Mayor Sohm welcomed and thanked everyone for attending the meeting.

 

Reverend Tom LaHue, North Bullitt Christian Church gave the invocation.

 

The Pledge of Allegiance to the Flag was said.

 

Mayor Sohm called the meeting to order at 6:32 p.m.

 

In attendance were Council members Stacey Cline, Don Cundiff, Larry Hatfield, Tony Miller, Margaret Moore and James Watkins.

 

James Watkins made motion to dispense with reading of 4/26/2004 regular meeting minutes. Don Cundiff 2nd. Motion carried 6-0.

 

Tony Miller made motion to approve minutes as printed. Stacey Cline 2nd. Motion carried 6-0.

 

Mayor Sohm reminded everyone that the special meeting with developers would be Monday, May 17th, 6:30 p.m. at City Hall. He invited all developers, engineers, business owners, and any interested citizens to attend this meeting to discuss future development in the City.

 

Mayor Sohm thanked everyone who attended the meeting with the Transportation Cabinet to discuss the Study of Highway 44. He reported that it was a good meeting and very well attended. He encouraged anyone who has not filled out the questionnaire handed out at the meeting to do so and mail it in. He stated there were copies in the back of the room on the table for anyone interested in filling one out.

 

City Attorney Wantland had second reading and public hearing on Ordinance 004-(number to be assigned) proposing annexation of property belonging to Marilyn Maraman Lee, being unincorporated territory adjoining the City of Shepherdsville. There was no one present to speak for or against the annexation. Don Cundiff made motion to pass. Larry Hatfield 2nd. Motion carried 6-0. (This Ordinance will be numbered 004-621.)

 

City Attorney Wantland had second reading of Ordinance 004-(number to be assigned) amending Ordinance 002-551 relating to the mandatory pick up of garbage with the City providing for payment therefore and penalties for failure to comply.

 

After some discussion on the policy for garbage falling out of dumpsters, and it was decided to contact our Waste Management representative, Larry Hatfield made motion to approve. Don Cundiff 2nd. Motion carried 6-0. (This Ordinance will be numbered 004-622.)

 

Mayor Sohm stated that the engineer is working on proposals to fix the drainage problem at River Valley and Beechwood Estates subdivisions.  He stated the easiest solution would be to fill the ditch up to a certain level with dirt, not rock, and the top eight inches should be top soil so it will grow grass and the water will flow. He stated the engineer would be present at the May 24th Council meeting to explain alternatives on fixing this problem.

 

There was no report from the Sewer, Historical, Transportation/Beatification or Recreation Committees.

 

City Attorney Wantland had first reading of Ordinance 004-(number to be assigned) confirming annexation of property belonging to Marilyn Maraman Lee, an unincorporated territory adjoining the City.

 

City Attorney Wantland had first reading of Ordinance 004-(number to be assigned) proposing annexation of property belonging to Troutwine Family, LLC and Sheila T. Bolus, being unincorporated territory adjoining the City.

 

City Attorney Wantland had first reading of Ordinance 004-(number to be assigned) concerning request for rezoning from Richard Miles, under contract to purchase property from J. Meadows, LLC from Agricultural to R-3 Residential. The property is 108 acres, more or less, and located on the west side of N Preston Highway abutting the north property line of the United States Post Office and then running in a westerly direction to W Blue Lick Road in the vicinity of Saltwell Road.

 

City Attorney Wantland had first reading of Ordinance 004-(number to be assigned) concerning request for rezoning from William G. Reesor, Ronald Reesor, James Ricky Reesor and Darlene Francis Perkins from R-2 and Stream Valley Reserve to B-1 Highway Business. The property is 5.8 acres, more or less, and located at the southeast intersection of Highway 44 West and Hensley Road.

 

City Attorney Wantland had first reading of Ordinance 004-(number to be assigned) concerning request for rezoning from Matsuda, LLC from R-1 Residential, R-4 Residential, Agricultural and B-1 Highway Business to EPA (53.163 acres) and EPB (66.864 acres). The property is located at 4404 Coral Ridge Road and Sarver Lane.

 

Angie Woodward addressed the Council giving her recommendation for a farmers market to set up in Shepherdsville. She stated this would be a community event with a small number of people selling fresh produce. She stated for the first year vendors would be asked to pay $240.00 for a tent and table and would be set up every Saturday from 8:00 a.m. to 12:00 noon at the Paroquet Springs Conference Centre. She stated that in other areas the market is set up vendors are not required to pay a business license fee and is asking the City to waive their fee of $100. She stated at this time she has six vendors available for the Paroquet Springs market but a decision needs to be made so the market can get started. The season is approximately 22 weeks and at this time it is down to 20 weeks. She stated she has received approximately $8300 in donations to start the market and would like the City’s assistance in getting started. She stated that rules and regulation policies have been established and they are ready to start. She stated the only hold up is that none of the vendors want to buy a business license and pay occupational withholding to participate in the market. She asked if the City would join as a sponsor along with the Tourism Commission, Chamber of Commerce and Farm Bureau? Councilman Tony Miller stated he would like to see this happen but the City does charge flea market participants for an occupational license. Councilman Don Cundiff stated he would also like to see it but we have to be fair.  Councilwoman Margaret Moore stated that the farmers market is only going to be there for four hours one day a week and the flea market vendors are there many more hours and more days. Councilman Larry Hatfield feels we could prorate for the number of months the farmers market is in business, approximately $40. Mayor Sohm stated we need to be fair; the City could possibly prorate but not waive the fee entirely. Police Chief Ron Morris stated at this time most vendors at the flea market do not have a business license due to the fact that the man hours involved in pursuing this is prohibitive. Ms. Woodward stated she would like to see the City become a sponsor of the farmers market. Mayor Sohm asked City Attorney Wantland if the City could prorate the fee. City Attorney Wantland stated he does not think the fee can be prorated. Councilman Hatfield suggested to Ms. Woodward to ask the Tourism Commission to buy the business licenses for the vendors to operate. Ms. Woodward stated she would do that.

 

Tot Moore addressed the Council and stated the hay on the First Street property needs to be cut right now. He stated that he and Hill Bleemel would like to buy the hay in the field. Larry Hatfield made motion to give the Mayor the authority to work out a deal with Tot Moore and Hill Bleemel for the hay. Tony Miller 2nd. Motion carried 6-0.

 

Planning Commission Appointee Ben Robards stated there was nothing new for Shepherdsville at this time.

 

Board of Adjustments Appointee Scott Isert sent a meeting docket to the Council and left word with the Mayor that he would be in attendance at the next meeting.

 

Public Works Foreman Jesse Walls stated that they are behind on ditching and other projects that need do be done and would like to hire some help. Councilwoman Margaret Moore stated since this is a personnel issue she would like to discuss in executive session.

 

Police Chief Ron Morris reported that Taser training started today and was going very well.

 

Councilwoman Stacey Cline asked if a letter had been sent to the business on Highway 44 West to clean up? Chief Morris stated the business had been cited and that an officer had been by there at 3:00 a.m. this morning and there was a sign there that everything left was free. He stated they would try to locate the owner and speak with him. Councilman Hatfield stated he knew the owner and would speak with him about this matter.

 

Councilwoman Cline asked about the culvert on Blue Lick Road. Mayor Sohm stated this was a state road.

 

Councilwoman Cline also stated she had received a complaint on the house by the car wash on Buckman. Chief Morris stated they have also been cited.

 

Councilman James Watkins asked if when the new school on Blue Lick was built if there were plans to put in a pipe to move water? Mayor Sohm stated the engineer has the plans now and is reviewing. He suggested Councilman Watkins call him to discuss this.

 

Councilwoman Cline asked where the children that practice football at Roby would practice once this new school is built? She asked if the property on First Street could be used for this purpose? Mayor Sohm stated he didn’t see a problem with them practicing on the property but parking would probably be a problem. Councilwoman Cline asked if the YMCA could use the property for soccer practice also. Mayor Sohm stated he didn’t feel that would be a problem either. Councilwoman Cline will call June Daugherty and let her know they can practice on First Street.

 

Councilman Don Cundiff again asked about the Paroquet Springs sign. Mayor Sohm stated he thought that would be done but that communication fell through. City Attorney Wantland stated he would follow up with the owners again. He also asked about the status of the house by the water plant. Mayor Sohm stated he has three phone numbers that he has called and received no response. He stated a letter would be sent for clean up.

 

Councilwoman Margaret Moore stated she has received complaints about gunshots in the park affecting people who live on Howlett Drive. Chief Morris asked Ms. Moore if they had called dispatch to report this. She said they had not called dispatch. Chief Morris stated that they need to call dispatch the next time this happens so an officer can check out the complaint. Ms. Moore also stated the sidewalks on Highway 44 East close to the Dawson Building need repair. She stated we need to get the address of the owner and send a letter.  She again stated the curve is deteriorating on Circle Drive. PWF Walls stated that was on the list to be repaired.

 

Councilman James Watkins stated that work needs to be done on the temporary sidewalk to the Post Office. It is covered with high grass and weeds.

 

Mayor Sohm asked for a motion to adjourn to executive session to discuss personnel, litigation and possible property purchase. Stacey Cline made motion to adjourn to executive session. James Watkins 2nd. Motion carried 6-0.

 

Don Cundiff made motion to return to regular session. Larry Hatfield 2nd. Motion carried 6-0. City Attorney Wantland stated the Mayor has been given authority to investigate property purchases as directed by the Council and to investigate putting temporary help on staff on a short term basis.

 

Larry Hatfield made motion to adjourn. Don Cundiff 2nd. Motion carried 6-0. Meeting adjourned at 9:15 p.m.
