Mayor Sohm welcomed and thanked everyone for attending the meeting.

 

Father David Naylor, St. Aloysius Catholic Church gave the invocation.

 

The Pledge of Allegiance to the Flag was said.

 

Mayor Sohm called the meeting to order at 6:34 p.m.

 

In attendance were Council members Tony Miller, Margaret Moore, Trina Summers, and Alan Wetzel.

 

Trina Summers made motion to dispense with reading of 7/31/2006 special regular meeting minutes. Tony Miller 2nd. Motion carried 4-0.

 

Tony Miller made motion to approve minutes as printed with correction to date on second page. Alan Wetzel 2nd. Motion carried 4-0.

 

City Attorney Wantland had second reading and public hearing on Ordinance 006-(number to be assigned) on request by Land Development Group Inc. to rezone 47.30 acres, more or less, located at 3088 Highway 44 East from B-2 Central Business and R-2 Residential to R-3 Residential. City Attorney Wantland stated the Planning Commission had approved with restrictions. The restrictions are all lots shall be a minimum of 80’ in width at the building line and meet the minimum requirements of R-2 zoning and only single family dwellings shall be constructed on the property. Attorney Mark Edison was in attendance at the meeting representing the applicant and stated this was the Bridwell property on 44 East and there will be a turning lane put in at the entrance. Joe Downs, developer at the property stated the first floor would be 1500 square foot and if the house is a two story the first floor would be 1100-1200 square foot. There was no comment from the public. Tony Miller made motion to accept the Planning Commission recommendation with restrictions. Alan Wetzel 2nd. Motion carried 4-0. (This Ordinance will be numbered 006-704.)

 

City Attorney Wantland had second reading and public hearing on Ordinance 006-(number to be assigned) on request by Rolling Acres Farm, LLC to rezone 16 acres, more or less, located on the north side of Buffalo Run Road at its intersection with Ohm Drive from IL Light Industrial to IG General Industrial. Attorney John Wooldridge was present representing the applicant. He said the property would be used for an enclosed concrete plant with 16 trucks on site. He said a retention basin would be on site for water run-off from washing down the trucks. He said there would be deed restrictions that the property can only be used for one purpose; if that company no longer exists the property will revert back to IL usage restricted to five uses: asphalt plant; ceramic; machine shop; structural steel. Councilwoman Trina Summers asked what the hours of operation would be. Attorney Wooldridge said probably 6:00 a.m. to 4:00 p.m., daylight operation. City Attorney Wantland stated since there were two Council members not present tonight he would like to postpone the vote until the next meeting if the Council agrees. Mayor Sohm stated we would go ahead with the public hearing and then decide to postpone if the Council wishes. Mayor Sohm opened up the public hearing. Wastewater Treatment Plant Superintendent Mike Schroeder asked if there was zero process wastewater going into the sewer. Mr. Wooldridge answered no. There were no other comments from the public so Mayor Sohm closed the public hearing. Attorney Wooldridge stated there were similar plants on

Hounds Lane
in Eastern Jefferson County and a Sellersburg, Indiana plant which is the same plant they are planning to open here. Councilman Alan Wetzel stated he would like to visit the plants and he agrees that everyone should be present for this discussion. Councilwoman Margaret Moore stated she feels it is in the best interest to wait until next meeting for a decision. Alan Wetzel made motion to table this discussion for further investigation and bring up again at the August 28th meeting for vote. Trina Summers 2nd. Motion carried 4-0.

 

Mayor Sohm reported that the Civil War re-enactment and re-dedication ceremony for the Shepherdsville Cemetery went great. He stated there were several hundred people there and he received several positive comments about the park. Councilwoman Trina Summers also stated the ceremony went great and encourage people who did not attend to go visit the Cemetery.

 

Mayor Sohm reported from the Transportation/Beautification Committee that he has a list of streets to the paved/patched. Councilwoman Trina Summers asked about the Highway 480 project. Mayor Sohm stated that he is waiting on contracts from the State for signature then the project can begin.

 

Mayor Sohm reported from the Recreation Committee that the additional park equipment, picnic tables, benches and grills are in and about one-half mile of the trail at First Street Park has been cut in and dense grade put on it.

 

City Engineer Toby Spalding reported from the Sewer Committee that he would like to address the formation of the Drainage Committee at the next meeting when all the Council members are present. He stated he would like to have one or two council members on the Committee. Councilwoman Trina Summers and Councilman Alan Wetzel volunteered to be on the Drainage Committee and will meet with City Engineer Spalding to discuss and begin prioritizing drainage problems within the City. Mr. Spalding stated if they knew anyone from the public who would like to sit on this committee to let him know.

 

Vickie Carter,

addressed the Council about her parents who live at
138 S Plum Street
. She stated she is living with her parents at this time as their primary caregiver. She stated that the Police Department is going a wonderful job patrolling this area. However, she feels the first lot from Highway 44 West on the left which is empty is very dark and there have been several instances of vandalism. She would like a light pointed on to
Plum Street
to light the area. Mayor Sohm stated that he has spoken with Bennie Stillwell with the Public Works Department about a light being put on the existing pole and newer lights replacing the old lights be put on Plum. Police Chief Ron Morris stated that there has been a bike patrol and a directive patrol in this area. Chief Morris also reported that Detective Meyer has gone and spoke with residents and that Officer Smothers is trying to contact Ms. Walden about a Block Watch Program. 

 

Planning Commission Appointee Ben Robards reported that the Commission approved 85 lots for the Claude Lundy development.

 

Board of Adjustments Appointee Duane Price was not present at this meeting.

 

Police Chief Morris stated that the department had received a grant for body armor in the amount of $2300.

 

City Attorney Wantland asked Public Works Foreman Jesse Walls to get an estimated cost on what it would take to bring to code and finish Shawnee Acres streets. He stated there is no one to go after for repairs at this time. Councilwoman Trina Summers stated she doesn’t want to penalize property owners by assessing their tax bills for them to pay. Mayor Sohm stated we could pave the streets through the City and get it done cheaper.

 

Councilman Tony Miller asked that the alleyway behind the Florist be added to the list to be paved. He also stated that the vandalism to the street lights he reported on has not been fixed.

Councilwoman Margaret Moore made motion to adjourn to executive session to discuss personnel. Tony Miller 2nd. Motion carried 4-0.

 

Alan Wetzel made motion to return to regular session. Margaret Moore 2nd. Motion carried 4-0. City Attorney Wantland stated the Mayor and Attorney had been given instructions to follow up on several issues and will do so.
