cline 2nd. Motion carried 6-0.

Mayor Sohm welcomed the new council members and said he was looking forward to working with them for the next two years.

Mayor Sohm reported that the judicial center on Highway 480 had to be evacuated today due to a chemical discharge in the building. Several people were transported to the hospital and several more were treated at the scene. He stated Shepherdsville Fire Department responded with several other agencies and did a very good job handling the situation.

Mayor Sohm reported that Public Works Assistant Foreman Bennie Stillwell had to have surgery and is doing very well.

Mayor Sohm announced City Hall would be closed on January 17th in observance of Martin Luther King Jr. Day.

City Attorney Wantland had second reading and public hearing on Ordinance 004-(number to be assigned) on request by Divine Savior Lutheran Church of Shepherdsville, Inc. to rezone 2.25 acres, more or less, located on the south side of Northside Avenue, 400’, more or less, west of N Preston Highway from R-1 Residential to R-3 Residential. City Attorney Wantland stated this had received a favorable recommendation from the Planning Commission. Mayor Sohm asked if there was anyone present on behalf of the Church. Ed Jensen was present and stated he would try to answer any questions the Council had. Councilwoman Margaret Moore asked Mr. Jensen what the plans were for the property. Mr. Jensen stated that with the highway coming through the Church would probably sell the property and relocate. Mayor Sohm asked if the reason they were requesting an R-3 zoning was because the property would be worth more. Mr. Jensen answered yes. Councilman Tony Miller asked why rezone R-1 to R-3 because R-3 has smaller lots. Mayor Sohm stated apartments can go on R-3. Councilwoman Trina Summers asked if the apartment owners approached the Church about selling property. Mr. Jensen stated he thinks that Pastor Lehenbauer spoke with them. Councilman Miller made motion to put a restriction of 70 foot lots on the Ordinance. Councilwoman Moore 2nd. Mayor Sohm stated that since there was no one present to discuss this matter he would like to table until the next meeting. Councilman Miller and Councilwoman Moore withdrew their motion and 2nd. Mr. Jensen stated that he would contact Mr. Steve Sahloff who is knowledgeable about this subject to be at the next meeting. Councilwoman Stacey Cline made motion to table this discussion and public hearing until the January 24th meeting. Councilman Tony Miller 2nd. Motion carried 6-0.

City Attorney Wantland had second reading and public hearing on Ordinance 004-(number to be assigned) on request by Donna Ferguson Satterly to rezone .67 acres, more or less, located at 2002 Highway 44 East from R-1 Residential to B-2 Central Business. City Attorney Wantland stated this had also received a favorable recommendation with restrictions from the Planning Commission. Councilwoman Moore stated she would like to require brick front on the building. There was no public comment. Councilwoman Moore asked if the property owner had received a letter that this issue was going to come up at this meeting. The City Clerk stated that notice had been published in the paper. Councilwoman Moore stated she feels we should send letters out. City Attorney Wantland stated that we need to only do what is required by law. Mayor Sohm suggested we table this issue and discuss adding the deed restriction of all brick front at the next meeting after we ask the property owner to attend the meeting. Councilman Miller made motion to table until the next meeting. Councilman Alan Wetzel 2nd. Motion carried 6-0.

Further discussion followed on request by Dogwood Homes to take over all streets in Lakes of Dogwood. Public Works Foreman Jesse Walls stated he had done core samples on streets and they all met the design criteria specifications. He stated he thought there was a drainage issue regarding a catch basin over a driveway. David Miles, representing Dogwood Homes stated he has agreed to fix this problem per a conversation with Toby Spalding, the City’s engineer. Mr. Miles stated that the City is holding $1000 if the problem is not corrected but assured the Mayor and Council he would fix the problem. The City Clerk stated that the pump station is also included in this request to be taken over. Councilwoman Stacey Cline made motion to take over the streets, sewers and pump station providing there are no problems with the sewers after being videoed. Councilwoman Moore 2nd. Motion carried 6-0. Mr. Miles asked how long it would be before the sewer lines were videoed. Mayor Sohm asked Wastewater Treatment Plant Superintendent Mike Schroeder how long before the lines could be looked at? WWTPS Schroeder stated within the next six weeks.

There were no Sewer, Historical, Transportation/Beautification or Recreation Committee reports. However, Mayor Sohm did again thank all departments for putting up the holiday decorations this year.

City Attorney Wantland read Proclamation 05-01 proclaiming January 2005 as School Board Recognition Month. Councilwoman Moore made motion to approve. Councilwoman Cline 2nd. Motion carried 6-0.

Planning Commission Appointee Ben Robards stated there was nothing new for Shepherdsville.

Board of Adjustments Appointee Scott Isert was not present at the meeting.

Police Chief Ron Morris invited the Mayor and Council to the Roby DARE graduation on Thursday at 2:00 p.m. Chief Morris also reported that John Bradley has taken over full time responsibility of the Code Enforcement Officer duties. He stated that Officer Bradley had opened 21 cases last week. Chief Morris also encouraged all Council members to sign up for the e-mail alert program being initiated by the police department. He also reported that the department had formed a committee to look at the VIPS program. This is looking into the feasibility of using volunteers to help the police department in various areas.

Public Works Foreman Jesse Walls reported there had been a fire in the public works garage and there was mostly smoke damage. They are in the process of cleaning up and making a list of items lost.

City Attorney Wantland stated he would like to give property owners a heads up before talking about them at a public meeting. He encouraged the Council that when calling him, the City Clerk or Officer Bradley to have as much information as possible on the problem. This will assist in getting the problem taken care of in a timely manner.

Margaret Moore asked if the audit would be presented at the next meeting. The City Clerk stated that the audit was scheduled to be presented at the next meeting barring any delays. Councilwoman Moore also welcomed the new council members.

Mayor Sohm welcomed the new council members and encouraged them to call him with any questions, suggestions or concerns.

Stacey Cline made motion to adjourn. Tony Miller 2nd. Motion carried 6-0. Meeting adjourned at 7:24 p.m.
