AUGUST 11, 2003

Mayor Sohm welcomed and thanked everyone for attending the meeting.

Councilman Larry Hatfield gave the invocation.

The Pledge of Allegiance to the Flag was said.

Mayor Sohm called the meeting to order at 6:30 p.m.

In attendance were Council members Stacey Cline, Don Cundiff, Larry Hatfield and James Watkins.

James Watkins made motion to dispense with reading of 7/28/2003 regular meeting minutes. Don Cundiff 2nd. Motion carried 4-0.

Don Cundiff made motion to approve minutes as printed. Stacey Cline 2nd. Motion carried 4-0.

City Attorney Joe Wantland had second reading of Ordinance 003-(number to be assigned) confirming annexation of unincorporated territory adjoining the City of Shepherdsville, Bullitt County. (Phillip & Marsha Leigh/Eagle Heights Baptist Church).

James Watkins made motion to approve. Don Cundiff 2nd. Motion carried 4-0. (This ordinance will be numbered 003-592.)

City Attorney Wantland had second reading of Ordinance 003-(number to be assigned) approving a revenue lease in principal amount not to exceed $3,200,000 for the financing of a project (Paroquet Springs Conference Centre).

After some discussion Don Cundiff made motion to approve. James Watkins 2nd. Motion carried 4-0. (This ordinance will be numbered 003-593.)

Elaine Wilson, Executive Director of the Conference Centre and Tourism Commission thanked the Mayor and Council for their support of the Centre.

City Attorney Wantland had second reading and public hearing on Ordinance 003-(numbered to be assigned) to rezone property owned by John Miller, George Dilley, Richard Haarman and Eugene Paul from Stream Reserve and R-2 Residential to R-3 Residential. The property in question is 28.0 acres, more or less, located on the south side of Highway 44 East abutting the east property line of 2003 Highway 44 East in Shepherdsville. City Attorney Wantland stated that the Planning Commission denied this request.

Miss Eddington addressed the Council stating her opposition to this rezoning request.

(Tony Miller came in at this time.)

John Wooldridge addressed the council stating he was representing Mr. Miller, Dilley, Haarman and Paul. He stated the property is currently zoned stream reserve and located on Highway 44 East. He stated there would not be any streets intersect any street except for Highway 44. Mr. Wooldridge stated he feels the Planning Commission ruled in error. He handed out a page taken from the comprehensive plan in which he feels shows the property meets the medium density requirements. Mr. Wooldridge stated single-family homes and patio homes along Floyds Fork would be build with the possibility of town homes in the future. He also stated that the developers have agreed to 70-foot wide lots.

(Tony Miller removed himself from this discussion and vote due to a member of family being a business partner of one of the gentlemen involved.)

After further discussion Larry Hatfield made motion to approve the rezoning and reject the Planning Commission recommendation. Motion died for lack of a second.

Don Cundiff stated he had not heard anything to see why we should accept the rezoning and made the motion to accept the Planning Commission’s recommendation to deny the rezoning. Stacey Cline 2nd. Motion carried 3-1 (Larry Hatfield voted against.) (This ordinance will be numbered 003-594.)

City Attorney Wantland had second reading and public hearing on Ordinance 003-(number to be assigned) to rezone property owned by Joiners Drywall, LLC from R-1 Residential to R-3 Residential. The property in question is 3.4 acres, more or less, located on the west side of S Preston Highway abutting the north property line of Insight Communications in Shepherdsville. City Attorney Wantland stated that the Planning Commission also denied this request.

Eric Farris was present at the meeting representing Joiner Drywall. He stated this property is across the river just this side of Insight. It is approximately 3.4 acres and is bounded by the wastewater treatment plant. He stated the proposal is for three separate pairs of units (8 plex condos). He stated a common wall would join them with the entrance off of Highway 61. Mr. Farris stated he feels the need for housing to in this area to accommodate growth at the KY 480 corridor. He stated the price would be approximately $80,000 per unit and there will be heavy evergreen buffers. He also stated that only the building pads would be raised out of the flood zone. He stated this is not to be rental property.

Mr. Sam Hardy, 645 S Preston Highway spoke in opposition to the rezoning. He stated concerns over noise, congestion, smell from the sewer plant, the fact that the land is located in the flood plain and traffic.

After further discussion Larry Hatfield made motion to table this item until the next meeting to give the Council a chance to go look at the site. Stacey Cline 2nd. Motion carried 5-0.

James Watkins made motion to approve. Don Cundiff 2nd. Motion carried 5-0.

Further discussion followed on request from Jack Porter to take over the remainder of Beechnut Court that lies in Section 1 of Beechwood Estates. Public Works Foreman Jesse Walls stated that the core samples taken exceed minimal standards but there is a soft spot in the road.

PWF Walls stated that he feels developers should do core samples with City personnel present. He also stated that he feels the requirements for roads should be based on individual roads. He feels we need to change the Design Criteria standards to reflect this.

City Attorney Wantland stated that there should be some standard policy. He suggested having a minimum standard for roads that can be waived.

James Watkins stated he feels if roads need stabilizing that should also be added to the Design Criteria as a requirement for developers.

Mayor Sohm stated we need to check the Design Criteria Ordinance and have PWF Walls go to the Transportation Cabinet District 5 and see what their requirements are.

Mayor Sohm instructed PWF Walls to talk to Jack Porter about fixing the soft spot in the road before the City takes it over.

Assistant Fire Chief Terry Whittaker updated the Council of the radio situation. He reported that he has been talking with Zoneton Fire District and they have okayed Shepherdsville Fire to use Fire Channel 1 for now. He stated he is still looking at obtaining our own FCC license. He stated he’s getting closer to a resolution but there is nothing definite yet.

Mayor Sohm stated that the sewer project is wrapping up. There are a few bugs still to be worked out. A walk through will be scheduled to go over the punch list items by next week.

There was no report from the Historical Committee. Mayor Sohm did state that he had received some information on Brashear Station. He stated it was in the northeast corner 500 paces from the high water mark.

Mayor Sohm reported that several streets including Reesor Alley have been paved in the last several days. He asked the Council if they had additional streets that needed paving to let him know as soon as possible.

Mayor Sohm reported that he had met with Tom Taylor who gave an update on the park layout. He also reported that Tracy Corbit is working on an additional grant for trail ways.

City Attorney Wantland opened bids on the City’s Commercial Property and Inland Marine insurance coverage. There was one bid received from Insurance Connections for $16,400.

After some discussion Larry Hatfield made motion to accept bid. Stacey Cline 2nd. Motion carried 5-0. Larry Hatfield asked that either Mayor Sohm or City Clerk Owen contact the insurer and inquire if a higher deductible would lower the premium.

City Attorney Wantland read Resolution 03-24 acknowledging the need for recreational trails to promote good health and enjoyment for the members of the City. Mayor Sohm stated this is for the trail way grant Tracy is working on. He stated the City can use anything the City contributes as in kind. He stated that Tracy would find out if the property we purchased counts toward the match. Don Cundiff made motion to approve. James Watkins 2nd. Motion carried 5-0.

Bobby Elkins addressed the Council about his property located next to the sewer plant. He asked the Council to come look at his property where he’s getting runoff from the plant. Larry Hatfield stated he had been to look at the property and also asked the Council to go look at the area Mr. Elkins is talking about. Mayor Sohm stated if the Council would like to meet at City Hall tomorrow at 4:00 he would go at that time to look at the property.

David Shain addressed the Council about a lot on Sixth Avenue in Salt River that needs mowing. He stated the address was 240 Sixth Avenue and Peoples Bank of Mt. Washington owned it. Mayor Sohm stated the City would send the bank a letter asking them to mow.

Planning Commission Appointee Ben Robards stated there was one new case for Shepherdsville. Samuel & Vickie Dever are requesting rezoning on a piece or property.

Board of Adjustments Appointee Scott Isert was not present at the meeting.

Fire Chief Robbie Spriggs thanked the Mayor and Council for their support on the fire truck refurbish. He stated they were going to check the progress is about two weeks if anyone wanted to go.

James Watkins asked if we could have Mago look at the potholes on Paroquet Springs Drive?

Don Cundiff asked about the house on Highway 44. Chief Spriggs stated that the material found was not asbestos and they are waiting on final approval from the State to burn.

Larry Hatfield asked when the grade work was going to be done where sewers were put in behind River Oaks? PWF Walls stated that it had been contracted out. He stated he would try to find out when the work would be done by the next meeting.

Larry Hatfield made motion to adjourn. James Watkins 2nd. Motion carried 6-0. Meeting adjourned at 8:30 p.m.
