Mayor Sohm welcomed and thanked everyone for attending the meeting.

Dan Taylor, North Bullitt Christian Church gave the invocation.

The Pledge of Allegiance to the Flag was said.

Mayor Sohm called the meeting to order at 6:35 p.m.

In attendance were Council members Stacey Cline, Tony Miller, Margaret Moore, Faith Portman, Trina Summers and Alan Wetzel.

Stacey Cline made motion to dispense with reading of 9/12/2005 regular meeting minutes. Tony Miller 2nd. Motion carried 6-0.

Trina Summers made motion to approve minutes as printed. Alan Wetzel 2nd. Motion carried 6-0.

Mayor Sohm announced that from 7:00 p.m. through 12:00 a.m. Tuesday, September 27th there would be two lanes closed on southbound I-65 for repair work.

Mayor Sohm introduced the City’s new Treasurer, Maxine Jeffries. She comes from the City of Shively and will be a great asset to the City.

City Attorney Wantland had second reading of Ordinance 005-(number to be assigned) confirming annexation of unincorporated territory adjoining the City of Shepherdsville. (This is the remaining property not annexed in Heritage Hill subdivision.). Trina Summers made motion to approve confirmation. Tony Miller 2nd. Motion carried 6-0. (This Ordinance will be numbered 005-675.)

There was no report from the Sewer, Historical, Transportation/Beautification or Recreation Committees.

City Attorney Wantland had first reading of Ordinance 005-(number to be assigned) establishing the real property ad valorem taxes and providing assessment, equalization and collection pursuant to the provisions of KRS 92.280, Et. Seq. Mayor Sohm stated that this is the seventh year in a row the City has been able to reduce the property tax rate for Shepherdsville citizens.

City Attorney Wantland had first reading of Ordinance 005-(number to be assigned) levying personal property, and property of public service companies ad valorem taxes and providing assessment, equalization and collection pursuant to the provisions of KRS 92.280, Et. Seq. Mayor Sohm stated the second reading of these Ordinances and public hearing would be at the October 10th meeting.

Stacey Cline made motion to approve payment of the September invoices. Faith Portman 2nd. Motion carried 6-0.

Ray Haines, 345 White Tail Circle addressed the Council about the sewer charges on his water bill. He stated that over the last several years he has built $4 million in homes in Shepherdsville. He stated he has paid $4773 in sewer charges for water that doesn’t go into the sewer for watering sod this summer and he thinks this is grossly unfair. Mayor Sohm stated that everyone is abiding by the same Ordinance and paying the same rates. Councilwoman Trina Summers stated that this is industry standard practice. Mr. Haines stated this is not an industry standard, he has been building housed 25 years and have been given discounts in Louisville for watering sod. He stated he didn’t think we would do anything about it he just wanted to let the City know he feels this is unfair. Mayor Sohm thanked him for building in Shepherdsville but stated that in order to change this we would have to amend the Ordinance. He stated he agrees the amount of money is terrible and asked Mr. Haines to leave his water bills with him so that we could check them out for possible over billing.

Alisha Colin, 369 Dogwood Run addressed the Council stating she was recently voted in the new president of the Homeowners Association. She stated she needs some assistance from the City in regard to speeding on Dogwood Run between 7:00-8:00 p.m.; overnight parking on streets (she stated she contacted the Sheriff’s Department and was told signs must be on every street; she stated they need No Parking Any Time signs); and she also asked for police patrol at the lake area at night. She stated people are going onto the play area to “play”; she asked if speed limit signs of 20 mph posted throughout the subdivision.

Attorney Mark Edison addressed the Council regarding the ally that runs from Combs Court to 2nd Street. He stated the problem is that Farm Bureau has 10 parking barriers in the ally. City Attorney stated if it is a City right of way he would contact Farm Bureau and ask them to move the bumpers. If they don’t remove them, the City will. Stacey Cline motioned to give Attorney Wantland permission to contact Farm Bureau about the barriers. Faith Portman 2nd. Motion carried 6-0. City Attorney Wantland asked Mr. Edison to contact LG&E to have the pole moved out of the right of way.

Planning Commission Appointee Ben Robards was not present at the meeting.

Board of Adjustments Appointee Scott Isert was not present at the meeting.

Councilwoman Trina Summers stated the High School Drive sidewalk looks great. She asked if there had been any more thought on the Vine Street sidewalk. Mayor Sohm stated he had the figures and would put a copy in each Council Member’s box. She also asked how far along we were on getting new playground equipment. Councilwoman Margaret Moore stated she needs some catalogs to look through to get ideas on what to purchase.

Councilman Tony Miller stated the grass at 208 Circle Drive needs cut, you can’t see the house because of the vines. He also reported 158 Joshua Court and 326 Tara Circle needs grass cut.

Councilwoman Faith Portman stated there were two houses on Buckman with high grass. She also asked if anything could be done about a house that leaves their garbage out all the time. She also stated that she had spoken with Ruth Chowning and Ms. Chowning inquired on whether the Walkable Trail signs had been put up in the park. Public Works Foreman Jesse Walls stated that he was waiting for someone to contact him about where to place the signs in the park.

Councilwoman Margaret Moore stated the grass in Salt River and at the Eddington building was high. She also inquired about paving Hester Court. PWF Walls stated he was not sure that Hester Court was a City Street or a private driveway. He stated he could not find where the City took it over. Mayor Sohm stated we can’t find any proof that the City took this street over. He stated the road goes in 60 foot and looks like a driveway. He asked the Council to keep in mind that we vote to take it over or we find the paperwork saying we took it into the City maintenance program. He stated the City can’t pave a street not in the City maintenance program.

Mayor Sohm asked for a motion to adjourn to executive session to discuss personnel and land acquisition. Alan Wetzel made motion to adjourn to executive session. Margaret Moore 2nd. Motion carried 6-0.

Stacey Cline made motion to return to regular session. Faith Portman 2nd. Motion carried 6-0.

City Attorney Wantland stated the Mayor had been given instructions to follow up on and he would do so.

Alan Wetzel made motion to adjourn. Faith Portman 2nd. Motion carried 6-0. Meeting adjourned at 8:28 p.m.
