AUGUST 25, 2003 Mayor Sohm welcomed and thanked everyone for attending the meeting. Pastor T. Michael Tobin, St. Aloysius Catholic Church gave the invocation. The Pledge of Allegiance to the Flag was said. Mayor Sohm called the meeting to order at 6:31 p.m. In attendance were Council members Stacey Cline, Don Cundiff, Tony Miller, Margaret Moore and James Watkins. James Watkins made motion to dispense with reading of 8/11/2003 regular meeting minutes and 8/18/2003 special meeting minutes. Tony Miller 2nd. Motion carried 5-0. Stacey Cline made motion to approve minutes as printed. Tony Miller 2nd. Motion carried 5-0. Mayor Sohm announced the sewer project walk-thru would be August 27th starting at 12:00 noon. He stated the project engineers; Toby Spalding and Joe Exely, Wastewater Treatment Plant Superintendent Mike Schroeder and himself would visit the project area and make a punch list of items to complete. Mayor Sohm also stated he would like to commend the Shepherdsville Fire Department for their response to 19 calls within 30 minutes last Friday after the storm. Mayor Sohm introduced David Presnell Jr. who gave the Council an update on the Adam Shepherd Parkway and Conestoga Parkway. Mr. Presnell recommended that the City Council vote the final contract award to Flynn Brothers tonight at this meeting. He stated there would be a pre-construction meeting on Wednesday, August 27th at 9:30 a.m. at City Hall. He invited the City Council to attend. Mayor Sohm stated that the bid was accepted at the special meeting held on August 28th. He stated another vote could be taken if Mr. Presnell thought it was necessary. Tony Miller made motion to accept bid from Flynn Brothers for construction of the Adam Shepherd Parkway and Conestoga Parkway. Don Cundiff 2nd. Motion carried 5-0. Mayor Sohm also announced that Bullitt County Imaging Center had dropped their opposition to a Jewish Hospital facility locating in Bullitt County. He stated he appreciates their sentiment and their support of Bullitt County. James Watkins made motion to remove Ordinance 003-(number to be assigned) to rezone property owned by Joiners Drywall, LLC from R-1 Residential to R-3 Residential. The property in question is 3.4 acres, more or less, located on the west side of S Preston Highway abutting the north property line of Insight Communications from the table for further discussion. Motion carried 5-0. Eric Farris was present at the meeting representing Joiner Drywall and stated that there were people at the meeting who can answer any question the Council has on this issue. After further discussion Margaret Moore made motion to follow recommendation of the Planning Commission and deny the rezoning. Tony Miller 2nd. Motion carried 5-0. WWTP Superintendent Schroeder reported that there were still a few bugs to be worked out at the plant but all in all things were going pretty well. There was no report from the Historical committee. Mayor Sohm reported that several streets in the City have been paved. He stated that he had received a request to pave Tollview Drive, Melwood Drive and parts of Jackie Way. Margaret Moore stated that 4th Avenue needs to be repaved and Public Works Foreman Jesse Walls stated High School Drive needs repaved. Don Cundiff asked about Third Street from Buckman Street back. PWF Walls stated Louisville Water Company has been doing work on Third Street but he feels they are just about finished. Mayor Sohm stated he would like to possibly widen Third Street between Abbott and Plum. PWF Walls stated he feels Louisville Water Company should resurface Carpenter Street due to the work they have done there. City Attorney Joe Wantland stated he would check on an ordinance requiring roads be put back equal to or better than they were when work began on them. Margaret Moore stated she feels companies who tear up the roads should be responsible to fix them. Mayor Sohm reported the Recreation Committee would meet on Wednesday, August 27th at 6:00 p.m. at City Hall. City Attorney Wantland had first reading of Ordinance 003-(number to be assigned) confirming annexation of unincorporated territory adjoining the City of Shepherdsville, Bullitt County, KY (Bruce Hamilton property). City Attorney Wantland had first reading of Ordinance 003-(number to be assigned) amending zoning maps of the City as recommended by the Bullitt County Joint Planning and Zoning Commission (Vicki and Samuel Dever). City Attorney Wantland had first summary reading of Ordinance 003-(number to be assigned) amending the City of Shepherdsville, Bullitt County, Kentucky, annual budget for fiscal year July 1, 2002 through June 30, 2003 by estimating revenues and resources and appropriating funds for the operation of city government. City Attorney Wantland had first summary reading of Ordinance 003-(number to be assigned) amending the City of Shepherdsville, Bullitt County, Kentucky, Water & Sewer Operation and Maintenance budget for fiscal year July 1, 2002 through June 30, 2003 by estimating revenues and resources and appropriating funds for the operation of the Water and Sewer Department. City Attorney Wantland had first reading of Ordinance 003-(number to be assigned) establishing the real property ad valorem taxes and providing assessment, equalization and collection pursuant to the provisions of KRS 92.280, et seq. City Attorney Wantland had first reading of Ordinance 003-(number to be assigned) levying personal property, and property of public service companies ad valorem taxes and providing assessment, equalization and collection pursuant to the provisions of KRS 92.280, et seq. City Attorney Wantland announced there would be a public hearing at 6:30 p.m. on September 8th at City Hall on the proposed tax rate. James Watkins made motion to pay August bills. Stacey Cline 2nd. Motion carried 5-0. Planning Commission Appointee Ben Robards stated there was one new case for Shepherdsville. Samuel & Vicki Dever are requesting rezoning on a piece or property. Mr. Robards also reported the Commission is awaiting a final draft of the new regulations. Board of Adjustments Appointee Scott Isert was not present at the meeting. PWF Walls stated that he has asked the State Transportation Cabinet to send him information about their design criteria regulations. WWTPS Schroeder stated that the tests he had done on the water runoff from Mr. Elkins property came back less than 20, which is below the required limit. Fire Chief Robbie Spriggs stated that the property on Highway 44 West is ready to burn. He also reported that the 1993 pumper fire truck had been temporarily put out of service and the City of Middletown loaned the City a back up in case of an emergency. Chief Spriggs also reported that the fire department was switching radio frequencies tonight as Zoneton has okayed the use of Fire Channel 1 for now. Stacey Cline stated that she has received complaints about cleaning up Buckman Street of trash, dirt and bushes. She asked PWF Walls to call the State and see if they will clean the road. Ms. Cline also stated that the I-65 overpass going toward Roby Elementary School also looks bad. PWF Walls suggested the City send a letter to County Judge Kenny Rigdon asking that they require the contractor working on the Court house and AOC facilities to clean up Frank E. Simon, Third Street and Highway 61 or the City will clean up and charge the contractor the cost. Don Cundiff suggested the City send a letter to Judge Rigdon asking that the contractor clean up on a daily basis. Margaret Moore stated that she had received some calls from residents on Bratcher Estates regarding drainage problems. Mayor Sohm stated he and PWF Walls would go look at the problem to determine if there is anything the City could do to help. Ms. Moore also stated that clean up letters needed to be sent to everyone who has junk in their yards on Hester and Carpenter streets. She stated that the property on 44 East by the Shell Station (Halls) needed to be mowed and that Adrian Jones’ property had not been cleaned up yet. PWF Walls stated that the City has been back in that area twice and dug out but they re-laid 200 feet of sewer line. Ms. Moore asked if there was any way the City could require property owners to tile and cover tile with dirt? City Attorney Wantland answered no. Conditions of rezoning are made by recommendation of the Planning Commission. He stated the City could not legally add or take away from zoning conditions. Ms. Moore asked if the City could pass an ordinance stating no more open ditches be allowed in the City? Mayor Sohm stated the Design Criteria standards require curb, gutters and closed ditches. He also stated it may interfere with the new storm water runoff requirements. James Watkins made motion to adjourn. Stacey Cline 2nd. Motion carried 5-0.
