NOVEMBER 22, 2004

Mayor Sohm welcomed and thanked everyone for attending the meeting.

Pastor Gary Hardin, First Baptist Church of Shepherdsville gave the invocation.

The Pledge of Allegiance to the Flag was said.

Mayor Sohm called the meeting to order at 6:33 p.m.

In attendance were Council members Stacey Cline, Don Cundiff, Margaret Moore, Duane Price and James Watkins.

Stacey Cline made motion to dispense with reading of 11/8/2004 regular meeting minutes. James Watkins 2nd. Motion carried 5-0.

Don Cundiff made motion to approve minutes as printed. James Watkins 2nd. Motion carried 5-0.

Mayor Sohm announced that “Light Up Shepherdsville” would be Thursday, December 2nd at 6:00 on First Street.

Mayor Sohm announced that the Annual Holiday Dinner/Awards Banquet would be on Friday, December 10th, 6:00 p.m. at Paroquet Springs Conference Centre.

Mayor Sohm announced that the Swearing In Ceremony for the new council members would be Thursday, December 30th, 6:30 p.m. at City Hall.

Mayor Sohm announced that the City had been approved for a $100,000 grant from a Federal Appropriations Bill to assist in its Phase II Storm water project.

Mayor Sohm announced that Item B on the agenda has been removed from discussion per the request of council members.

City Attorney Wantland had second reading and public hearing on Ordinance 004-(number to be assigned) on request by Charles Burris and Judy Burris to rezone 10 acres, more or less, of property accessed through an easement that runs between the Bullitt County Stockyards and the Bullitt County Road Department on S Preston Highway (the property is to the right immediately after you cross the CSX Railroad tracks). City Attorney Wantland stated that the Planning Commission recommended approval and there was no opposition to the request. Mark Edison stated he was present on behalf of Mr. Burris. He stated that Mr. Burris had drawn up a map showing what ground was usable (shaded in green) and what ground was low and wet (shaded in blue).  City Attorney Wantland asked if Mr. Burris would be willing to restrict the portion of property and limit use to two acres. Mr. Edison stated he has no problem with that. City Attorney Wantland asked if Mr. Burris would be willing to limit the number of cars stored on the property at one time. Mr. Wantland suggested limiting the number of cars to a normal rotation of 30, not to exceed 50 at any time and to limit the use of property to two acres for auto purposes. Mr. Edison and Mr. Burris agreed to these restrictions. City Attorney Wantland stated he would get with Mr. Edison to work out the wording. Councilman James Watkins stated his only concern was with the railroad crossing. Mayor Sohm asked if Mr. Burris would be willing to give the City a right of way along the railroad. Mr. Burris stated he has no problem with this but would have to talk with Mr. Hester. James Watkins made motion to rezone property with the added restrictions as stated above. Stacey Cline 2nd. Motion carried 5-0. (This Ordinance will be numbered 004-645).

There were no Sewer, Historical, Transportation/Beautification or Recreation Committee reports.

City Attorney Wantland had first reading of Ordinance 004-(number to be assigned) amending the City of Shepherdsville, Bullitt County, Kentucky, annual budget for fiscal year July 1, 2003 through June 30, 2004 by estimating revenues and resources and appropriating funds for the operation of City Government.

City Attorney Wantland had first reading of Ordinance 004-(number to be assigned) amending the City of Shepherdsville, Bullitt County, Kentucky, water and sewer operation and maintenance budget for fiscal year July 1, 2003 through June 30, 2004 by estimating revenues and resources and appropriating funds for the operation of the Water and Sewer Department.

City Attorney Wantland had first summary reading of Ordinance 004-(number to be assigned). A flood damage prevention ordinance for the City of Shepherdsville.

City Attorney Wantland read a Resolution of Intent relating to flood damage prevention in the City of Shepherdsville.

Don Cundiff made motion to pay November bills. James Watkins 2nd. Motion carried 5-0.

Planning Commission Appointee Ben Robards reported there were two new cases for Shepherdsville. Divine Savior Lutheran Church of Shepherdsville requesting 2.25 acres, more or less, located on the south side of Northside Avenue, 400’, more or less, west of N Preston Highway from R-1 Residential to R-3 Residential and Donna Ferguson Satterly requesting .67 acres, more or less, located at 2002 Highway 44 East from R-1 Residential to B-2 Central Business. Mr. Robards also reported that the Commission should be acting on the new zoning regulations in December and could possibly adopt at the January meeting.

Board of Adjustments Appointee Scott Isert was not present at the meeting but sent the meeting docket to the Council for review.

Councilwoman Margaret Moore stated she would like to go into executive session to discuss litigation.

Planning Commission Appointee Ben Robards reported that all litigation concerning Shepherdsville and Matsuda had been dismissed.

Mayor Sohm asked for a motion to adjourn to executive session to discuss litigation and land acquisition. Stacey Cline made motion to adjourn to executive session. James Watkins 2nd. Motion carried 5-0.

Don Cundiff made motion to return to regular session. James Watkins 2nd. Motion carried 5-0. City Attorney Wantland stated that the Mayor had been given instructions on how to proceed and will do so before the next meeting.

Stacey Cline made motion to adjourn. Don Cundiff 2nd. Motion carried 5-0. Meeting adjourned at 7:48 p.m.
