Mayor Sohm welcomed and thanked everyone for attending the meeting.

 

Sandy Smith, Family Worship Center gave the invocation.

 

The Pledge of Allegiance to the Flag was said.

 

Mayor Sohm called the meeting to order at 6:35 p.m.

 

In attendance were Council members Stacey Cline, Margaret Moore, Faith Portman and Trina Summers and Alan Wetzel.

 

Stacey Cline made motion to dispense with reading of 5/22/2006 regular meeting minutes. Trina Summers 2nd. Motion carried 5-0.

 

Trina Summers made motion to approve minutes as printed. Faith Portman 2nd. Motion carried 5-0.

 

Mayor Sohm stated he would like to set a date for the city-wide garbage pickup. Mayor Sohm stated that due to budget constraints the City was unable to do this last year. After some discussion it was decided the dates would be June 26-30th. Public Works Foreman stated no batteries; paint, tires, refrigerators or air conditioners (unless Freon had been removed) would be picked up.  

 

Discussion followed on changing the July Council Meeting dates. After some discussion Stacey Cline made motion to cancel the July 10th meeting and reschedule it for July 31st. Trina Summers 2nd. Motion carried 5-0. The July 24th meeting will remain the same.

 

City Attorney Joe Wantland had second reading of Ordinance 006-(number to be assigned) proposing annexation of unincorporated territory adjoining the City of Shepherdsville (Owned by S & F Investments). Attorney Wantland stated this is a consensual annexation. Mayor Sohm stated this includes the last 100 feet of

Conestoga Parkway
and the northeast corner of the property. There was no public comment. Trina Summers made motion to approve annexation. Faith Portman 2nd. Motion carried 5-0. (This Ordinance will be numbered 006-694.)

 

Discussion followed on adopting an Ordinance to regulate charitable and not for profit collections in the City. City Attorney Wantland stated this Ordinance could cause problems. Once you regulate you must regulate everyone the same. Councilwoman Stacey Cline stated she has a problem with passing an Ordinance on this. Councilman Alan Wetzel stated he would like to regulate the number of people at an intersection and mandate what they wear. Mayor Sohm stated he could charge a permit; set time requirements; and if organization is not found in violation of Ordinance give their money back. Councilwoman Trina Summers stated if the organization collecting cannot produce a 501c (3) license they are not a true charity. Councilwoman Margaret Moore stated she is just afraid someone will get killed. City Attorney Wantland said he would draw something up.

 

Mayor Sohm reported from the Historical Committee that the stone for the fence at the

1st Street
Cemetery did not come in last week so they should get started this week with putting the stone on the fence.

 

Mayor Sohm stated there were no reports from the Transportation/Beautification or Sewer Committees.

Mayor Sohm reported from the Recreation Committee that the Public Works Department had starting putting together the play ground equipment for

1st Street
Park and it is scheduled to be put up this week.

 

City Attorney Wantland had first reading of Ordinance 006-(number to be assigned) adopting the City of Shepherdsville, Bullitt County, Kentucky, annual budget for fiscal year July 1, 2006 through June 30, 2007 by estimating revenues and resources and appropriating funds for the operation of City Government. Mayor Sohm stated the second reading and public hearing would be June 26th. (Tony Miller came in at this time.)

 

City Attorney Wantland had first reading of Ordinance 006-(number to be assigned) adopting the City of Shepherdsville, Bullitt County, Kentucky, Water and Sewer Operation and Maintenance budget for fiscal year July 1, 2006 through June 30, 2007 by estimating revenues and resources and appropriating funds for the operation of the Water and Sewer Department. Mayor Sohm stated the second reading and public hearing would also be June 26th.

 

City Attorney Wantland had first summary reading of Ordinance 006-(number to be assigned) amending Ordinance 006-689 an Ordinance providing Personnel Policies and Procedures for all employees of City Government located in the City of Shepherdsville, Bullitt County, Kentucky.

 

City Attorney Wantland had first reading of Ordinance 006-(number to be assigned) concerning request by Bobby Clemons and Carol Clemons to rezone 62’ x 260’ of property located at

670 W Blue Lick Road
from R-2 Residential to R-3 Residential. Mayor Sohm stated that since this request was initiated the property has changed hands and the new owner would be present at the next meeting.

 

City Attorney Wantland had first reading of Ordinance 006-(number to be assigned) concerning request by Martha Lynn Eddington, Kenneth Eddington and Mildred Eddington to rezone 150’ x 200’ of property at 314 Old Preston Highway South and is lots 21, 22, 23, 24, 25 and 26 of the W.H. Hayes Estate Subdivision from Agricultural and B-2 Central Business.

 

Mr. Dan DeGrella was present to address the Council about final pavement in Shawnee Acres subdivision. He stated there were 52 lots in the subdivision and 47 were now occupied. He stated there are large pot holes, uneven roads and several problems with the road. He stated he knew that the developer Lou Sharp has passed away and Richard Miles had bought some lots. He stated that he had spoken with Mr. Miles and was told that this is Mr. Mills’s responsibility to pave. (There were also several other residents of Shawnee Acres in attendance at the meeting regarding this problem.) Mayor Sohm stated that he contacted Richard Miles who will contact Rick Mills who is supposed to finish the final pavement after the last house is built. Mayor Sohm stated the responsibility lies with Rick Mills. Mayor Sohm stated he would discuss this situation with Richard Miles. City Attorney Wantland stated that the residents of Shawnee Acres should get together and file a suit against Mr. Mills if he does not finish the road. Mayor Sohm also suggested getting the Homeowner Association established in the subdivision. Mayor Sohm also stated he is working to have more street lights installed in the subdivision. Mayor Sohm asked Mr. DeGrella to leave his contact information and he would keep him posted on what he found out.

 

Planning Commission Appointee Ben Robards stated there were four cases for Shepherdsville. Dona Smith, Executrix of the Junie Rummage Estate requested to rezone 150’ x 155’ of property located at

175 N. Maple Street
from R-1 Residential to B-2 Central Business. Mr. Robards stated this request had been denied by the Planning Commission. MSRSF Investments LLC, S & F Properties LLC and Benjamin Robards III requested to rezone 169.84 acres, more or less (41.694 acres on the south side at N Preston Highway and 128.144 acres on the east side abutting the southbound lanes of I65) located on Conestoga Parkway from Agricultural, IL Light Industrial and IG General Industrial to B-2 Central Business. Mr. Robards stated this request was approved. Land Development Group, Inc. requested to rezone 47.30 acres, more or less, located at 3088 Highway 44 East from B-2 Central Business and R-2 Residential to R-3 Residential. Mr. Robards stated this request had been tabled.  Michael and Velva Spurlock requested to rezone 1.44 acres, more or less, located at
190 Cedar Grove Road
from B-2 Central Business and R-4 Residential to IL Light Industrial. Mr. Robards stated this request had been approved. Mr. Robards also reported that 61 homes had been approved in the Mallard Lakes subdivision.

 

Board of Adjustments Appointee Scott Isert was not present at the meeting.

 

City Engineer Toby Spalding passed around some before and after pictures to the Council to view of the drainage project just completed at The Pointe Subdivision.

 

Assistant Fire Chief Terry Whittaker stated he had read the Appellate Court ruling on the fire department. He asked City Attorney Wantland if Shepherdsville Fire could now make fire runs within the City limits again. City Attorney Wantland answered yes, we are starting over with the lawsuit. He stated we would send a letter to Bullitt County Dispatch stating such. City Attorney Wantland stated that the Citizens of Shepherdsville are still paying both taxes but the fire department will again respond to City calls for service.

 

Councilwoman Trina Summers asked about putting an acceleration lane at the asphalt company on Highway 61. She stated she has received several complaints from citizens who come up behind a truck that has just pulled out of there and can hardly get up the hill. Mayor Sohm stated we would have to get the State involved and that it would be a great expense. Ms. Summers asked if it was something we could look at possibly in the future. Mayor Sohm stated we could do that now, especially since we have a City Engineer. Ms. Summers also asked about mowing grass along the sidewalk at the interstate ramps. Public Works Foreman Jesse Walls stated he had spoken with the State about this and was told that several cities are now doing this. Mayor Sohm asked PWF Walls to get in touch with Mr. Couch or Mr. Hartlage at the State and find out if the City could bid this on an annual basis.  Trina Summers made motion to authorize the Mayor to engage in negotiations to do what is necessary to provide grass cutting and weed eating along the interstate ramps inside the City limits. Alan Wetzel 2nd. Motion carried 6-0.

 

Mayor Sohm asked for a motion to adjourn to executive session to discuss litigation. Faith Portman made motion to adjourn to executive session. Stacey Cline 2nd. Motion carried 6-0.

 

Faith Portman made motion to return to regular session. Alan Wetzel 2nd. Motion carried 6-0. Mayor Sohm stated that the City Attorney had been given instruction on how to proceed.

 

Alan Wetzel made motion to adjourn. Faith Portman 2nd. Motion carried 6-0. Meeting adjourned at 8:43 p.m.
