FEBRUARY 23, 2004

Mayor Sohm welcomed and thanked everyone for attending the meeting.

Pastor Robert Stoess, Shepherdsville Church of Nazarene gave the invocation.

The Pledge of Allegiance to the Flag was said.

Mayor Sohm called the meeting to order at 6:33 p.m.

In attendance were Council members Stacey Cline, Don Cundiff, Larry Hatfield, Tony Miller, Margaret Moore and James Watkins.

James Watkins made motion to dispense with reading of 2/9/2004 meeting minutes. Stacey Cline 2nd. Motion carried 6-0.

James Watkins made motion to approve minutes as printed. Don Cundiff 2nd. Motion carried 6-0.

Mayor Sohm read a thank you card from Wilbur and Dolores Raymond and Cecil and Legatha Cox thanking him and the Council for sewers in the east end of the City and making a much needed drainage correction at the end of Grandview Drive and also for the Kroger store.

Larry Hatfield made motion to table the three ordinances on extending sale of alcohol and Sunday sale of alcohol indefinitely. Stating that the City is not ready for this right now. James Watkins 2nd.

Mr. Hatfield stated that when and if the matter comes up again all churches would be notified.

Mayor Sohm stated he thinks this issue needs to be put to rest and not tabled.

Don Cundiff stated this would not be brought up again without the public being notified. Tony Miller asked how the public would be notified? City Attorney Joe Wantland stated notice would be put in the paper.

At this time this is considered a dead issue.

After this discussion vote was taken. Motion carried 6-0 to table indefinitely.

City Attorney Wantland had second reading and public hearing on Ordinance 004-(number to be assigned) requesting rezoning from Valley View Farms I Limited Partnership to rezone 840 acres, more or less, from Agricultural to R-3 Residential located on the north side of Cedar Grove Road, bounded by Mooney Lane on the west, Valley View Drive on the east and Salt River on the north.

Tony Miller asked if the Korfage/Plenge families would have control over what’s put on the property. Mr. Plenge stated that yes, they would have control.

City Attorney Joe Wantland asked if they would agree to row houses being at least 1100 square foot? Mr. Plenge and Mr. Korfage agreed to this restriction.

After this discussion Don Cundiff made motion to approve. Margaret Moore 2nd. Motion carried 6-0. (This Ordinance will be numbered 004-609).

Discussion followed on the three ordinances pertaining to code enforcement. City Attorney Wantland stated that if Option A (relating to the adoption of a Code Enforcement Board) passed there would be no need for Option B (relating to the position of Citation Officer for the City fixing qualifications, tenure and compensation or Option C (relating to the funding of the City Police Department for the additional use of the officers for code enforcement).

Chief Morris stated he would like to assign an officer with sworn police duties to do code enforcement.

After further discussion Margaret Moore stated she would recommend that we put this on hold and ask that each Council member ride the streets of Shepherdsville to see the problems first hand.

After further discussing this issue the Council asked that City Attorney Wantland have the second reading of Option A, the ordinance that adopts a code enforcement board with a police officer serving as code enforcement officer.  Don Cundiff made motion to approve. Stacey Cline 2nd. Motion carried 6-0. (This Ordinance will be numbered 004-610).

City Attorney Wantland had second reading of Ordinance 004-(number to be assigned) amending Ordinance 004-606 establishing a permit and fee for the construction or demolition of buildings within the City. Margaret Moore made motion to approve. James Watkins 2nd. Motion carried 6-0. (This Ordinance will be numbered 004-611).

Mayor Sohm asked Wastewater Treatment Plant Superintendent Mike Schroeder if he had anything to report on Sewer issues. WWTPS Schroeder stated that there has been some discussion in the past about putting mandatory clean outs at the property line for new developments, graded at ground level. He stated he would like to put this in Ordinance form and amend the Design Criteria Specifications that makes this an option.

City Attorney Wantland stated he feels we can already do that by just writing it on the building permit.

Don Cundiff made motion to take out the option of putting mandatory clean outs at the property line for new developments. Stacey Cline 2nd. Motion carried 6-0.

WWTPS Schroeder also stated that per the Storm Water permit guidelines, some of the City’s ordinances need updated. He feels that could be something the code enforcement officer can do with some guidance.

Mayor Sohm stated that the City is going to have to start spending some money on the Storm Water Permit requirements in the form of public hearings, hand outs to the community regarding storm water issues and hiring someone to find all the outfalls to the river in the City.

WWTPS Schroeder also stated that he had budgeted for a vactor trailer in this year’s budget but after further research feels the trailer will not fit our needs. He feels instead of a trailer we need a vactor truck and is getting bids. He also stated he is getting bids for a push camera for the TV truck.

There was no report from the Historical Committee.

Police Chief Ron Morris stated that the police department has started to work on some areas of the City that need attention such as working with the fire department to have the fire hydrants painted and painting/repairing parking meters. He stated he feels there are some things within the City we can clean up ourselves.

Public Works Foreman Jesse Walls stated he would like to take out the parking meters and replace with signs.

After further discussing this it was decided with the new Court House facility coming soon this could cause numerous problems.

PWF Walls stated he is working on an area by J.B. Close funeral home where rock can be put down making room for a parking lot.

Mayor Sohm stated we would contact FEMA and check on whether you can have paid parking on FEMA bought property.

Don Cundiff asked if there were any grants available for repairing or replacing parking meters? The City Clerk stated she would call KLC and see if they know of any grant money available to repair/replace parking meters.

Mayor Sohm stated that at the last meeting Tom Taylor, Chairman of the Recreation Committee handed out a report on issues concerning the park. Mayor Sohm asked the Council to think about Mr. Taylor’s report to discuss at the next meeting. He stated he felt Mr. Taylor had some good ideas about this property and feels we need to start making plans for its use.

Don Cundiff asked about a completion date for the Cedar Grove Industrial Park walking trails. Mayor Sohm stated he would call Jesse Flynn or Jim Rice and get an update on the project.

Mayor Sohm stated he had received a request to use the park for a Farmers Market. He stated we would call FEMA and get guidelines on land use.

Pastor Bill Klinglesmith with Crossroads Community Church addressed the Council about using a portable modular unit behind the church for use as a classroom. He stated they have run out of room in the building. City Attorney Wantland stated that he needed to go before the Planning Commission and get a conditional use permit. He stated the City has no objections after approval is received from Planning and Zoning and then a building permit is issued from the City.

City Attorney Wantland had first reading of Ordinance 004-(number to be assigned) rezoning property of Norman and Roberta Dillander from R-2 Residential to B-2 Central Business. The property is 7/10 of an acre, more or less, located at 1369 Highway 44 West.

Larry Hatfield made motion to approve payment of February bills. James Watkins 2nd. Motion carried 6-0.

Sherry Lish and Robbie Hines, residents of Emily Brook subdivision, addressed the Council about the streetlights being turned off by the developer.

Mayor Sohm stated that the developer had asked PWF Walls several months ago what needed to be done for the streets to be taken over by the City. At that time he was given a list of things to be done and told after these items were complete a letter needed to be submitted to the City asking that the streets be taken over.

Don Cundiff suggested calling or sending a letter to the developer regarding this problem. He feels we need to look at this and find a way to help solve this problem.

Mayor Sohm asked PWF Walls to get a punch list of items to be done and have it by the next meeting. The City Clerk was instructed to call Salt River Electric and get prices on having the streetlights turned back on.

Planning Commission Appointee Ben Robards stated there was nothing new to report for Shepherdsville.

Board of Adjustments Appointee Scott Isert reported that at the last meeting there were three variances approved; Able LLC to reduce parking and Gordon Food Service to reduce number and size of parking spaces.

Police Chief Morris stated he has been doing some research on sending invoices to people for criminal investigations. He stated he would like the Council’s input and possibly draw up an Ordinance.

Tony Miller asked for a copy of the Waste Management delinquent list and also reported the house next door to Hometown Car Wash needs a clean up letter.

Margaret Moore stated she would like to go into executive session to discuss land acquisition and personnel.

Tim Wise, 145 4th Avenue, addressed the Council about problems in Salt River. He stated that after the clean up letters were sent out recently only one person on the list attempted to clean up and others got worse. He would like to see something done about this problem.

Mayor Sohm asked for a motion to adjourn to executive session to discuss land acquisition and personnel. Don Cundiff made motion to adjourn to executive session. Margaret Moore 2nd. Motion carried 6-0.

Larry Hatfield made motion to return to regular session. James Watkins 2nd. Motion carried 6-0. City Attorney Wantland stated no action was taken and the Mayor will report back at the next meeting.
