NOVEMBER 8, 2004

Mayor Sohm welcomed and thanked everyone for attending the meeting.

Pastor Randy Pace, Family Worship Center gave the invocation.

The Pledge of Allegiance to the Flag was said.

Mayor Sohm called the meeting to order at 6:35 p.m.

In attendance were Council members Stacey Cline, Don Cundiff, Tony Miller, Margaret Moore, Duane Price and James Watkins.

James Watkins made motion to dispense with reading of 10/25/2004 regular meeting minutes. Stacey Cline 2nd. Motion carried 6-0.

Tony Miller made motion to approve minutes as printed. Don Cundiff 2nd. Motion carried 6-0.

Mayor Sohm announced that City Hall would be closed on Veterans Day, Thursday, November 11th.

Police Chief Ron Morris introduced the 3 newest officers to the Shepherdsville Police Department. Jeff Schank, Jeremy Meyer and Johnathan Smith. He stated these three officers were at the top of their class in the Academy.

City Attorney Wantland had second summary reading of Ordinance 004-(number to be assigned) approving a lease for the financing of a project, providing for the payment and security of the lease; creating a sinking fund; and authorizing the execution of various documents related to such lease (for purchase of police in car cameras.) Chief Morris stated this would allow cameras to be put in all patrol vehicles. Don Cundiff made motion to approve. James Watkins 2nd. Motion carried 6-0. (This Ordinance will be numbered 004-643.)

City Attorney Wantland had second reading and public hearing on Ordinance 004-(number to be assigned) on request by Joseph Cruise to rezone 60’ x 150’ of property located at 1289 Highway 44 East from R-1 Residential to B-2 Central Business. There was no comment from the audience but Councilwoman Margaret Moore asked Mr. Cruse what his plans were for a 60’ x 150’ lot. Mr. Cruise stated that he has been renting the property for 20 years and the renter has moved out. He stated he is thinking about putting it up for sale but he has no plans for any development. Tony Miller made motion to rezone. Stacey Cline 2nd. Motion carried 6-0. (This Ordinance will be numbered 004-644.)

Mayor Sohm stated he has a draft set of plans for the interceptor line at City Hall and invited the Council to come by to review them if they wished.

Mayor Sohm reported that David Strange has been working on getting the old stone jail opened back up and that he has done a good job with this project.

There were no Transportation/Beautification or Recreation Committee reports.

City Attorney Wantland had first reading of Ordinance 004-(number to be assigned) on request by Charles Burris and Judy Burris to rezone 10 acres, more or less, of property accessed through an easement that runs between the Bullitt County Stockyards and the Bullitt County Road Department on S Preston Highway (the property is to the right immediately after you cross the CSX Railroad tracks). City Attorney Wantland stated that the Planning Commission recommended approval with no restrictions. Councilwoman Margaret Moore asked Mr. Burris what his plans were for the property. Mr. Burris stated he would like to open a small car lot. Councilwoman Moore asked about the railroad crossing. Mr. Burris stated that would not really be a problem because you can see a mile down the track and he doesn’t feel this will add a high volume of traffic to the area. Mayor Sohm asked Mr. Burris if he would do auto repair on the property. Mr. Burris stated there would be no auto repair except to fix the cars to be sold. Mr. Burris stated he would put a sign on the side of the building that they are going to use and the Bullitt County Stockyards has agreed to put a sign on their fence. Mr. Burris stated he would only have 20-25 cars on the lot at one time. City Attorney Wantland asked Mr. Burris if the DMV was going to require him to have commercial property. Mr. Burris stated he has a dealer’s license to sell. Councilwoman Moore stated she has a problem with putting a sign on the fence. Mr. Burris stated he is not that concerned with a sign and would not put a sign on the fence. Councilman Tony Miller stated that ten acres is a large lot for 20-25 cars. Mr. Burris stated there are 35-40 cars on the lot now and that some would be hauled off and crushed. Mr. Burris stated that four acres of that property is in water since the jail was built. City Attorney Wantland asked Mr. Burris if the City could put a limit on the number of cars allowed on the property at a time. Mr. Burris stated he has no problem with that. City Attorney Wantland stated he would like to designate two acres for cars. Mayor Sohm stated the second reading would be November 22nd.

Mayor Sohm stated that the City had received a request from Richard Miles to take over Lakes of Dogwood, Sections one, two, three and four: Reichmuth Lane, Lakes of Dogwood Blvd., Lakes Edge Drive, Lake Park Court, Clear Lake Drive, White Blossom Drive, Pagoda Court. Councilwoman Moore stated we need to have an engineer check this out before we approve this request. Mayor Sohm asked Public Works Foreman Jesse Walls to check this out, get the number of miles involved and get core samples of the roads. Mayor Sohm stated that if there are any problems PWF Walls feels we need an engineer’s opinion we will hire one.

Discussion on request from Marine Corps Reserve Toys for Tots placing a box for toy collection in City Hall. It was decided to call the event coordinator and make sure that all toys collected would stay in Shepherdsville.

Planning Commission Appointee Ben Robards was not present at this time.

Board of Adjustments Appointee Scott Isert was not present at the meeting.

Major Dannye Allen with the Fire Department stated that the fire department is sponsoring a program to Shop with a Firefighter this year. He stated 10 families from Roby and Cedar Grove would be picked and the children will be taken shopping by a firefighter and lunch served to them at the firehouse.

Councilman Tony Miller stated there is a yard on Tollview that school buses keep driving through and tearing up and the homeowner wants the City to fix. City Attorney Wantland stated that this is not the city’s responsibility to repair this yard. Mr. Miller also congratulated everyone on the election and stated to James, Don and Duane that he has really enjoyed working with them and wished everyone a Merry Christmas since this is probably his last meeting of the year due some surgery coming up.

Councilman James Watkins congratulated everyone on the election and wished them luck.

Councilman Don Cundiff asked about the status of the stop light at Highway 44 and Paroquet Springs Drive. Mayor Sohm stated that he has spoken with Brian Meade with the Transportation Cabinet who has a drawing and is supposed to be checking on this for us. Mayor Sohm stated he feels like we may have money left from the grant and will be able to include this as part of Adam Shepherd Parkway project. He stated the State has no plans to install a new light at this intersection. Mr. Cundiff congratulated everyone of the election and wished them luck.

Councilman Duane Price wished everyone good luck.

Councilwoman Margaret Moore stated she is disappointed that Don didn’t win the election and she feels the people made a mistake.

Planning Commission Appointee Ben Robards was present at this time and reported there was nothing new for Shepherdsville. He stated that because of the meeting date change he had not received his docket yet.

Mayor Sohm congratulated the newly elected Council members, Alan Wetzel, Faith Portman and Trina Summers and stated he is looking forward to working with them.

Mayor Sohm stated that we usually cancel the last meeting in December and asked the Council if they would like to do that at this time. Margaret Moore made motion to cancel the December 27th Council meeting unless an emergency arises and it is needed. Tony Miller 2nd. Motion carried 6-0.

Mayor Sohm asked for a motion to adjourn to executive session to discuss litigation and land acquisition. City Attorney Wantland invited newly elected Council members Faith Portman and Alan Wetzel to attend the session. James Watkins made motion to adjourn to executive session. Don Cundiff 2nd. Motion carried 6-0.

James Watkins made motion to return to regular session. Stacey Cline 2nd. Motion carried 6-0. City Attorney Wantland stated that land acquisition had been discussed and that he and the Mayor have received instructions on how to proceed and will do so.

Tony Miller made motion to adjourn. Stacey Cline 2nd. Motion carried 6-0. Meeting adjourned at 8:16 p.m.
