July 24, 2006 Mayor Sohm welcomed and thanked everyone for attending the meeting.
Pastor Randy Pace, Family Worship Center gave the invocation. The Pledge of Allegiance to the Flag was said. Mayor Sohm called the meeting to order at 6:33 p.m. In attendance were Council members Stacey Cline, Tony Miller, Margaret Moore, Faith Portman, Trina Summers and Alan Wetzel. Trina Summers made motion to dispense with reading of 6/26/2006 regular meeting minutes. Stacey Cline 2nd. Motion carried 6-0. Tony Miller made motion to approve minutes as printed. Margaret Moore 2nd. Motion carried 6-0. Mayor Sohm announced that the Wastewater Treatment Plant had been awarded an Operational Excellence Award for Continued Outstanding Operation from the Kentucky-Tennessee Water Environment Association for the period of January 1, 2005 – December 31, 2005. Mayor Sohm reminded everyone that the Sewer Progress Meeting would be Monday, July 31st at 5:30 p.m. at City Hall. Mayor Sohm announced that the audit would be presented at the July 31st meeting. Mayor Sohm announced that the re-dedication ceremony for the Shepherdsville Cemetery would be held on Saturday, August 5th at 12:30 p.m. in conjunction with the Civil War re-enactment that will be held on August 5th and 6th at First Street Park. City Attorney Wantland had second reading of Ordinance 006-(number to be assigned) adopting regulations on charitable and not for profit collections within the City limits. After some discussion motion wad made by Tony Miller to approve. Faith Portman 2nd. Motion carried 4-2 (Trina Summers and Stacey Cline voted against). (This Ordinance will be numbered 006-699.) City Attorney Wantland had second reading of Ordinance 006-(number to be assigned) confirming annexation of unincorporated territory adjoining the City of Shepherdsville. (Owner: S & F Investments; remainder of Conestoga Parkway.) Trina Summers made motion to approve. Alan Wetzel 2nd. Motion carried 6-0. (This Ordinance will be numbered 006-700.) City Attorney Wantland had second reading and public hearing on Ordinance 006-(number to be assigned) on request by Dona Smith, Executrix of the Junie Rummage Estate to rezone 150’ x 155’ located at 175 N Maple Street from R-1 Residential to B-2 Central Business. Jennifer Porter addressed the Council on this zoning request representing the applicant in favor of the request. She stated her clients feel the property in its present zoning is not being used for its best use. She passed around photos of the surrounding businesses around this property. Angela Raley, 162 N Oak Street and Kathy Stevens, 170 N Oak Street addressed the Council in opposition of the rezoning request. She stated she was speaking on behalf of Patti Bradford, Pastor Stoess and Mrs. Thomas. She stated they feel the zoning requested is not conducive to family values and that it would negatively impact property values. She stated they do not want their lifestyle and neighborhood changed. Ms. Raley also stated there are drainage issues in the area and if a parking lot is put in drainage problems would worsen. Ms. Raley and Ms. Stevens also passed around photos of the area. She stated it’s not about a dollar issue; she has worked hard for her home and would like to area to remain as is. Councilman Tony Miller stated he had received a call from a neighbor who stated they don’t care what they do with the house. Dona Smith stated there are no plans at this time for the property; she feels it doesn’t have much resale value as a home. Councilwoman Trina Summers stated that after the property is sold Rummage/Smith will lose control of what could go in the B-2 zoning. B-2 has many uses. Mr. Kenneth Smith spoke in favor stating that water runs down hill and he feels that drainage issues and rezoning requests are two different issues. Councilwoman Stacey Cline stated we all know there are drainage issues throughout Bullitt County and she does not feel this is an issue in the rezoning request. She stated it is a tough issue and does not feel anyone is going to buy the property as residential. Councilwoman Margaret Moore stated she goes to Pic Pac frequently and didn’t really realize how much the lights shone in Mrs. Rummage’s house. She stated this would be a huge factor if the property were a home. Councilman Alan Wetzel stated this was a hard issue for him because there are a lot of uncertainties because we don’t know what’s going in there and drainage is a concern on this property. He stated there is a lot of property in the City that is vacant and there are a lot of kids in this area with the day care. Councilwoman Faith Portman stated that her concern was the kids; she feels this zoning is too close to kids. Councilman Tony Miller stated he also feels it’s too close to kids and the B-2 zoning is so uncertain. Mayor Sohm closed the public hearing. Tony Miller made motion to adopt the recommendation of the Planning Commission to deny this rezoning. Faith Portman 2nd. Motion carried 5-1. (Stacey Cline voted against.) (This Ordinance will be numbered 006-701.) City Attorney Wantland had second reading and public hearing on Ordinance 006-(number to be assigned) on request by MSRSF Investments LLC, S & F Properties LLC and Benjamin Robards III to rezone 169.84 acres, more or less (41.694 acres on the south side at N Preston Highway and 128.144 acres on the east side abutting the southbound lanes of I65) from Agricultural, IL Light Industrial and IG General Industrial to B-2 Central Business. Attorney John Wooldridge was present on behalf of the applicants. He stated the property meets the comprehensive plan and has all utilities. There was no opposition to the request. Mayor Sohm closed the public hearing. Tony Miller made motion to adopt recommendation of the Planning Commission to approve this rezoning request. Trina Summers 2nd. Motion carried 6-0. (This Ordinance will be numbered 006-702.) City Attorney Wantland had second reading and public hearing on Ordinance 006-(number to be assigned) on request by Michael and Velva Spurlock to rezone 1.44 acres, more or less, located at 190 Cedar Grove Road from B-2 Central Business and R-4 Residential to IL Light Industrial. Velva Spurlock, owner of S & S Panel was in attendance. She stated her business had been grandfathered since 1992 and she is just trying to get in compliance. She stated she’s not going to change what’s there now. There was no opposition to the request. Mayor Sohm closed the public hearing. Tony Miller made motion to adopt the recommendation of the Planning Commission to approve this rezoning request. Stacey Cline 2nd. Motion carried 6-0. (This Ordinance will be numbered 006-703.) Mayor Sohm stated the Historical Committee report was covered in the announcements. Mayor Sohm reported from the Transportation/Beautification Committee that he had met with Richard Miles about cleaning up Highway 61. He stated Mr. Miles is very interested in getting this area cleaned up and offered his help in any way the City may need it. Mayor Sohm stated there was no report from the Recreation or Sewer Committees. City Attorney Wantland had first reading of Ordinance 006-(number to be assigned) on request by Land Development Group Inc. to rezone 47.30 acres, more or less, located at 3088 Highway 44 East from B-2 Central Business and R-2 Residential to R-3 Residential. Mayor Sohm stated the second reading would be August 14th. City Attorney Wantland had first reading of Ordinance 006-(number to be assigned) on request by Rolling Acres Farm, LLC to rezone 16 acres, more or less, located on the north side of Buffalo Run Road at its intersection with Ohm Drive from IL Light Industrial to IG General Industrial. Mayor Sohm stated this would also have the second reading on August 14th. Tim and Donna Wise, 145 4th Avenue was present to address the Council about the vacant house on 4th Avenue. They stated they were still concerned about the property next to them that has been abandoned for three years. Mayor Sohm stated he agreed with Mr. & Mrs. Wise; something needs to be done about this property. Mayor Sohm stated the City had gone in and cleaned up the property and has mowed the grass several times. He would like the City for foreclose on the money owed to it and get the Fire Marshal involved to have an order to remedy written. Mr. Wise stated there is no porch and a beam has been knocked down. He stated he would send Fire Chief Spriggs to look at the property and get an order to remedy written up. He asked Attorney Wantland to foreclose on the amount due the City. Trina Summers made motion to proceed with legal resolution and safety issues in regard to 133 4th Avenue. Faith Portman 2nd. Motion carried 6-0. Mayor Sohm asked Public Works Foreman Jesse Walls to board the house up if we can. Planning Commission Appointee Ben Robards stated there were two zoning cases for Shepherdsville. Land Development Group and Rolling Acres Farm LLC. He also stated there was three subdivision plats approved. Mayor Sohm stated that he had appointed Duane Price as the City’s Appointee to the Board of Adjustments. He stated Duane was unable to attend the meeting tonight but would be here at the next meeting. Public Works Foreman Walls stated they had started on the Wilbur Raymond project today. Councilman Tony Miller stated that Channel 41 did a tremendous job last Saturday when speaking with Assistant Fire Chief Terry Whittaker. Councilwoman Stacey Cline stated she wanted to thank Code Enforcement Officer John Bradley for getting the golf course mowed. Councilwoman Faith Portman stated the grass at Park Place on Highway 44 East needed to be mowed. She also thanked the City employees on the garbage pick up. Tony Miller made motion to adjourn.
